to Schuler Homes of California, Inc.

The Public Works Director having reported that on September 14, 1999, the Board
accepted a Grant Deed of Development Rights from Schuler Homes of California, Inc.,
described in Exhibit "A" attached hereto, in lieu of complying with certain conditions of
approval for Development Number 8250.
On the recommendation of the Community Development Director, IT IS BY THE
BOARD ORDERED that the Chairperson is AUTHORIZED to execute the following
"Quitclaim Deed" of the development rights to "Schuler Homes of California Inc." The
document was prepared by the Public Works Department, Real Property Division.
The Real Property Division is DIRECTED to cause said Quitclaim Deed to be
delivered to the grantee.

For valuable consideration, receipt of which is hereby acknowledged, the County of Contra
Costa, a political subdivision of the State of California, hereby remises, releases and
forever quitclaims to, Schuler Homes of California, Inc., all of its right, title and interest in
the real property, specifically "development rights," as defined in the deed to the County
of Contra Costa, recorded on October 27, 1999, Series No. 99-285325, Contra Costa
County Records, State of California; situated in the unincorporated area of the County of
Contra Costa, State of California, more particularly described in Exhibit "A," attached
hereto and made a part hereof.
No transfer tax due. This is a quitclaim of development rights only.

I. Recommended Action:
APPROVE Contract Change Orders No. 2 & No. 3 in the approximate amounts of
$8,000.00 and $11,000.00 respectively and AUTHORIZE the Chief Engineer to
execute them in order to compensate the contractor, DK Environmental, for the
placement of additional aggregate base material and for the excavation and offhaul
of material.

II. Financial Impact:
The project contingency funds are sufficient to cover the change order costs. The
source of funds is Federal Emergency Management Agency Funds (75%) and State
Office of Emergency Services Funds (25%).
III. Reasons for Recommendations and Background:
The total for both Change Order No. 2 and No. 3 was greater than 10% of the
original contract, thereby requiring board approval.
IV. Consequences of Negative Action:
Without Board approval the contractor will not receive payment for work done under
contract Change Order No. 2 and No. 3.

The Board of Supervisors of Contra Costa County, as the governing body of the Contra Costa County
Flood Control and Water Conservation District, RESOLVES that:
The Flood Control District on August 11, 1999 contracted with DK Environmental, for removing and
replacing damaged wire mesh gabions, with American Contractors Indemnity Company as surety, for
work to be performed on the grounds of the County; and
The Chief Engineer reports that said work has been inspected and complies with the approved plans,
special provisions and standard specifications and recommends its acceptance as complete as of
November 4, 1999.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.
