LEGISLATION: S$ 373 (RAINEY) SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ADOPT a position in SUPPORT of SB 373 by Senator Richard K. Rainey which will authorize the board of supervisors in any 1937 Act county to offer safety retirement to the county's animal service officers. BACKGROUND: On December 15, 1993, the Board of Supervisors amended its 1999 Legislative Program to add the following: "Support legislation to offer Animal Control Officers safety retirement as long as there is no additional cost to the County." Senator Rainey has introduced SB 373 for this purpose. As introduced, S13 373 would broaden the definition of safety member for retirement purposes by adding the following language: "Safety member"also means persons employed as animal service officers who are subject to be assigned to accompany law enforcement officers when the law enforcement officers are attempting to arrest individuals who are suspected of operating an illegal laboratory to manufacture controlled substances In order to restrain or capture any animal being used to guard the property. BY DEPUTY This provision would not be effective in any county until the board of supervisors of that county adopted a resolution making this provision effective in that county. The legislation does not address the issue of who will pay for the increased costs of safety retirement. That is left to negotiations between the county and its employee organizations. LEGISLATIVE COUNSEVS DIGEST SB 373, as introduced, Rainey. County employee retirement benefits. The County :employees' Retirement Law of 1937 prescribes retirement benefits for employees included in the safety member category. This bill would include specified animal service officers in that category. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. The people of the State of California dry enact as follows; 1 SECTION 1. Section 31469.3 of the Government 2 Code is amended to read: 3 31469.3. "Safety member" means any person who is 4 either: (a) A member of a pension system established 5 pursuant to either Chapter 4 or Chapter 5, who elects by 6 written notice filed with the board, to become a safety 7 member, or 8 (b) Any person employed by a county, subject to 9 Section 31676.1 or 31695.1 or by a district or court 10 organized or existing within such a county, whose 11 principal duties consist of active law enforcement or 99 SIS 373 —2- 1 --2--w1 active fire suppression as described in Section 31470.2 and. 2 31474.4, or active lifeguard service as limited by ,Section 3 31470,6 or juvenile ball group counseling and group 4 supervision or animal central capture or confinement if 5 adopted by the board of supervisors as provided in 6 Section 31469.4. 7 SEC. 2. Section 31469.4 of the Government Code is 8 amended to read.. 9 31469.4. "Safety member" .means persons employed 10 as probation officers, juvenile hall or juvenile home group 11 counselors, and group supervisors who are primarily 12 engaged in the control and custody of delinquent youths 13 who must be detained under physical security in order 14 not to be harmful to themselves or others. 15 "Safety member" also means persons employed as 16 animal service officers who are subject to being assigned 17 to accompany law enforcement officers when the law 18 enforcement officers are attempting to arrest individuals 19 who are suspected of operating an illegal laboratory to 20 manufacture controlled substances in order to restrain or 21 capture any animals being used to guard the property. 22 The provisions of this section shall not be applicable in 23 any county until the board of supervisors by resolution 24 make the provisions applicable. 0 99 F
