BARRY, AICP 9-� - County COMMUNITY DEVELOPMENT DIRECTOR DATE: December 7, 1999 SUBJECT: REQUEST FOR AUTHORIZATION OF A GENERAL PLAN AMENDMENT STUDY FOR A 155 ACRE SITE (APN # 200-100-003) IN THE TASSAJARA AREA SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Staff recommends the Board of Supervisors decline to authorize a General Ran Amendment Study for APN # 200-100-003, as requested by Ponderosa Homes on behalf of the Finley- Tassajara Corporation. FISCAL IMPACT None. If the Board declines to authorize there will be no further costs incurred. If the study is authorized, the applicant would pay fees to cover the County's cost for conducting the requested study. BACKGROUND/REASONS FOR RECOMMENDATIONS Ponderosa Homes has submitted on behalf of the Finley-Tassajara Corporation a request for authorization for a General Plan Amendment (GPA) Study on a 155-acre site (APN # 200-100- 003) located in the Tassajara area. They are proposing a GPA study on a 95-acre portion of the site's westerly section fronting Camino Tassajara to be redesignated from Agricultural Lands (AL) to Single Family Residential-Medium Density (SM). This change would have the potential to yield between 214 and 349 single family dwelling units based on a range of 3.0 to 4.9 units per acre allowed under the SM designation. The balance of the site's 60 acres would retain the Agricultural Lands (AL) designation. Attached is a copy of a letter and map from Ponderosa Homes, dated October 12, 1999, which outlines the authorization request made on behalf of the Finley-Tassajara Corporation (see Exhibit "A"). As U|uotnutad in the map listed as Exhibit 1113": Urban Limit Line Modifications Considered for Tmss 'ara Area, 1/26/99, the subject site is clearly located within the area of Temm 'aro that is currently under evaluation as part of the Urban Limit Una Review Study (ms authorized by Board of Supervisors on 1/26/99). There are two alternatives inthe study for the Tass 'oraarea1ornove the Urban Limit Line inward, and under each alternative being studied the subject site would be placed outside the Urban Limit Line. Additionally, in an earlier action the Board of Supervisors approved on September 22, 1998 e "disinclination policy" with regard to considering General Plan /\rnendnnant study requests for the Taoa 'ara area until further determination. Staff naomnnnmendo that the Board of Supervisors decline authorization of o GPA Study on APN# 200-100-003, as requested by Ponderosa Homes on behalf of the Finley-Tmss 'aro Corporation. Staff believes that it would be premature at this time to authorize a GPA study to redesignate a portion of the subject site from a non-urban use to on urban use allowing residential development since the Board has previously authorized a GPA study (now in progress) to evaluate the potential inward movement of the Urban Limit Line in the Tmao 'aro area which includes study alternatives placing the site outside the Urban Urni1 Line. The proposed General Plan change would have the potential to yield between 214 and 349 single family dwelling units. As outlined in the County staff report, authorization of the GPA Study would be in conflict with the Cuban Limit Line Review Study previously authorized by the Board of Supervisors. There are two alternatives in the study for the Tassajara area to move the Urban Limit kine (ULL) inward, and tinder each alternative being studied the subject site would be placed outside the Urban Limit Line. County staff has also pointed out that on September 22, 1998 the Board approved a "disinclination policy.' with regard to considering General Plan Amendment study requests for the Tassajara area until further determination. In April of this year, the Town urged the Board to postpone consideration of any General Plan Amendment studies in the Tassajara Orea until the ULL relocation review was completed. (July 14,;1998) The Town has previously Indicated its suppoo for the Tassajara Agricultural Preservation Agreement, and the subject site is within the Agricultural Preservation Area. This support, in conjunction with the premature nature of the , proposed General Plan Amendment study, prompt the Town to concur with the County staff'recommendation and the urge the Board's rejection of the proposed GPA Study.
