SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&.BACKGROUND AND JUSTIFICATION 1. RECOMMENDED ACTION. AWARD the contract to Space Leasing Company in the amount of$273,222; AUTHORIZE the Executive Director of the Housing Authority to execute the contract with Space Leasing Company upon receipt of satisfaction performance and payment bonds and insurance certificates; ORDER that in accordance with the project specifications and/or upon signature or the contract,any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; ORDER that the Executive Director is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the Housing Authority to ensure performance under the contract,pursuant to Section 22300 of the Public Contract Code;and Pursuant to Public Contract Code Section 4114,DELEGATE the Board's functions under Public Contract Code Sections 4107 and 4110 to the Executive Director or his designee. DENY the protest of Taber Construction for award of contract to Space Leasing. DECLARE that,should the award of the contract to Space Leasing be invalidated for any reason,the Board would not in any event have awarded the contract to any other bidder,but instead would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in cases where the successful bidder established a mistake,refuses to sign the contract,or fails to furnish required bonds or insurance(see Public Contract Code Sections 5100-5107). II. FINANCIAL IMPACT: This contract is funded by Federal grants to the Contra Costa County Community Services Department. There are no County general funds involved in the funding of this contract.The amount of the contract is within the amounts budgeted. III. REASONS FOR RECOMMENDATION/BACKGROUND Bids for the above captioned project were received on December 17, 1998,There were six(6)bids received.A copy of the Bid Abstract is attached. The lowest monetary bidder was Space Leasing Company($273,222). Space Leasing Company's bid was found to be complete and responsive. Funding for this project is provided through a grant received by the County Community Services Department from the Federal Administration for Children and Families. Investigation revealed that the protest is invalid based on advice of County Counsel's Office that subcontractors may be substituted and/or Space Leasing may perform the work under standard program criteria. IV. The Housing Authority is under contract with the County Community Services Department to construct two much needed mead Start classroom facilities. Both facilities will be located at the Housing Authority's public housing developments, one at Brentwood and one at Oakley. These facilities will serve the greater community and our residents. Brentwo6d Facility: Our goal is to have the building (a one classroom modular building) ready for occupancy by the summer of this year. This requires an expedited schedule. The funding for the construction is through the Federal Administration for Children and Families Program, and is subject to public bidding requirements. Brentwood Bid Process: The Housing Authority publicly advertised and put this jab out to bid in November 1998. Six bids were received on December 17th, 1958. The apparent low bidder was Space Leasing Company in the amount of$273,222. Other bids ranged up to $923,500 (See Bid Abstract dated 12/17/98). The day after bids were received we got a letter of protest from Taber Construction. Taber was the third lowest bid receivers. Taber chimed that two of the subcontractors, Run's Backhoe and Northstar Construction Plumbing and Fire Protection, listed by the low bidder, Space Leasing, did not hold current contractor's licenses or bonding. Further, Taber claimed that Ron's Backhoe's subcontractor's license did not cover all of the work required under the sub-contract. After receiving Taber's bid protest, staff contacted Space Leasing to discuss the matter. According to Space Leasing, Northstar's license was,temporarily suspended due to an \\housauth}.\user\home\rmeew\msofiice\wirword\memo.doc oversight and soon will be reinstated,, Since Northstar will be properly licensed at the time of contract award, Space Leasing plans to use Northstar for the listed work (installation of fire sprinklers). As for Ron's Backhoe, it is unknown whether they will be able to reinstate their suspended license by the time of the contract award. If not, Space Leasing will propose to substitute another subcontractor for the listed work (pipeline, grading, paving, and concrete). Such substitution is expressly authorized under the Subcontractor Listing Law (Public Contract Code Section 4107 (a) (6)) where a listed subcontractor is not properly licensed. Following consultation with the County Counsel's Office, we sent a response letter to Taber on January 7, 1999 (see attached copy). The letter advised Taber that we had investigated the protest, that there was no evidence that Space Leasing was aware of the license suspensions at the time it listed Northstar and Ron's Backhoe, that the law expressly allows substitution of subcontractors where a listed subcontractor is unlicensed, and that there is nothing that would require the rejection of Space Leasing's bid. For these reasons, we found Taber's protest to be invalid and rejected it. We received a second letter of protest from Taber on January 14, 1999. This letter made new complaints about the subcontracting practices of Space leasing. Taber claimed that neither of the two subcontractors in question were in business and that Space Leasing had listed these subcontractors without obtaining proposals from them. After consulting again with County Counsel, I sent a letter to Taber Construction Co. denying their second protest (see attached copy). The denial was based on the fact that Taber made these new claims beyond the time period allowed for bid protests, as per Housing Authority procurement policy, and because the claims were unsubstantiated by any source. The Housing Authority has not done business previously with Space Leasing. As is our regular practice, we have reviewed and checked references regarding the experience, prior performance, and other qualifications of this firm. Space Leasing has constructed a number of Head Start facilities for other jurisdictions, and all of these reviews have been positive. It is staffs belief that Space Leasing's bid was fully responsive. As with all Housing Authority projects, the Federal requirements for compliance with the Davis-Bacon Act wage standards will be carefully monitored. At the regular Board of Commissioner's meeting on February 2, 1999 we placed the award of the contract to Space Leasing and denial of the bid protest by Taber on the consent calendar. This item was pulled to be rescheduled for February 231 . We are operating under a very tight budget and schedule for this project. In fact, the budget originally could not support the Space Leasing bid. Fortunately, Community Services was able to commit additional funds to bridge the gap. Of course there is always the option potential of throwing out all bids and re-bidding. It is our belief that this is not a good option because it would cause undue delays, putting us way behind our goal of completing the building by this summer. I hope this information is helpful to you in understanding the bid process and how the Taber bid protest was handled by the Housing Authority. If the license suspensions are not removed, and the listed subcontractors cannot perform, substitutions would be allowed under Public Contract Code Section 4107,which expressly cover the situation where a listed subcontractor is not licensed. Your reference to the C34 license held by Run's Backhoe is not of concern, since the general contractor Is licensed to perform the associated work. Under these circumstances,there is nothing that would require the invalidation of Space Leasing's bid. Pac2setter lndustres The contractor is not currently considered for award of contract, and so a complete investigation of these conditions is not warranted at this time. If the bid by Pacesetter Industries comes under consideration,your concerns will be fully investigated. For the reasons listed above, I fired your protest to be invalid, and reject the reasons as cause to not award the contract to the apparent low bidder. if you choose to protest this determination,you must respond, In writing,within five(5)working days of receipt of this letter,to the Housing Authority Executive director. Your second letter makes claims against the bid not addressed in your original protest, and are not subject to review as per Housing Authority procurement policy. Additionally, we find these claims to be unsubstantiated by your firm., or any other source. I believe the Headstart facility building in Brentwood should be awarded to Taber Construction,who came in third on the bids. The two low bids have numerous problems. The lowest bidder has two Sub-Contractors listed with either suspended or inactive licenses, one of which was not aware he had submitted a bid to the General Contractor. The second low bidder listed no sub contractors which would seem to automatically disqualify him because there is electrical and fire sprinklers on this job. His license does not allow for him to perform this work. I am told,County Counsel is prepared to let the#1 bidder substitute the two problem contractors which they say under the Public Bidding Code is legal. My opinion is that if he used the names of contractors who did not submit bids, is that legal? If he is allowed to do this, has he submitted the names of who these contractors are and their qualifications? If he has not, 1 think he has not complied. 1 would also life to point out Taber Construction is locat6d in:Martinez and the other two contractors are located in Atwater andFresno.- Some consideration should be given to a local contractor. 1 would very much appreciate your consideration in this matter. Taber Construction did provide additional.,pertinent information. • January 21, 1999 Housing Authority does not address Taber Construction's additional issues and recommends award of contract to Space Leasing. s January 23, 1999 Taber Construction makes contact with Ron Hozelton of Ron's Backhoe. Ron stated that he knew noting about this project and had not submitted a proposal. He had done trenching work for Pace Setter about 1 year ago,therefore Pace Setter would know his license classification_ Detail of Facts I. Space Leasing listed Ron's Backhoe.
