DIRECT the Director of Community Development to file a Notice of Determination and a
Certificate of Fee Exemption: De Minimis Impact Finding with the County Clerk.
AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to Community
Development for processing, and a $25 fee to the County Clerk for filing the Notice of
Determination.
11. FINANCIAL IMPACT:
The estimated project cost is $400,000 funded by 80% Highway Bridge and Rail Replacement
(HBRR) funds and 20% local funding.
Ill. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes the replacement of the existing two-lane, 22-foot wide by 31-foot long Bailey
Road Bridge with a new two-lane 32-foot wide by 40-foot long reinforced concrete slab structure
in approximately the same location as the existing bridge.
It is needed in order to bring the bridge up to current standards.
The project has been determined to be in compliance with the General Plan. A Mitigated
Negative Declaration of environmental significance pertaining to this project was published
October 20, 1999. The Board has considered the Mitigated Negative Declaration together with
all comments received' during the public review period.
This project has been found to be de minimis in its effect on the environment and is exempt from
the $1,250.00 Fish and Game filing fee.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize
funding.

NOTICE OF PUBLIC REVIEW AND INTENT TO ADOPT'A PROPOSED
MITIGATED NEGATIVE DECLARATION
County File # CP 99-62
Pursuant to the State of California Public Resources Code and the "Guidelines for
Implementation of the California Environmental Quality Act of 1970" as amended to
date, this is to advise you that the Community Development Department of Contra
Costa County has prepared an initial study on the following project:
BAILEY ROAD BRIDGE REPLACEMENT, County File # CP99-62: The Contra Costa
County Public Works Department proposes to replace the existing two-lane, 22-foot
wide by 31 foot long Bailey Road Bridge. A new two-lane 32 foot wide by 40--foot long
reinforced concrete slab structure will be constructed in approximately the same
location as the existing bridge. A small permanent easement (0.08 acre) will be
obtained from the Concord Naval Weapons Station in order to accommodate the slight
expansion in size of the bridge. In addition, the County will require a temporary
easement on the Weapons Station property to accommodate construction activities.
Restriping will allow the existing 11 foot wide lanes of Bailey Road to meet the 12- foot
wide lanes of the new bridge. Depending on the abutment system chosen, loose rock
slope protection (RSP) may be required at the base of the bridge to minimize erosive
flow damage. If used, the RSP will be covered with soil and seeded above the ordinary
high water mark, upon completion of the project. In order to construct the new
abutments, minor grading of approximately 160 ft2 of creek bank and channel will be
necessary. Existing roadside drainage ditches will be modified as necessary to drain
the slightly realigned roadway and to continue discharging into Mt. Diablo Creek.
Overhead utility lines (including power, telephone, and cable) and two utilities located
under the bridge (gas and water) will require relocation. In order to facilitate
construction while allowing for continued access through the area, a two-lane detour
road will be installed immediately adjacent to the existing bridge through Mt. Diablo
Creek. The detour road will consist of approximately 1,600 cubic yards of soil.
Following construction, the soil used for the detour road will be removed and the pool
area restored. In order to minimize further headcutting associated with the pool,
approximately 10 yd of rock slope protection will be installed at the upstream end of the
pool. The work associated with replacement of the bridge will be performed during the
summer season. if Mt. Diablo Creek is not dry at the time of construction, the creek will
be dewatered in order to minimize impacts to water quality as well as to facilitate
construction. Approximately seven trees may require removal due to installation of the
detour road and general bridge construction. Trees in the riparian zone removed a

Project Location: The Bailey Road Bridge is located over Mt. Diablo Creek in the
Concord area of central Contra Costa County. The Naval Weapons Station property
adjoins the project site on the northwest side, and the land use designation is
Public/Semi-Public in the County General Plan. The remaining land use in the project
area is designated as Single Family High Density or Low Density.
The proposed project will not result in any significant impacts.
A copy of the mitigated negative declaration and all documents referenced in the
mitigated negative declaration may be reviewed in the offices of the Community
Development Department, and Application and Permit Center at the McBrien
Administration Building, North Wing, Second Floor, 651 Pine Street, Martinez, during
normal business hours.
Public Comment Period — The period for accepting comments on the adequacy of the
environmental documents extends to 5:00 P.M., Monday, November 22, 1999. Any
comments should be in writing and submitted to the following address:

The project will not have a significant effect on the environment. The
recommendation is based on the following:
9. The project will not create unstable earth conditions, changes in geologic substructure
or increase the exposure of people or property to geologic or water related hazards.
2. No significant negative aesthetic effect will result from the project. Approximately seven
trees may require removal to allow for the new bridge design and installation of the
detour road, however, the trees do not represent a scenic resource since they do not
constitute a stand of trees and are not the dominant view from the adjacent residences
or Bailey Road. All areas left exposed due to construction of the bridge will be seeded
with a mix including native grasses and wildflowers upon completion of the project.
3. No new species will be introduced into the area as a result of the project. No reduction
in acreage of any agricultural crop will occur as a result of the project. No construction
activities will occur within any areas designated as "Environmentally Sensitive Areas„
on the project plans. Any direct impacts to wildlife will be minimized to less than
significant through preconstruction surveys and relocation of any fish or wildlife found
in the vicinity of the construction area. Impacts to red-legged frog habitat will be
mitigated through the restoration of the pool to be temporarily impacted by the detour
road as well as the purchase of credits at either Black Diamond Mines Red-legged Frog
Mitigation Bank (if the bank is open and operating at the time of purchase of the
mitigation credits) or the Pleasanton Ridge Red-legged Frog Mitigation Bank (the only
currently operating red-legged frog mitigation bank).

Construction activities will create minor, short-term, temporary impacts. But no significant
impacts will occur since the following best management practices are incorporated into the
project and in project specifications.
4. There will be no significant change in the air quality at the site as a result of the project.
Construction machinery and vehicles will generate short-term emissions and possibly
objectionable odors during construction which may temporarily deteriorate air quality
at the project site. To minimize the impact, contract specifications will stipulate the use
of properly tuned and muffled equipment. Air quality impacts will also be reduced by
eliminating unnecessary idling of machines when not in use. Dust palliatives or water
may be applied to minimize fugitive dust during construction, if warranted.
5. Construction of the replacement bridge will occur during periods of low or no flow(e.g.,
April 15 to October 1) to avoid water quality impacts. If water is present, the
construction area will be dewatered by installing cofferdams and diverting water around
the work site. A silt filter barrier will be installed to minimize the amount of sediment
moving downstream.
6. Traffic will be diverted to a temporary detour road during construction of the new bridge,
which may create a minor inconvenience to travelers on the roads surrounding the
bridge. The project has the potential for interfering with an emergency response.
However, the general public will be notified prior to the onset of construction and the
detour road will remain one lane in each direction and should minimize traffic impacts
due to construction of the replacement bridge and subsequent emergency response
delays.
7. Caltrans Standard Specifications, including the use of properly tuned and muffled
equipment, will apply regarding construction noise. Limiting the hours of work to 7:30
a.m. to 5.00 p.m., Monday through Friday, unless modified upon written approval, will
also minimize noise impacts.

adjoins the project site on the northwest side, and the land use designation is

DETERMINATION
On the basis of this initial evaluation:
I find that the proposed project COULD NOT have a significant effect on the environment, and a
NEGATIVE DECLARATION will be prepared.
✓ I find that although the proposed project could have a significant effect on the environment,there
will not be a significant effect in this case because the mitigation measures described on an attached
sheet have been added to the project. A MITIGATED NEGATIVE DECLARATION will be
prepared.
I find that the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENTAL IMPACT REPORT is required.
I find that the proposed project MAY have a significant effects)on the environment,but at least one
effect (1) has been adequately analyzed in an earlier document pursuant to applicable legal
standards, and (2) has been addressed by mitigation measures based on the earlier analysis as
described on attached sheets, if the effect is a "potentially significant impact" or "potentially
significant unless mitigated." An ENVIRONMENTAL IMPACT REPORT is required,but it must
analyze only the effects that remain to be addressed.
I find that although the proposed project could have a significant effect on the environment,there

SUMMARY: The replacement bridge will be constructed in approximately the same location and with

similar dimensions and materials as the existing bridge,therefore,the visual quality of the new bridge
will be essentially the same as the existing bridge. Construction equipment will be visible temporarily
during construction,however this is a minor and short term impact,ending upon completion of the
project. Approximately seven trees may require removal for installation of the replacement bridge and
the associated detour road. The trees include two walnut trees that are less than approximately 3"dbh,
three walnuts that are approximately 12"dbh,one almond tree that is approximately 3"dbh, and one
willow that is approximately 3"dbh. Additional trees including a 3"dbh olive and a 24"dbh pine may
require trimming of limbs and/or roots. In order to minimize damage to the trees that may be impacted
by construction,contract specifications will include protective measures such as clean trimming and
treating of roots and limbs. Construction activities will impact the minimum amount of vegetation
necessary to complete the replacement bridge. The trees to be removed and/or trimmed do not constitute
a stand of trees and are not the dominant view from either the adjacent residences or Bailey Road.
Therefore,removal of the trees will not have a substantial adverse effect on scenic resources. Replacing
the Bailey Road.Bridge will not produce a significant amount of new light or glare since the new bridge
will be constructed in approximately the same location and with similar dimensions and materials as the
existing bridge.

SUMMARY:
Construction of the project is expected to occur during the spring and summer months. In the event that
Mt. Diablo Creek is flowing at the beginning of the construction period,dewatering of the creek will be
necessary. If dewatering is necessary,pre-construction surveys will be performed to identify and
relocate wildlife and fish in the vicinity of the construction. Any fish or wildlife captured will be
relocated to an appropriate location outside or downstream of the construction area. Exact locations for
release of captured fish and wildlife will be determined by Public Works staff in consultation with the
California Department of Fish and Game.
Approximately 92 tule elk(Cereus elaphus nannodes)live on the Concord Naval Weapons Station
property. The weapons station has approximately 3,000 acres of pasture area available to the tule elk for
grazing. Construction associated with the Bailey Road Bridge will temporarily remove approximately
1.3 acres of pasture land. This impact is negligible since it constitutes less than one percent of the total
tole elk pasture area. The construction area will be surrounded by a 6 foot tall chain link fence with a
barbed wire top. This security fencing is required since the Concord Naval Weapons,Station is a high
security facility. Installation of the security fencing will isolate the tule elk from the construction area
and minimize the possibility of injury or disturbance due to construction activities. Following
construction,the fencing will be returned to approximately the same pre-project location.
Several sitings of California red-legged frog(Rana aurora draytoniz), a federally threatened species,
have been identified on the Concord Naval Weapons Station property,which is located just downstream
of the Bailey Road Bridge project site. The nearest red-legged frog siting is less than a mile away from
the Bailey Road.Bridge. There will be temporary impacts to red-legged frog habitat due to construction
of a detour road that will provide a bypass around the bridge work. In order to replace the bridge and
continue to provide access to residents,a temporary detour road will be constructed adjacent to the
existing bridge. The detour road will be constructed through a pool in Mt.Diablo Creek immediately
downstream of the existing bridge. The pool provides potential habitat for the red-legged frog. Impact
to the pool will consist of approximately 1,320 ft2. The impact to red-legged frog habitat will occur for
as long as the pool holds water(i.e.,approximately six to eight weeks). U. S. Fish and Wildlife Service
(USFWS)representatives have met with Public Works staff and determined that mitigation at a 2:1 ratio
will be required for the temporary impact to the red-legged frog habitat. Specific details of the
mitigation are discussed below. Impacts to the red-legged frog due to the dewatering are expected to be
negligible.
The California Natural Diversity Data Base(CNDDB)has records of California tiger salamander
(Ambystoma ealiforniense)within a mile of the project site; however, there is no breeding habitat on-site

for the species. Upland areas adjacent to the project site could provide suitable upland estivation habitat;
however,due to the small area of temporary disturbance,extent of existing disturbance and the marginal
quality of habitat for California tiger salamander,potential impacts are not anticipated. In addition,
impacts to steelhead(Oncorhynchus mykiss irideus)are expected to be negligible since Mt. Diablo Creek
is ephemeral and is typically completely dry during the spring and summer months.
In order to mitigate for the temporal loss of habitat for red-legged frog due to construction of the
temporary detour road,Contra Costa County will purchase the appropriate number(to be determined by
the U.S.Fish and Wildlife Service)of mitigation credits at a local red-legged frog mitigation bank. The
mitigation bank utilized to mitigate for impacts to red-legged frog habitat will be either the Black
Diamond Mines Mitigation Bank(if it is open and operating when the County is purchasing mitigation
credits)or the Pleasanton Ridge Mitigation Bank(the only currently available mitigation bank). In
addition,the pool adjacent to the Bailey Road Bridge that will be temporarily impacted due to the
construction of the detour road will be restored following completion of the bridge project and removal
of the temporary access road. Fill associated with the temporary detour will be removed and the pool
will be re-excavated to approximate pre-project conditions. The banks of the pool will be revegetated
with appropriate upper-riparian species such as buckeye,valley oak,walnut and elderberry. Trees within
the riparian zone removed as a result of the project will be replaced at a 3:1 ratio in the vicinity of the
pool to be impacted.The purchase of mitigation credits at an appropriate red-legged frog mitigation bank
and the restoration of the pool will constitute the 2:1 mitigation ratio required by the USFWS for
temporal impacts to the pool. Potential direct impacts to wildlife will be mitigated by performing pre-
construction surveys for any fish and wildlife in the vicinity of the construction. If red-legged frog are
found during the preconstruction surveys, a qualified biological monitor will be retained to monitor the
project site. The biological monitor will hold a copy of the incidental take permit for red-legged frog
obtained as a result of the County's programmatic Section 7 consultation with USFWS and will relocate
any red-legged frogs found to appropriate habitat downstream of the project site.
The pool to be temporarily filled to construct the detour road,as well as some of the construction activity
associated with the construction of the bridge itself, is within U.S.Army Corps of Engineers,Regional
Water Quality Control Board,and California Department of Fish and Game jurisdiction. Department of
Public Works staff have coordinated with staff from the various regulatory agencies regarding the
project,and the appropriate permits will be obtained. Many of the typical permit conditions(i.e.,
replacement of riparian trees at a 3:1 ratio, dewatering of the creek in the event that it is flowing at the
start of construction),have already been incorporated into the design of the project. The County will
comply with all additional conditions required by the various regulatory permits. Temporary impacts to
the pool will be mitigated through restoration as described above.

including informing personnel connected with the project of the possibility of finding archaeological

SUMMARY:According to the Assessors Parcel Map for the area that includes the Bailey Road Bridge,there
is no known earthquake fault in the area as delineated on the Alquist-Priolo Earthquake Fault Zoning Map.
Potential seismicity in the area has been accounted for in the design of the replacement bridge structure.
According to the Resource Mapping System and the soil survey of Contra Costa County, Garretson loam
soils with a 0 to 2 percent slope are found in this area. These soils have a moderate to low liquefaction
potential. The potential for runoff'is very slow to slow,and the hazard of erosion is none to slight where the
soil is tilled and exposed.
Grading of the construction site will result in a minor change in topography and temporarily increase the
exposure of soils to wind erosion. However,this impact is insignificant given that the total area affected is
only approximately 1.3 acres. Depending on the abutment system chosen,approximately 160 ft2 of loose
rock slope protection(RSP)may be required at the base of the bridge to minimize erosive flow damage. If
used,the RSP will be covered with soil and seeded above the ordinary high water mark, upon completion
of the project, as will other exposed areas. With the exception of the detour road,minimal modification of
the creek channel and increase in soil erosion will occur as a result of the project. In order to construct the
new abutments, minor grading of approximately 160 ft2 (0.004 acre) of creek bank and channel will be
necessary. Following construction of the bridge,the detour road will be removed and the pool restored. In
order to minimize further headcutting associated with the pool, approximately 10 yd3 of rock slope
protection will be installed at the upstream end of the pool. Adherence to standard dust control and erosion
control practices, including, but not limited to, general watering of exposed areas and/or use of chemical
stabilizers will minimize impacts. These measures will be incorporated into the construction contract.
Superficial grading of the project area is not expected to result in unstable earth conditions or change
geographical substructures. Exposure of people or property to geologic hazards is not expected to increase
as a result of the project.
All areas left exposed due to construction of the bridge will be seeded with a mix including native grasses
and wildflowers upon completion of the project in order to stabilize exposed soil.

SUMMARY: According to the"State of California Hazardous Waste and Substances Site List(April
1998),there are no listed hazardous waste sites in or near the project area. The project has the potential
to release hazardous substances,such as accidental petroleum spills,during construction. Per the

SUMMARY: Water Quality Certification or waiver thereof will be obtained from the San Francisco Bay
Regional Water Quality Control Board(RWQCB)prior to construction of the project. Special conditions

Construction of the bridge will occur during periods of low or no flow(e.g. April 15 to October 1)to

The Bailey Road Bridge crosses over Mt. Diablo Creek. According to the Contra Costa County Flood
Control District Flood Insurance Rate Zone Information Map and the Resource Mapping System,the
creek and the area east of the creek are in a floodplain. However,since the new bridge will be
constructed at approximately the same location as the existing bridge,there will be no increased
exposure of people or property to flooding. Additionally,since the design of the new bridge is similar to
the existing bridge, it will not impair the flow of water;nor will it alter the course or flow of flood
waters. The existing bridge deck treasures approximately 22-feet by 31-feet and will be expanded to
approximately 32-feet by 44-feet. The increase in the bridge size is necessary to match the current
approaches and will not create an impervious surface area that will substantially increase the rate and
amount of runoff. Therefore,the amount of surface water in Mt. Diablo Creek will not change
significantly as a result of the project. Building the bridge will not adversely affect the quantity or
duality of surface water, ground water or public water supply.

SUMMARY: CEQA indicates that a project will normally have a significant adverse impact if it causes a
substantial increase in the ambient noise level in areas adjacent to the project site. The dominant source
of noise in the project area comes from vehicles already using Bailey Road. The new bridge will be
approximately ten feet longer and wider but it will not increase the usage of Bailey Road,therefore the
ambient noise levels associated with routine use of the new bridge will remain the same. Construction of
the project will increase the noise level temporarily. The closest sensitive receptors(i.e.,houses,
schools,churches)to the project site are residential parcels that are at least 100 feet from the proposed
bridge site. In general,construction activities produce noise levels of 86 dBA at 50 feet which is well
below the threshold of pain of 120-140 dBA. Contract specifications will require the use of properly
tuned and muffled equipment to minimize noise due to construction. Working hours will be limited to
7:30 a.m.to 5:00: p.m. Monday through Friday,unless modified upon written approval,to reduce
construction noise levels. These working hours will be incorporated as part of the construction contract.
Use of the detour road may increase the noise level for the residents of the home located on the
southwest side of the project area due to its location, however,this is a temporary impact that will end
upon completion of the project.

SUMMARY: The proposed project is on an existing roadway. Installation of the replacement bridge and
adjacent detour road will not affect available capacity and will therefore not induce population growth.
Construction of the bridge will not result in the displacement of any homes or residents. The project will
not result in a change in the location,distribution,density or growth rate of human population in the area.
The project will not affect existing housing,or create a demand for additional houses. Construction of
the replacement bridge and detour road will not require the removal of any homes or the displacement of
any people.

SUMMARY: Bailey Road is defined as an arterial roadway in the County's General Flan. The project
involves replacing the existing Bailey Road Bridge. The existing two-lane, 22-foot wide bridge is
deteriorating and requires replacement. Installation of the new 32-foot wide replacement bridge will bring
the bridge up to current standards but will not increase the capacity or usage of Bailey Road.
In order to allow replacement of the bridge while continuing to provide access to residents, a temporary
detour road will be constructed adjacent to the existing bridge. The detour road will be constructed through
a pool in Mt.Diablo Creek immediately downstream of the existing bridge. The detour road will be paved
and will have two 12 foot wide lanes each with a four foot shoulder. Installation of the detour road will
minimize traffic impacts due to the construction.
The project is consistent with the Transportation and Circulation Element of the General flan. Replacing
the bridge will not generate additional traffic except during construction when vehicles associated with those
activities utilize the local street system; however, the amount of additional traffic is insignificant. The
project has the potential for interfering with an emergency response; however,the general public will be
notified prior to the onset of construction in order to minimize delays in the emergency response. The
project will not alter waterborne,rail or air traffic as no water,rail or air transportation facilities are located
in the immediate vicinity of the project area

SUMMARY:The project will result in the relocation of some overhead utilities(including power,
telephone and cable)as well as two utilities(gas and water)hanging from the bridge. All relocation
activities will be coordinated with the appropriate utility agencies. The utilities on the bridge will be
hung off the new bridge and the overhead utilities will be replaced in approximately the same location
following construction of the new bridge. Existing roadside drainage ditches will be slightly modified to
accommodate the minor increase in size of the bridge and will continue to discharge into Mt. Diablo
Creek.

SUMMARY. As discussed above under#IV Biological Resources,the project does have the potential to
significantly impact plant or animal resources; however, direct impacts to wildlife will be minimized by
conducting preconstruction surveys and relocating any fish and wildlife found in the vicinity of the
construction area. Impacts to red-legged frog habitat will be mitigated through the restoration of the pool
to be impacted by the detour road as well as the purchase of credits at either Black Diamond Mines Red-
legged Frog Mitigation Bank(if the bank is operating at the time of purchase of the mitigation credits)or
at Pleasanton Ridge Red-legged Frog Mitigation Bank (the only currently operating red-legged frog
mitigation bank). Implementation of these mitigation measures will reduce the potentially significant
impacts of the project to a less than significant level. According to the cultural resources survey report
prepared for the project,no examples of major periods of California history or pre-history exist on the site.
Due to the nature of the project and the area in which it is proposers,the project will not have impacts that
are individually limited but cumulatively considerable. The bridge will be located in a previously disturbed
area in the approximate location of the existing bridge. Installation of the replacement bridge will not
increase the capacity of Bailey Road.
As discussed in Sections I(Aesthetics), III(Air Quality),VII(Hazards and Hazardous Materials),X(Noise),
XII(Population and Housing),and XIII Public Services,the proposed project will not result in substantial
adverse effects on human beings,either directly or indirectly.

Project Description.Common Name(if any)and Location:Bailey Road bridge Replacement Project,County pile#CP 99-62. The
Contra Costa County Public Works Department proposes to replace the existing two-lane,224 of wide by 3'4bot long Bailey Road Bridge.
A new two-large 32-foot wide by 40-foot tong reinforced concrete slab structure will be constructed in approximately the same location as
the existing bridge. A small permanent easement(0.08 acre)will be obtained from the Concord Naval Weapons Station in order to
accommodate the slight expansion in size of the bridge. In addition,the County will require a temporary easement on the Weapons Station
property to accommodate construction activities. Restriping will allow the existing 11-foot wide lanes of Bailey Road to meet the 12-foot
wide laim of the new bridge. Depending on the abutment system chosen,loose rock slope protection(IPSP)may be required at the base
of the bridge to minimize erosive flow damage. If used,the RSP will be covered with soil and seeded above the ordinary high watermark,
upon coormpletson of the project. In order to construct the new abutments,minor grading of approximately 160 ft,?-of geek bank and channel
will be necessary. Existing roadside drainage ditches wilt be modified as necessary to drain the slightly realigned roadway and to continue
discharging Into Mt Diablo Creek. Overhead utility lines{including power,telephone,and cable)and two utilities located under the bridge
(gas and water)wilt require relocation. In order to facilitate construction while allowing for continued access through the area,a two-lane
detour iniad wilt be Installed immediately adjacent to the existing bridge through Mt. Diablo Creek. The detour road wilt consist of
approAmately 1,600 cubic yards of soil. Following construction,the soil used for the detour road will be removed and the pool area
restored. In order to minimize further headcrating associated with the pool,approximately 10 yd3 of rock slope protection will be installed
at the upstream end of the pool. The work associated with replacement of the bridge will be performed during the summer season.If Mt.
Diablo Creek Is not dry at the time of construction,the crook will be dewatered In order to minimize acts to water quality as well as to
facilitate construction. Approximately seven trees may require removal due to Installation of the detour road and general bridge

on the basis of the Initial study and checklist, no additional CEQA document need be prepared. Based on an Initial Study
conducted to evaluate the potential for adverse impacts and considering the record as a whole, there is no evidence that the
proposed project will have a potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends.
Based on substantial evidence, the County of Contra Costa rebuts the presumption of adverse effect as listed at subsection (d)
of Section 753.5 of the Fish and Game Code.
