Creation of North Richmond Municipal Advisory Council. Pursuant to the authority granted by Section 31410 of the California Government Code, the North Richmond Municipal Advisory Council (NRMAC), was created by the Board of Supervisors with the passage of Board Resolution 92/346 dated May 5, 1992. The NRMAC is hereby re- established with its composition to be as herein provided effective on the date of this Resolution's adoption. This Resolution supercedes all past Board Resolutions (e.g., 99/507, 97/532, etc.) concerning the NRMAC and its composition except that all present incumbent Council members are continue in their offices according to their election or appointment. 2. Membership and NRMAC Boundaries. The Council shall consist of nine (9) members. Six members shall be resident voters of the North Richmond community. Two (2) members of the Council shall serve as representatives from businesses located within or adjacent to the North Richmond unincorporated area. One member shall serve as a representative of the incorporated area (as hereinafter described) of the City of Richmond that immediately adjoins the NRMAC boundaries. The boundaries of the North Richmond community and NRMAC are as depicted by the document map reference on file in the Contra Costa County Assessor's office for this purpose and which may be examined at that office. 3. Terms of Office. a. Elected Permanent Council: (1) The six elected members of the NRMAC shall be elected by the resident voters of the North Richmond unincorporated area in conformance with the Uniform District Election Law (Elections Code sections 23500 et seq.,), with the cost of conducting such election(s) to be borne as directed by the Board of Supervisors. (2) All members elected to office during regular elections shall hold office for terms of four years or until their successors are elected and qualify (take office). Election cycles shall be staggered with four seats being up for election during one cycle, (starting in 1999), and two seats being elected during the alternate cycle, (starting in 2001). (3) Vacancy. Should a vacancy occur at any time in any Council Member's term, the Board of Supervisors may appoint a NRMAC community resident voter to serve for the remainder of that vacant office's term. b. Appointed Business Seats: (1) Two members of the NRMAC shall be appointed. These members shall be business persons whose facilities are operating in or adjacent to the unincorporated area of North Richmond. (2) The terms of office for these business representatives shall be four year terms. -1- RESOLUTION N0. 99/660 (3) Vacancy. Should a vacancy occur at any time the Board of Supervisors may appoint a replacement. c.- Appointed.Richmond City Resident: (1) One appointed NRMAC Council Member shall be (and remain during the Member's term) a resident voter of the incorporated area of the City of Richmond located south of Chesley Avenue, east of York Street, north of Willard Avenue and west of the Southern Pacific Railroad right-of-way as generally shown on the attached diagram. (2) The term of office for this appointed City of Richmond resident shall be four years. (3) Vacancy. Should a vacancy occur at any time, the Board of Supervisors may appoint a qualified replacement. 4. Council Duties and Powers: a. The Council shall advise the Board on: (1) Services which are or may be provided to the North Richmond Community by the County or other local governmental agencies. Such services include, but are not limited to, public health, safety, welfare, public works and planning. (2) The feasibility of organizing the existing special districts serving the North Richmond community in order to more efficiently provide public services such as, but not limited to, water, sewer, fire, parks recreation, and infrastructure improvements. b. The Council may: (1) Represent the North Richmond community before the Local Agency Formation Commission on proposed boundary changes affecting the community. (2) Represent the North Richmond community before the County Planning Commission(s) and the Zoning Administrator on land use and other planning matters affecting the community. In this regard, the Council shall cooperate with other planning advisory bodies in the North Richmond County area in order to avoid duplication and delay in the planning process. (3) Provide input and reports to the Board, County staff or any County hearing body on issues of concern to the North Richmond community. c. It is understood that the Board is the final decision-making authority with respect to issues concerning the North Richmond community and that the Council shall serve solely in an advisory capacity. Except as specified above, the Council may not represent the North Richmond community to any State, County, city special district or school district, agency or commission, or any other organization on any matter concerning the community. 5. Compensation.- The ompensation:The Council members shall serve without compensation of any kind and the Board shall not provide funds for the payment of Council meeting stipends of reimbursement of Council members' expenses. 6. Staff and Financial Support: The Board shall provide no ongoing professional or clerical staff support to the Council or provide funds to pay for any of the Council's operating costs. However, County staff will provide the Council with information and reports on matters of interest to the Council. 7. Council Establishment Not Subject to Vote: _2_ RESO=ON No. 99/660 The issue of establishment of an elected Council shall not be an election item submitted Jo the voters of the North Richmond community. 8. Council.O eratign: Within the parameters of this Resolution, the Council may organize itself and operate as it determines but shall hold regular meetings at least monthly at an established time and place. The Council meeting shall be conducted in accordance with the provisions of the "Brown Act" (Government Code Sections 54950 ff.) and the county's Better Government Ordinance including the pre-meeting posting of meeting calendar notices. In addition, the Council shall fully comply with the Board of Supervisors' policy concerning conflict of interest and open meetings (Resolution No. 82/574 and the Political Reform Act (Government Code sections 81000 ff.) as applicable. 9. Council Funds: Any funds transferred to or received by the County for the Council shall be accepted pursuant to Resolution No. 90/334 and only used for the benefit of the Council and its North Richmond community.
