AUTHORIZE the Deputy Director,Redevelopment, or his designee to: (1)waive the County's right of
first refusal to acquire the property located at 4315 Conejo Drive in the unincorporated area. near
Danville, and(2) execute the required legal documents for this purpose.

"affordable units"). Purchasers of the affordable units were required to enter into a Buyer's
Purchase Agreement which provided the County with the right of first refusal to acquire, or to
assign its right to acquire the unit at a predetermined price, in the event of resale. The purpose of
the resale restriction is to provide the County with an opportunity to maintain the affordability of
the unit by assigning the right to acquire to another moderate income household.
The townhome located at 4315 Conejo Drive in the unincorporated area near Danville is one of
the affordable units and was acquired by a moderate income household in November, 1994. The
owner notified the County in September, 1998 of her intent to sell the unit and the County
notified the owner in November, 1998 of its intent to assign its right to purchase to an eligible
household. The County had 90 days to identify an eligible household and was unable to do so. If
the County does not now waive its right to acquire the unit, it must purchase the unit. No
potential source of County funds have been identified for this purpose. Therefore, staff is
recommending that the County waive its right of first refusal to acquire this property and permit
the owner to sell the unit on the open market. Staff is evaluating alternative approaches and
sources of funding for handling these types of matters in the future.
