The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on June 2,1999 contracted with California Pavement Maintenance
Company, Inc., for the placement of slurry seal on various County Roads, with Reliance Insurance
Company as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of November 5, 1999.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

The Board of Supervisors of Contra Costa County RESOLVES that:

roadway widening and reconstruction, storm drain facilities, curb, sidewalk and slurry seal, with Safeco
Insurance Company of America as surety, for work to be performed on the grounds of the County; and

plans, special provisions and standard specifications and recommends its acceptance as complete as
of October 27, 1999.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County

APPROVE and AUTHORIZE the Public Works Director to amend the Consulting Service
Agreement with Denise Duffy and Associates increase the value from $25,000 to $40,000 and to
extend the completion date from December 31, 1999 to January 31, 1999 in order to provide "on-
call)) environmental permitting services for various projects throughout the County.
11. Financial Impact:
The estimated cost of the contract is $15,000.00 funded by Flood Control ad, and Airport
project funds (100%).

III. REASONS FOR RECOMMENDATION/BACKGROUND:
The amendment of the "on—call" Consulting Service Agreement is needed to assist Public Works
Department staff in obtaining regulatory permits associated with Flood Control, Road, and Airport
projects.
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the Consulting Service Agreement is not amended, various flood control, road, and airport
projects will not obtain required permits causing delays in their construction and repair.

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action.- APPROVE agreement to provide right of way services to the City of
Vacaville for their Leisure Town Road Bridge Project and AUTHORIZE the Board Chair to sign
the agreement on behalf of the County.
11. Financial Impact: The City of Vacaville will pay the actual costs for Real Property staff right of
way services.
111111. Background and Reasons for Recommendations: The City of Vacaville requires a variety of
right of way services that are required by federal funding to be performed by a certified agency
and desires to contract with the County for these services. Solano County is not certified and also
contracts with Contra Costa County.
IV. Consequences of Negative Action: Less efficient government because the City of Vacaville
would have to contract with another certified agency that is not as close to the City at greater
expense.

AGREEMENT
1 Effective Date and Parties. Effective on October 1, 1999, the COUNTY OF
CONTRA COSTA, a political subdivision of the State of California (hereinafter
referred to as "County"), and the CITY OF VACAVILLE, a municipal corporation
(hereinafter referred to as "City"), hereby mutually promise and agree as follows:
2. Purpose. The City is planning the Leisure Town Road Bridge & Roadway Safety
Improvements project to be constructed during the year 2000. The City needs an
agency certified by Caltrans for federally funded projects to review right of way
activities and desires to contract with the County for property appraisal, acquisition,
and project oversight services.
3. Services by County. The services to be rendered by County to City may include
appraisal, appraisal review, negotiation, land rights document preparation, right of
way acquisition, relocation, and/or supervision of independent contractors providing
such services.
4. Payment for Services. City agrees to reimburse County for all labor costs and
appropriate overhead for County Real Property Agents labor including overtime
rates for evening or weekend work (See Appendix "A" for pay rates). City shall pay
all acquisition settlement and any other costs of acquisition such as title fees,
recording fees, etc. Such payments shall be made within 30 days of billing by
County. Total cost to City for County's services shall not exceed $6,500 without
written approval of City.
5. Indemnification. City agrees to defend, indemnify and save harmless County, its
officers, and employees against any and all !oss, damage, liability, expense, claims
or demands of whatever character, direct or consequential, directly or indirectly
contributed to or caused by County assuming and acting as the right of way agency
for and on behalf of City.
6. Independent Status. Nothing herein shall be construed to imply that any County
employee providing services hereunder is a City employee.

7. Term. The term of this agreement shall commence on the effective date hereof and
shall end upon termination by either party upon 30 days written notice. The rights
and obligations of Paragraph 5 "Indemnification" shall survive any such termination.

III. Background and Reasons for Recommendations:
Subsurface Consultants, Inc. is an environmental firm which various County
agencies use from time to time to provide soils investigations and analyze for the
presence of hazardous materials. Public Works, the Flood Control District and the
Redevelopment Agency use Subsurface Consultants' services for a variety of
projects. In order to conserve time and reduce paperwork, a single "standing"
Consulting Services Agreement with a $50,000 limit was initially approved and later
amended for an additional $50,000 so that the firm's services could be obtained
quickly on an as-needed basis. In the interim, various projects have drawn down
the funds available through this agreement. County staff members wish to continue
to use this firm because of its quick response time and reliable performance.
Therefore, staff is requesting approval of a second amendment for an additional
$50,000 for future services as needed. The agreement extends through the
completion of all assigned projects.
IV. Consequences of Negative Action:
Negative action will result in an incomplete assessment of properties and possibly
substantial financial risks associated with contamination problems.

SECOND AMENDMENT TO CONSULTING SERVICES AGREEMENT
1. EFFECTIVE DATE AND PARTIES. Effective on December 1, 1999 Contra Costa
County (herein called "PUBLIC AGENCY"), and Subsurface Consultants, Inc.
(herein called "CONSULTANT"), mutually agree as follows:
2. PURPOSE. The parties desire to amend the agreement they entered into, effective
February 1, 1998 entitled "Consulting Services Agreement," to provide payment for
additional work furnished to the Public Agency.
3. AMENDMENT. Said agreement is hereby amended as follows:
1.d. Completion date: Change from "February 1, 2000" to "December 1, 2000."
1.e. Payment Limit: from "$100,000" to "$150,000.00"
4. EFFECT. Except for the amendments agreed to herein, said contract remains in
full force and effect.
