Subdivision 8250 Project No. 0651-61-077E Rodeo The Public Works Director having reported that on September 14, 1999, the Board accepted a Grant Deed of Development Rights from Schuler Homes of California, Inc., described in Exhibit "A" attached hereto, in lieu of complying with certain conditions of approval for Development Number 8250. On the recommendation of the Community Development Director, IT IS BY THE BOARD ORDERED that the Chairperson is AUTHORIZED to execute the following "Quitclaim Deed" of the development rights to "Schuler Homes of California Inc." The document was prepared by the Public Works Department, Real Property Division. The Real Property Division is DIRECTED to cause said Quitclaim Deed to be delivered to the grantee. Financial Impact: The project contingency funds are sufficient to cover the change order costs. The source of funds is Federal Emergency Management Agency Funds (75%) and State Office of Emergency Services Funds (25%). III. Reasons for Recommendations and Background: The total for both Change Order No. 2 and No. 3 was greater than 10% of the original contract, thereby requiring board approval. IV. Consequences of Negative Action: Without Board approval the contractor will not receive payment for work done under contract Change Order No. 2 and No. 3. Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.
