The Redevelopment Plan for the North Richmond Project Area adopted by Ordinance No. 87-50 on July 14, 1987, as amended by Ordinance No. 94-6 on December 6, 1994; C. The Redevelopment Plan for the Bay Point (formerly West Pittsburg) project Area adopted by Ordinance No. 87-102 on December 29, 1987, as amended by Ordinance No. 94-64 on December 6, 1994; D. The Redevelopment Plan for the Oakley Project Area adopted by Ordinance No. 89-89 on December 21, 1989, as amended by Ordinance 94-65 on December 6, 1994; and E. The Redevelopment Flan for the Rodeo Project Area adopted by Ordinance No. 90-50 on July 10, 1990, as amended by Ordinance No. 94-66 on December 6, 1994, 2) DIRECT the Deputy Director - Redevelopment to publish the Ordinanaces within 15 days in the Centra Costa Times, a newspaper of genera'! circulation in the County of Contra Costa; and ) DETERMINE that the activity is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 1061(b)(1) of the CEQA Guidelines, DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk, and DIRECT the Director of Community Development to arrange for payment of the $25.00 handling fee to the County Clerk for filing of the Notice of Exemption. FISCAL IMPACT The proposed amendments do not raise the fiscal limits of the redevelopment pians, therefore no fiscal impact to the general taxing entities results. The Redevelopment Agency's cost of borrowing is enhanced due to longer time frame for repayment of debt. BACKGR ? dD/REASONS FOR RE- OMMENDATIUNS A) AB 1290 Redevelopment Reform Act (AB 1290) context A major redevelopment reform bill, Assembly Bill 1290 ("AB 1290), was enacted in 1994 by the State Legislature, which among other things imposed certain time limits on all existing redevelopment plans, including a time limit for the repayment of debt and receipt of tax increment. Pursuant to the requirements of AB 1290 (codified as Health and Safety Code Section 33333.6), the Board of Supervisors adopted ordinances on December 6, 1994 which adopted certain time limits including the following time limits for the repayment of debt and receipt of tax increment for the Plans: Qakle Proiect Area - Ordinance No. 94-65: December 21, 2029 Noah Richmond Project Area - Ordinance No. 94-63: July 14, 2027 Rodeo Project Area - Ordinance No. 94-66: July 10, 2030 Bay Point Project Area - Ordinance No. 94-64: December 29, 2027 Pleasant Hill BAIT Station Project Area - Ordinance No. 94-62: July 10, 2024 This past legislative session, the State Legislature passed AB 1342 (codified as Health and Safety Code Section 33333.6(f)(2)). This section permits the Board of Supervisors to amend the Plans to extend the time limits of the Plans to the maximum time limits otherwise permitted under Health and Safety Code Section 33333.6(the "Time Limits Amendments"). The time limits for repayment of debt and receipt of tax increment may be extended to the following dates under the new legislation: Oakley Project Area: December 21, 2039 oarp2.boo North Richmond Project Area: July 14, 2037 Rodeo Project Area: July 10, 2040 Bay PointPro#ect Area: December 29, 2037 Peasant HiII BART Station Project Area: July 10, 2034 Section 33333.6(f)(2) permits the Board of Supervisors to bypass most of the procedures normally required for redevelopment plan amendments. The Board of Supervisors may adopt the proposed Ordinances in accordance with the normal procedures for the enactment of ordinances. Unlike the process for most redevelopment plan amendments, the Board of Supervisors is not required to hold a public hearing or provide notice to Project Area property owners or affected taxing agencies prior to the adoption of the proposed Ordinances. Adoption of the Ordinances will not cause a change in financial arrangements with affected taxing entities or affect the ability of the Contra Costa County Redevelopment Agency (the "Agency") to repay previously incurred debt. Pursuant to CEQA Guidelines Section 15378(b)(2), (4) and (5), adoption of the Time Limits Amendments is not a "project", and is therefore exempt from CEQA review and staff recommends that the Board of Supervisors approve a CEQA Notice of Exemption for the Ordinances and the Time Limits Amendments. B) Proposed Amendments to Extend Repayment of debt and Receipt of Tax Increment Limits The deadlines for repayment of debt and receipt of tax increment currently contained in the Plans are not at the maximum time limit permitted by the provisions of Section 33333.6. Therefore, the Time Limits Amendments make the following change to the Plans: Deadline to Receive Tax Increment. Currently under the Plans, the last day to repay debt and receive tax increment revenue is set at 40 years from the date of adoption of the Plans. Pursuant to Section 33333.6(f)(2), the Board of Supervisors may amend the Plans to set the last day to repay debt and receive increment at a date which is 10 years after the last date for effectiveness of the Plans. Since the Plans fix the last day for effectiveness of the Plan at 40 years from the date of adoption of the Plans, the Time Limits Amendments then set the last day to repay debt and receive tax increment under the Plans as follows: Oakley Project Area: December 21, 20139 North Richmond Project Area: July 14, 2037 Rodeo Prolect Area: July 10, 2040 BayPo#nt Project Area: December 29, 2037 Pleasant Hill BART Station Proiect Area: July 10, 2034 oarp2.bos CONTRA COSTA COUNTY REDEVELOPMENT AGENCY TATE: February 18, 1999 TO: Board of Su �sors FROM: Jim may, e Director- Redevelopment SUBJECT: em D.2 uesday, February 23, 1999; Ordinance Amending County Rede prrient Plans Extending the Time Limit for Repayment of Debt Concerns have been expressed that extending the time limit for the repayment of redevelopment debt will be detrimental to other County functions. With respect to those concerns,the following should be considered. I. REVENUE IMPACT IS NEUTRAL While the County has a one-time opportunity to extend the AB 1290 time limits for the repayment of debt for each of its five redevelopment project areas,the Redevelopment Agency would not be increasing the maximum amount of tax increment that can be collected in each project area. For example, in the Pleasant Hill BART' Station Project Area,the tax increment limit is $125 million. Based on the very conservative projection of tax increment growth for that project area(Appendix A), the$125 million cap will be achieved within the term of the existing limitof 2024. The logical question would therefore be, f6Why does the time limit need to be extended?" The answer lies in meeting the requirements of the Bond market, which exact a severe interest rate penalty for structuring bonded indebtedness with anything other than level debt service based on the existing demonstrated tax increment. If the Agency were to structure its debt to the 2024 time limit, it would be required to structure escalating debt service in order to take full advantage of the tax increment growth that is expected in the Pleasant Hill BART project area. A consequence of that escalating debt service schedule would be that the Agency's bonds would not qualify for an investment grade credit rating and would therefore produce fewer capital project dollars for every dollar of tax increment collected. According to the February 8, 1999 edition of the Bond Buyer,the interest rate penalty could be as much as 75 basis points(.75%),as shown on Table 1. This interest rate penalty could lower the amount of bond proceeds by as much as$1.5 million. As additional tax increment dollars are collected in the future, there will be a time when the Agency will be required to sequester most of those funds for debt repayment. As a consequence,it is likely that the Agency's tax increment debt will be paid off prior to the existing time limits; and when the debt is repaid, all of the taxes will revert to the affected taxing entities. In summary,extending the time limit for repayment of the debt does not and cannot'increase the total dollar limit established for each project area. What it will do is allow the Agency to leverage its limited tax increment dollars more efficiently by selling investment grade bonds at a lower interest rate than would be required if the shorter time limit must be retained. This would also be the case for subsequent issues of Bonds sold by the Redevelopment Agency prior to expiration of the Agency's ability to establish debt for Pleasant Hill BART in 2004. FISCAL AGREEMENT FOR FIRE DISTRICTS The County Redevelopment Agency has five(5)adopted Redevelopment Plans. The status of fiscal agreements for fire districts is shown on Table 2 below. The 1994 Redevelopment Reform legislation eliminated these previsions. The legislation permitting the 10 year extension for repayment of debt for pre-1994 Redevelopment Plans does permit a 20%pass-through of tax increment revenues computed from the year 40 Assessed Value Base during the 10 year extension period. This further reduces the loss to taxing entities. The legal description of the Project Area is set forth in Exhibit of the Time Limits Amendment described and incorporated in this Ordinance by reference below? and WHEREAS,the Redevelopment flan,as amended, contains time limits for conducting certain redevelopment functions meeting the requirements of the Community Redevelopment Law(the "CRL") for such time limits in effect as of the date of adoption and amendment of the Redevelopment Plan, and WHEREAS,AB 1342 amended the CRL effective January 1, 1999. Section 2. The Time Limits Amendment is hereby incorporated in this Ordinance by reference and made a part of this Ordinance as if set out in full in the Ordinance. Section 3. It is hereby found and determined that the proposed amendments embodied in the Time Limits Amendment are necessary and desirable. The Redevelopment Plan, as adopted by Ordinance No. 84-30,dated July 10, 1984, as amended by Ordinance No. 88- 58, adapted on July 19, 1988 and Ordinance No. 94-62, adopted.on December 6, is further amended in accordance with the proposed amendments set forth in the Time Limits Amendment. Section 4. The Time Limits Amendment is hereby adopted, approved, and designated as part of the official Redevelopment Plan for the Project Area. it is the purpose and intent of the Board of Supervisors that the Time Limits Amendment be implemented as part of the Redevelopment Plan for the Project Area. The Executive Director of the Agency may prepare a document that incorporates the provisions of the Time Limits Amendment into the existing text of the Redevelopment Plan, and such document shall then constitute the official Redevelopment Plan for the Project Area. 320\0111 1 71 04.1 Section 5. To the extent of the amendments set forth in the Time Limits Amendment, this Ordinance amends Ordinance No. 84-30,dated July 10, 1984, Ordinance No. 88-58, adopted on July 19, 1988, and Ordinance No. 94-62, adopted on.December 6, 1994. Section 6. In accordance with Health and Safety Code Section 33333.6(h), the Time Limits Amendment shall not be construed to affect the validity of any bond, indebtedness,or other obligation,including any mitigation agreement entered into pursuant to Health and Safety Code Section 33401,authorized by the Board of Supervisors or the Agency prior to January 1, 1994. Mor shall the Time Limits Amendment be construed to affect the right of the Agency to receive property taxes pursuant to Health and Safety Code Section 33670,to pay the indebtedness or other obligation described in this Section 6. Section 7. The Board of Supervisors hereby approves the CEQA Notice of Exemption and directs the Clerk of the Board to file the Notice of Exemption with the County Clerk of Contra Costa County. Section 8. The Clerk of the Board is hereby directed to file a copy of the Time Limits Amendment with the minutes of this meeting. A copy of this Ordinance and the Time Limits Amendment shall be transmitted to the Agency and the Agency is vested with the responsibility of implementing the Time Limits Amendment. Section 9. The Executive Director of the Agency is hereby directed to record the Ordinance and the Time Limits Amendment in compliance with the provisions of Government Code Section 27295. Section 10. if any provision, section, subsection, subdivision, sentence, clause or phrase of this Ordinance or the Time Limitations Amendment is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion or portions of the Ordinance or the Time Limitations Amendment. Section 11. The legal description of the Project Area is set forth in Exhibit of the Time Limits Amendment described and incorporated in this Ordinance by reference below; and WHEREAS,the Redevelopment Plan, as amended, contains time limits for conducting certain redevelopment functions meeting the-requirements of the Community Redevelopment Law(the "CRL") for such time limits in effect as of the date of adoption and amendment of the Redevelopment Plan, and WHEREAS,AB 1342 amended the CRT.,effective January 1, 1999. AB 1342 adds Health and Safety Code Section 33333.6(f)(2)to the CRL,which allows the Board of Supervisors to amend the Redevelopment Plan to extend certain time limits for conducting various redevelopment functions; and WHEREAS,the Contra Costa County Redevelopment Agency(the "Agency")has analyzed the,provisions of the.Redevelopment Pian and the time limit requirements of Health and Safety Code Section 33333.6(f)(2), and has determined that the Redevelopment Plan may be amended to extend certain time limits in the manner and to the extent set forth in the staff report prepared in connection with this Ordinance and on file with the Clerk of the Beard; and. 320\1 011 1 71 06.1 WHEREAS,the Agency has prepared an amendment to the Redevelopment Plan to extend the time limits as permitted by Health and Safety Code Section 33333.6(f)(2)(the"Time Limits Amendment"), a copy of which is on file with the Clerk of the Board; and WHEREAS,the Board of Supervisors desires to amend the Redevelopment Plan in accordance with the terms of the Time Limits Amendment as authorized pursuant to Health and Safety Code Section 33333.6(f)(2); and WHEREAS, the Agency has prepared and submitted and.the Board of Supervisors has reviewed and considered the staff report on the Time Limitations Amendment; and WHEREAS,the Agency staff has prepared and submitted to the Board of Supervisors for review and approval a CEQA Notice of Exemption for the Time Limitations Amendment. WHEREAS,Health and Safety Code Section 33333.6(e)(2) states: In adopting this ordinance,neither the legislative body nor the agency is required to comply with Section 33354.6 or Article 12(commencing with Section 33450)or any other provision of this part relating to the amendment of redevelopment plans. NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA: Section 1. The Board of Supervisors hereby finds and declares that the above recitals are true and correct. Section 2. The Time Limits Amendment is hereby incorporated in this Ordinance by reference and made a part of this Ordinance as if set out in full in the Ordinance. Section 3. It is hereby found and determined that the proposed amendments embodied in the Time Limits Amendment are necessary and desirable. The Redevelopment Plan, as adopted by Ordinance No. 90-50 on July 10, 1990 and as amended by Ordinance No. 94-66 on December 6, 1994, is further amended in accordance with the proposed amendments set forth in the Time Limits Amendment. Section 4. The Time Limits Amendment is hereby adopted, approved,and designated as part of the official Redevelopment Plan for the Project Area. It is the purpose and intent of the Board of Supervisors that the Time Limits Amendment be implemented as part of the Redevelopment flan for the Project Area. The Executive Director of the Agency may prepare a document that incorporates the previsions of the Time Limits Amendment into the existing text of the Redevelopment Plan, and such document shall then constitute the official Redevelopment Plan for the Project Area. Section 5. To the extent of the amendments set forth in the Time Limits Amendment, this Ordinance amends Ordinance No. 90-50 adopted on July 10, 1990 and Ordinance No. 94-66 adopted on December 6, 1994. 320t101i 17108.1 Section 6. In accordance with Health and Safety Code Section 33333.6(h),the Time Limits Amendment shall not be construed to affect the validity of any gond,indebtedness,or other obligation, including any mitigation agreement entered into pursuant to Health and Safety Code Section 33401,authorized by the Board of Supervisors or the Agency prior to January 1, 1994. Nor shall the Time Limits Amendment be construed to affect the right of the Agency to receive property taxes pursuant to Health and Safety Code Section 33670,to pay the indebtedness or other obligation described in this Section 6. Section 7. The Board of Supervisors hereby approves the CEQA Notice of Exemption and directs the Clerk of the Board to file the Notice of Exemption with the County Clerk of Contra Costa County. Section 8. The Clerk of the Board is hereby directed to file a copy of the Time Limits Amendment with the minutes of this meeting. A copy of this Ordinance and the Time Limits Amendment shall be transmitted to the Agency and the Agency is vested with the responsibility of implementing the Time Limits Amendment. Section.9. The Executive Director of the Agency is hereby directed,to record the Ordinance and the Time Limits Amendment in compliance with the provisions of Government Code Section 27295. Section 10. If any provision, section,subsection, subdivision, sentence, clause or phrase of this Ordinance or the Time Limitations Amendment is for any reason held to be invalid or unconstitutional,such decision shall not affect the validity of the remaining portion or portions of the Ordinance or the Time Limitations Amendment. Section 11.
