The Contra Costa Board of Supervisors RESOLVES that: On the basis of a traffic and engineering survey and recommendations thereon by the County Public Works Department's Traffic Engineering Division, and pursuant to County Ordinance Code Sections 46-2.002 -46-2.012, the following traffic regulation is established (and other action taken as indicated): Pursuant to Section 21101(b) of the California Vehicle Code the intersection of Montecito Crescent (Road No. 3755E), and Terrace Road (Road No. 3755D), Walnut Creek, is hereby declared to be a stop intersection and all vehicles traveling east on Montecito Crescent (Road No. 3755E), shall stop before entering said intersection. On October 6, 1998, this Board resolved that the improvements in Subdivision 7820 were completed as provided in the Subdivision Agreement with Davidon Homes and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance. Therefore, IT IS BY THE BOARD ORDERED that the Public Works Director is AUTHORIZED to refund the$3,500.00 cash deposit(Auditor's Deposit Permit No. 240056, dated March 8, 1994) plus interest to Davidon Homes in accordance with Government Code Section 53079, if appropriate, and Ordinance Code Section 94-4.406 and the subdivision agreement. NOW THEREFORE BE IT RESOLVED that the warranty period has been completed and the Subdivision Agreement and surety bond for performance of $344,700.00, Bond No. 11133098639 issued by The American Insurance Company are exonerated.
