II. FINANCIAL IMPACT
No County funds are required. Federal funds alone account for the increased payment limits.
III. BACKGROUND
On June 22, 1999 the Board of Supervisors authorized approval to conduct contract
negotiations and authority to sign Title III Older Americans Act contracts for the Office on
Aging(currently Aging &Adult Services Bureau). The Office on Aging(currently Aging &
Adult Services Bureau)received an Amendment No. 1 to the California Department of Aging
Standard Agreement No. 29-002 which the Board approved on.June 22,, 1999. The
amendment increases the allocation allowing the program to provide additional services to
the Contra Costa County residents residing in a Skilled Nursi cility or Residential Care
Facilities as specified above. )

FINANCIAL IMPACT:
The Dispute Resolution Program is fully revenue offset by funds generated from ars eight dollar filing fee on
civil actions in the Superior Court. No County general funds are involved.
REASONS FOR RECOMMENDATION/BACKGROUND:
The Dispute Resolution Program Act of 1986 (Business and Professional Code Sections 465, et seq.) provided
for the establishment and funding, at County option, of local dispute resolution services as an alternative to
formal court proceedings. The Act authorized participating counties to increase',Superior, Municipal and
Justice Courts filing fees from one to three dollars for the purpose of funding the local dispute resolution
programs.
On January 1, 1987, the Board approved the County's participation in the program and authorized a three
dollar increase in court filing fees. The Dispute Resolution Advisory Committee was created by the Beard
to consider implementation strategies and funding guidelines appropriate for Contra Costa County.

From 1989 through 1998, the Advisory Committee solicited proposals for funding under the Dispute
Resolution Programs Act of 1986. The purpose of the funding is to encourage the establishment and use of
local dispute resolution services as an alternative to formal court proceedings. The program operates under
the provisions of the Dispute Resolution Programs Act. The Committee formed a County Dispute Resolution
Network, which is composed of a representative from each of the funded program agencies. It meets
periodically and coordinates County-wide training, advertisement and services. All of the project
representatives continue to meet together with staff from the County Administrator's Office to coordinate
alternate dispute resolution efforts.
The State reissued the California Dispute Resolution Program Act in 1998 and authorized counties to allocate
up to $8.00 from filing fees to generate new revenues for these local programs. Effective January 1, 1999,
the dispute resolution portion of the civil filing fee in Contra Costa County increased from $3.00 to $8.00.
The increase was approved by the Board of Supervisors pursuant to a request by the Superior Court. The
Superior Court identified two new priorities for the increased funding —Juvenile Mediation Services and a
Special Masters Program in Family Law. The Court requested that the new funding be split evenly between
the new categories. The Request for Proposal solicited applications for these new programs.
In response to the Request for Proposals, the Committee received five applications. No proposals were
submitted for the Special Masters Program in Family Law. The Dispute Resolution Advisory Committee met
on November 12, 1999, to consider funding of the County's dispute resolution programs. The Advisory
Committee decided that the Request for Proposal for the Special Masters Program,in Family Law should be
reissued. Additionally, the committee voted to fund four programs at the levels specified.
Three of the four projects will provide for the continuation of existing Dispute Resolution services (Battered
Women's Alternatives, California Community Dispute Services, and Center for Human Development). The
Advisory Committee also approved a new Juvenile Mediation program to be initiated by the Superior Court
Dependency Mediation Program and the Probation Department. The following is a brief description of each
program:
Battered Women's Alternatives plans to educate 2,000 adolescent youth in family, peer, and relationship
dispute resolution. Provide dispute mediation skill building for youth peer counselors through facilitation
of volunteer peers trained to mediate in dispute resolution for 50 youth and adults. Maintain ongoing
cooperative working relationships among dispute resolution service providers and members of the Contra
Costa Dispute Resolution Network to ensure effective referral and provision of services county-wide.
California Community Dispute Services plans to act as a mediating structure between the justice system
(courts, police, probation, and other agencies) and the community — alternatives include facilitation,
mediation, and arbitration services. Train and/or provide support services to volunteers, provide general
public relations and outreach efforts to educate the community.
Center for Human Development/Conflict Resolution Panels plans to provide direct conflict resolution
services in at least 30 cases each month, serving approximately 1,000 individuals. Train 50 community
members in conflict resolution; conduct at least 12 presentations to community groups, businesses, law
enforcement agencies, and governmental agencies to educate them about conflict resolution and CRP's
services; provide for-fee conflict resolution training to at least 4 organizations; and conduct at least 5 for-fee
mediations.
Superior Court Dependency Mediation Program plans in the first year to establish a victim/offender juvenile
mediation advisory panel and establish written protocols and guidelines. Present key mediator and probation
staff a 25 hour training program. Prescreen and conduct pre-mediation conferences; schedule 75-100
juvenile mediations cases for completion in the FY 00/01.
Additionally, the Contra Costa County Superior Court operates a variety of alternative dispute resolution
programs with trial court funding and other revenues. They also coordinate services with the participants
of the County Dispute Resolution Network.

scope of services and increases the Payment limit from$34,000.00 to $97,500.00, an increase of
$63,500.00.
B. AUTHORIZE the Director of General Services to execute the First Amendment to the
Consulting services agreement, and to issue written authorizations for extra work, in addition to
the authorization for the First Amendment,provided that the cumulative total extra cost for such
additional authorizations shall not exceed$10,000.00.

budgeted within the Health Services Department.

1. Effective Date and Parties: Effective November 16, 1999, Gutierrez/Associates,AIA(herein called"Consultant"),a California Corporation,and
the County of Contra Costa(herein called"County"),a political subdivision of the State of California,mutually agree as follows:
2. Purpose: On July 20, 1999,the parties entered into a contract entitled "Consulting Services Agreement," referred to as the "Agreement," which
covers architectural services for an Addition to 1034 Oak Grove Road,Concord,for Health Services Department. The parties desire to amend the
Agreement to expand the scope of service and to increase the payment limit accordingly.
3. Amendments to Agree ent:
A. In the Agreement,Section 1(e),change the Payment Limit from$34,000.00 to$97,500.00,an increase of$63,500.00. This change shall apply
to charges from and after July 21, 1999.
B. In accordance with Section 14 of the Agreement,provide the following extra services:
Architectural services for space planning,design contract documents,bidding and construction administration for Renovation of the Existing
Building at 1034 Oak Grove Road,Concord.
4. Effect:
Subject to the revisions made by this and any prior amendments,the Agreement shall remain in full force and effect.

1. ADOPT Resolution accepting the contracted work performed by Taber Construction for the
renovation of the Chris Adams Girls Center, 100 Glacier Drive, Martinez, Budget Line item No.

2. AUTHORIZE the Clerk to file with the County Recorder a copy of this Resolution as a Notice of
Completion for said contract.
FINANCIAL IMPACT.
Funds in the capital account established for the project are sufficient to cover the amount
encumbered by said contract.
BACKGROUND:
On May 5,1999, Contra Costa County contracted with Taber Construction and Reliance Insurance
Company, the bonding agency, for the renovation of the Chris Adams Girls Center, 100 Glacier
Drive, Martinez.
The County Administrator reports that said work has been inspected and complies with approved
plans and specifications, and recommends its acceptance as substantially complete as of December
7, 1599.

BACKGROUND:
On November 24, 1998 the Board of Supervisors AGREED with plans to construct a Family Law
Center and DIRECTED the County Administrator to proceed with the Center's financing and
construction. The estimated total project cost at that time was $7,500,000.
After considering recommendations of an Architectural Evaluation Team the Beard of Supervisors
APPROVED and AUTHORIZED a professional services agreement with Michael Ross/Charles Drulis
Architects and Planners on April 6, 1999. This contract included programming and design services
for a new Family Law Center with an estimated construction cost of $5,200,000. The Architect's fee
for standard design services (excluding programming and other additional services) was equivalent
to 9% of the construction cost.
During the programming phase Ross/Drulis, the Superior Court, and the County studied and
validated building program requirements for this Family Law Center. As part of this program
Ross/Drulis prepared planning, design, and construction cost estimates based upon the Court's
essential requirements. However, their estimate of the Court's essential requirements exceeded the
County's $7,500,000 budget commitment by $4,000,000. Therefore, on November 16, 1999 the
Board of Supervisors APPROVED and AUTHORIZED a Memorandum of Understanding between the
Superior Court and the County that closed this budget deficit. The $11,500,000 project budget
referenced by the MOU includes a construction cost estimate of$8,050,000 for the enlarged facility.
This Board Order requests approval of an amendment to the Architect's contract for the additional
services associated with designing a larger facility. The revised program contemplates a two-story
steel frame structure with approximately 40,000 gross square feet, whereas the original program
proposed a one-story wood frame structure of 25,000 square feet. The 7,000 square foot program
for Family Court Services was originally proposed for the second floor o€ 1111 Ward Street, but will
be housed in the new construction.
The recalculated building design fee is approximately 8.5% of the revised construction cost.
