EXPRESS the Board's intent that all Commission members shall comply with the Board's policy (ResolutionNo. 821574) to avoid and not have any conflicts of interest concerning Commission membership. 4. REQUEST the Family and Human Services Committee to review candidates for the representative and pediatrician positions at their March 8, 1999 meeting, recommending appointments to the Board of Supervisors. 5. DECLARE the intent of the Board of Supervisors to stagger the terms of the representative and pediatrician appointments with two appointments being for two years and the other two for four years. 5. EXPRESS strong support for the establishment of an advisory committee network to ensure broad public participation in the Children and Families First Commission. 7. DIRECT the County Administrator to prepare options on the operationaliziing the advisory committee network, including the possibility of establishing an advisory committee on service and programmatic issues and another on financial issues. 8. REQUEST the Family and Human Services Committee to review these options at their March 8, 1999 meeting and to recommend a preferred structure for public participation to the Board of Supervisors. 9. REQUEST the County Administrator to return to the Family and Human Services Committee after the Commission has,been operational for one year to evaluate its progress. CHILDREN'S IMPACT STATEMENT The new Children and Families First Commission will support the community outcomes of "Children Ready For and Succeeding in School," "Children and Youth Healthy and Preparing for Productive Adulthood" and "Families that are Safe, Stable and Nurturing." The Children and Families First Commission will be providing funding to support the healthy birth and development of children up to the age of 5. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): On January 25, 1999, the Family and Duman Services Committee received the attached report on the Children and Families First Commission (proposition 10). Scott Tandy, Chief Assistant County Administrator, reviewed the provisions of County Ordinance 98-48, which provides that the Commission shall have nine members with representation in designated categories. The Board of Supervisors requested the Family and Human Services Committee review the categories and recommend membership to the Board of Supervisors. Mr. Tandy also reviewed the need for a broad public participation with the new Commission and recommended the establishment of a network of advisory committees and boards. Dr. William Walker, Health Services Director, also spoke to the desirability of establishing a network of advisory committees and boards to support the development of the required strategic pian. In response to a question by Supervisor Gayle Uilkema, Vic Westman, County Counsel, stated that the Prop 10 commission could have between five and nine members; however, the Board of Supervisors in County Ordinance 98-45 chose to establish the Commission with nine members. Mr. Westman further advised the Committee that the funds from Proposition 10 could not be expended prior to adoption of the required strategic plan, which must be consistent with state guidelines. However, if state guidelines are not available as of July 1, 1999, the local plan is automatically grandfathered as approved. The Board members discussed the matter, then Chairman Canciamilla invited the public to comment. At the same meeting, the Board determined that the new Commission would be composed ofnine members representing the categories established in the Proposition 10 language. The Board of Supervisors referred further consideration of appointments to the Family and Human Services Committee at their first meeting in January 1999. Comp =CatewriesC �tor Pursuant to Proposition 10 and County Ordinance 98-46, County Commission members shall be appointed as follows: (a) One member of the County Commission shall be a member of the Board of Supervisors. (b) Two members of the County Commission shall be from among the County Health Officer and persons responsible for management of the following county functions: children's services, public health services, behavioral health services, social services, and tobacco and other substance abuse prevention and treatment services. 2 (c) The remaining members of the County Commission shall be from among the persons described in subsection (b) and persons from the following categories: (1) Recipients of project services included in the county strategic plan; (2) Educators specializing in early childhood development; (3) Representatives of a local child care resource or referral agency, or a local child care coordinating group; (4) Representatives of a local organization for prevention or early intervention for families at risk; (5) Representatives of community-based organizations that have the goal of promoting nurturing and early childhood development, (b) Representatives of local school districts; (7) Representatives of local medical, pediatric, or obstetric associations or societies; and (8) Representatives of local mental health organizations. A,pwin ,,nj ReccQ __endatio After consultation with County Counsel, the Health Services Director and the Social Service Director, we suggest that the Family and Human Services Committee recommend that the Board of Supervisors appoint the following persons and representatives, pursuant to Proposition 10 and County ordinance, as initial members of the Commission: =tySlWmds : One member shall be a County Supervisor. Proposition. 10 is so strongly focussed on services for children that it is important that the three department heads with direct management and programmatic responsibilities 3 be appointed. The County Health {officer, as well as persons responsible for management of County children's services and social services, should be members of the Commission. &p rin=d of 0oIs: Representatives of local school districts or educators specializing in early childhood development can be appointed, and the Superintendent of Schools is the only person who operates special education programs and has countywide responsibilities for school districts, as well as being an elected official. ' ; This appointee meets both the intent of initiative language for behavioral and treatment services as well as the composition category added by the Board in the ordinance for local mental health organizations. Last year the Board of Supervisors and Superintendent of Schools appointed a thirty-member Local Planning Council for Child Care and Development which is now operating in compliance with AB 1534 and welfare reform legislation. This category meets the criteria of both the initiative and the ordinance. ; bstg=Abuo,Ady-ismy a rd pre= iv j. An appointee from this category, again, meets the provisions of both the initiative and the ordinance. pr ?rams: An appointee in this category meets the intent of a representative of local medical, pediatric or obstetrics association or society as contained in the initiative. Representatives from the Substance Abuse Advisory Board, the Mental Health Advisory Board and the Local Planning Council for Child Care and Development are recommended because these are groups appointed by the Board of Supervisors to provide expert advice on programs relevant to Proposition 10. Finally, we think it is important to include a medical professional with early childhood development expertise. County Counsel has advised that if a second Supervisor were to be considered for appointment,the Board of Supervisors should be satisfied that the Supervisor qualifies 4 under one of the other subsections specified in Proposition 10 and in Section 26- 14.006 of Ordinance 98-46. If the Committee decides to pursue a second Supervisor appointment, we recommend that you substitute the board certified pediatrician representative. Advice 5mU?,eNeor ublic P t c' at'on Proposition 10 requires that a County strategic plan be developed that describes how program services and projects related to early childhood development within the County will be integrated into a consumer oriented and easily accessible system. The County Commission shall on an annual basis review its strategic plan and revise the plan as necessary and conduct at least one public hearing before it is adopted. The County strategic plan is then submitted to the State Commission prior to any funding being made available. In order to address the broad public participation objectives contained in Proposition 10, we recommend that the Commission establish a network of advisory committees to provide both technical and professional input and recommendations as necessary and appropriate. Prior to adopting the strategic plan, the Commission will notify this network of advisory committees in advance of the public hearing so that they will have an opportunity to provide input to the Commission. The network of advisory committees to the Commission would consist of at least the following: Fancily and Children's Trust (FACT) Public and Environmental Health Advisory Board (PEHAB) Juvenile Justice Commission Developmental Disabilities Council Family Preservation and Family Support Group Head Start Policy Council Interagency Council of Infant Services (ICIS) Local Resource and Referral Agency (Child Care Council) Child Abuse Prevention Council Contractor's Alliance Alcohol, Drug.Abuse, Perinatal Task Force (ADAPT) Child Care Directors' Association S S=M= The recommendations contained in this report will address the intentions of Proposition 10 and will allow the continuation of the work of the Children and Families Policy Forum in the past several years and open participation to additional community-based agencies and groups. In addition, it meets the recommendations for composition appointment, meets the intentions of the law; and is consistent with the ordinance that was adopted by the Board of Supervisors on November 25, 1998. Chapter 26-14 is added to the County Ordinance Code to read: Chapter 26-J4 Child-en an p`amilles First Omission 2fi ,002 Purpose and Authoft, This chapter provides for the establishment of Contra Costa County's Children and Families First Commission to implement the provisions of Proposition 10 adopted on November 3, 1998 and its Division 108 (commencing with Section 130100) added to the Health and Safety Code. (a) The commission shall meet at least every quarter and more often as necessary to perform and complete its duties as required this chapter and law. The commission shall select its chair, and shall adopt, by a majority vote, such rules as It shall deem expedient for the conduct of its business. (b) The commission may establish standing or ad hoc committees of its member. (c)All meetings of the commission shall be public except as provided by law. Members of commission shall not be compensated for their services, except they shall be paid reasonable per them as fixed by board order and reimbursement of reasonable expenses for attending meetings and discharging other official responsibilities as authorized by the commission. The commission shall adopt an adequate and complete county strategic plan for the support and improvement of early childhood development within the county. The [Revised 12-8-981 ORDINANCE NO. 98- 46 2— county strategic plan shall be consistent with, and in furtherance of the purposes of, the California Children and Families First Act of 1998 and any guidelines adopted by the state commission pursuant to subdivision (b)of the Health and Safety Code Section 130125 that are in effect at the time the county plan is adopted. (a) The county strategic plan shall, at a minimum, include descriptions of the following: (1) The goals and objectives proposed to be attained; (2) The programs, services, and projects proposed to be provided, sponsored, or facilitated; and (3) How measurable outcomes of such programs, services, and projects will be determined by the county commission using appropriate reliable indicators. (b) The county strategic plan shall not be deemed adequate or complete until and unless the plan describes how programs, services, and projects relating to early childhooddevelopment within the county will be integrated Into a consumer-oriented and easily accessible system. (c) The county commission shall conduct at least one public hearing on Its proposed county strategic plan before the plan is adopted. (Ord. 93-. 1.) ,0.1„8 Annual plan review and rests o s. The commission shall, on at least an annual basis, periodically review Its adopted county strategic plan and revise the plan as.may be necessary or appropriate. The commission shall conduct at least one public hearing on Its periodic review of the county strategic plan before any revisions to the plan are adopted. (Ord. 93- .§ 1.) 26-J4.022 Annual audit-reports and headngs. (a) County annual audit report. The commission in a'timely manner ORDINANCE NO. 98- 46 3-- snail prepare and adopt an annual audit and report pursuant to Health and Safety Code section 130150. The commission shall conduct at least one public hearing prior to adapting any annual audit and report. (b) State annual audit report. The county commission in a timely manner shall conduct at least one public hearing on each annual report by the state commission prepared pursuant to subdivision (b) of section 130150 of the Health and Safety Code. (Ord. 98--4K§ 1.) 26-14,924 Local trust fund. The local Children and Families First Trust Fund Is hereby created and established in the Contra Costa County Treasury. Moneys deposited in this trust fund shall be expended only for the purposesauthorized by the California Children and Families First Act of 1998 (Health and Safety Code §§ 130100 ff.) and in accordance with the commission approved county strategic plan. The dental Health Commission has reviewed the proposed composition of this new Commission as contained in the January 19th memorandum from Phil Batchelor to the Family and Duman Services Committee. We would like to compliment the County Administrator and the Board for goosing to have a nine member Commission (the largest allod under the Proposition) and for putting considerable thought into the composition of the new Commission and its Advisory Committee(s). We are pleased to see the inclusion of a Mental Health Commission representative which is indicative of this county's leadership rale in recognizing the mental health needs of our youngest and most vulnerable population. We do have some concerns about both the membership and timeline for this Commission. Community Focus and Representation on the Commission: Of the nine members, four are from county management and administration, one is from education administration, one is a physician, and only three are from community.advisorytgroups. • No members are from community based organizations. No members are parents, grandparents,foster parents, or ethers who have recently received or are currently receiving pre or past natal services for their infant to school age children. We are concerned that this composition is"top heavy"with professionals and does not allow for sufficient participation in decision making positions of service recipients and community based service providers. The County Administrator's recommendation that the Commission establish a network of Advisory Committee(s) to increase community participation, is an excellent idea, and will greatly add to the expertise of such a small Commission. However, the ultimate decision making authority still rests with the Commission. We have a unique opportunity in the development of this Commission to fully include families in the information development process and decisions that will have a direct impact on their lives. The Mental Health Commission recommends that the Board certified pediatrician be replaced by a community member who is a current or recent recipient of pre natal or eadly childhood services. Additionally we would ask the Board to consider more closely adhering to the wording of the Proposition which states that'"two members of the Commission shall be from among the County Health Officer and persons responsible for the management of...children`s servlces, public health services, behavioral health services, social services, and Contra Costa Substance Abuse Services+Contra Costa Emergency Medical Services•Contra Costa Environmental Health e Contra Costa Health Pian <Contra CHa2srdous Materials Programs-Contra Costa Mental Health•Contra Costa Public Health•Contra Costa Regional Medical Center.Contra Costa Health Centers tobacco and ether substance abuse prevention and treatment services''. Ey appointing two rather then three department administrators, that would leave one position available for a representative from a community based organizations We understand the concern about conflict of interest, especially for community based organizations which may receive a portion of this funding to provide services. However; we feel that this conflict equally applies to administrators whose department run programs may receive funding. We would be pleased to work with the Board and County Counsel to resolve this potential conflict. Advisory Committee(s) Memberships In addition to those groups listed in the January 19th memorandum, The Mental Health Commission recommends adding: • Family and Children's Services Advisory Committee • Maternal, Child, and Adolescent Health Advisory Board • Special Education Local Flan Area (SELPA) representatives • Community Advisory Committees(CAC's) representatives • All community based organizations serving this population • Children's.services workers and management from county departments • Parents, grandparents, foster parents, and other family members This is just a partial list of those whose input will be crucial to the development of a comprehensive strategic plan. We would be willing to work with the Family and !'lumen Services Committee to develop a more complete list. Timing: This is an exciting opportunity for us to develop a true "System of Care" for our youngest citizens. In order to optimize this new funding we need to make a careful study of existing services and their effectivenes, determine gaps, and develop expected performance outcomes. Only then can we develop a comprehensive strategic plan. Waiting until the March 8th meeting of the Family and !=lumen Services Advisory Committee to make recommendations on specific appointments to the Commission and to plan for participation on the Advisory Committee(s)will lose an entire month. With a deadline of July 1 st to submit our plan or possibly lose funding we need to begin IMMEDIATELY. The Mental health Commission recommends that the Family and Human Services Committee at Its February 8th meeting develop the appointment process and review appointments at Its next meeting in February. If there is no meeting planned for February 22nd dues to the President's Jay holiday, MHC would request a.special meeting so that appointments can be made In a timely fashion Thank you for taking prompt action on the development of this new Commission. Please feel free to call us for clarification on any of our recommendations. We look forward to working with you and the new Commission to ensure that this infusion of funding goes to provide exemplary services for our children and families.
