SUBJECT: Determine the Need to Continue the Emergency Action Regarding the Repair of the Fish
Ranch Road Slide, Orinda area.

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Action:
DETERMINE that there is a need to continue the emergency action taken by the Board of
Supervisors on March 24, 1993, pursuant to Public Contract Code Sections 22035 and 22050,
to repair the Fish Ranch Road Slide, Orinda area.
II. Financial Impact:
There is no impact to the general fund. Plans, specifications and engineer's estimate are
complete. The project is currently under construction, and the upper slide is complete. The lower
slide has been delayed due to weather and utility conflicts. However, the entire project should be
completed by mid-March. The expected contract cost based on the low bid is $684,651.

Ill. Reasons For Recommendations and Background:

Fish Ranch Road has been damaged by a landslide which affected the uphill, north bound lane and
approximately three feet of the downhill, south bound lane. The slide scarp has dropped
approximately one foot below road surface, creating a dangerous condition which necessitated
closing the road February 21, 1998. The Public Works Department was able to make temporary
repairs to the slide damaged roadway, which facilitated opening the south bound lane on !March 9.
Since Fish Ranch Road is included in the federal highway system and with the federal designation
of Contra Costa County as a disaster area, it qualifies for Federal Highway Administration funds to
make the repairs. To receive 100% funding for this repair, the work must be completed within 1803
days of the February 2, 1998 emergency declaration. After that time, only 88.5% financing is
available and the County will have to pay the 11.5% matching funds.
Construction to correct the slide work has been completed. Work to complete a secondary minor
slide began in early November, and is substantially completed. The road is open to traffic.
We recommend that the Board continue the emergency action to ensure completion of the repair
in the most expeditious manner.
IV. Conseguences of Negative Action:
Non-concurrence of the above recommendation will significantly delay completion of the repair of
the roadway, prolonging impacts to traffic flow.

The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on June 17, 1998, contracted with Bay Cities Paving & Grading, Inc. for
roadway widening, curb, gutter, sidewalk, street lighting, storm drain and inlets, with Liberty Mutual
Insurance Company as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of November 19, 1998.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

specifications for construction.
DIRECT the Director of Community Development to file a Notice of Exemption with the County

DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk for ding of the Notice of Exemption.
IL FINANCIAL IMPACT:
The estimated project cost is $450;000, funded by Measure C (100%).
Ill. REASONS FOR RECtJI11 MENDATIONIBACKGROUND:
The project includes reconstructing portions of Concord Avenue with Portland Cement Concrete
(PCC) pavement; and reconstruction portions of John Glenn Drive and Median Park Boulevard
with asphalt concrete (AC) pavement.
It is needed to replace the existing roadway sections which have experienced significant wear.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because the proposed project consists of the reconstruction of existing facilities where the
new facilities will be located on the same site as the structure replaced and will have substantially
the same purpose and capacity as the facilities replaced.
IW, CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize
funding.
CONTRA COSTA TRANSPORTATION AUTHORITY
FIRST AMENDMENT TO OCTA AGREEMENT NO. 87
WITH
CONTRA COSTA COUNTY REAL PROPERTY DIVISION
FOR
STATE ROUTE 4 (WEST) GAP CLOSURE PROJECT
RIGHT OF WAY SERVICES
JANUARY 20, 1999
WHEREAS,the Contra Costa Transportation Authority and Centra Costa County Real Property Division
("CONSULTANT") entered into Agreement No. 87 On August 1, 1998; and
WHEREAS,the parties now wish to further amend the Agreement and increase the total compensation; now
therefore be it
MUTUALLY AGREED:
(1) that Article 4 of the Agreement is amended to increase the base work compensation by$112,000 for an
overall total Agreement Value of 5250,(}00;and
(2) that all other items and conditions of the Agreement shall remain in effect.
In witness whereof,the parties hereto have executed this First Amendment to the Agreement as of the day and year
above written.

SUBJECT: Amendment to Agreement to Provide Services to the Contra Costa Transportation Authority

SPECTIC ECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action: APPROVE first amendment to agreement to provide right of way
services to the Contra Costa Transportation Authority for the State Route 4 West Gap project and
AUTHORIZE the Board Chair to sign the agreement on behalf of the County.
If. Financial Impact: Contra Costa Transportation Authority will pay the actual costs for Real
Property staff right of way and consultants' services.
Ill. Backoround and Reasons for Recommendations: Contra Costa Transportation Authority
requires a variety of right of way services but has no right of way staff and has contracted with the
County for these services. This amendment will raise the payment limit to cover the cost of
additional work by county staff and consultants.
Ill. Consequences of Negative Action: Less efficient government because the Contra Costa
Transportation Authority would have to hire aI''tion I Drivate contractors at greater expense.
