Recommended Action: APPROVE Project Contingency Fund increase of$55,000.00 and Contract Change Order No. 2 in the approximate amount of$52,000.00 and AUTHORIZE the Public Works Director to execute it in order to compensate the contractor, Carone & Sons, Inc., for unforeseen extra work. I(. Financial lmpact: The Project Contingency Funds are currently insufficient to cover the cost of extra work. Reasons for Recommendations and Background: The scope of work was increased to provide erosion control for the slope adjacent to the project and install pavement section for Cummings Skyway. Change Order No. 2 was needed to increase contract items, which exceeded the limits specified in Public Contract Code Section 24395 and exceeded the project contingency fund, APPROVAL of the change order and project contingency fund increase is REQUIRED. IV. Consequences of Negative Action: The lack of APPROVAL would prevent successful completion of this contract and preclude payment to the contractor for required work. Financial impact: There will be no impact on the County General Fund. The contract cost is $30,000.00 and is funded by Federal Highway Admnistration Funds (88.53%) and Road Funds (11.47%). Reasons for Recommendations and Back rq ound: On June 18, 1998 the Public Works Department entered into a contract with Gordon N. Ball, Inc. to perform emergency repairs on Fish Ranch Road in the Orinda area. The contract was accepted on december 8, 1998. On December 28, 1998, Gordon N. Mall, Inc. filed a claim with the Clerk of the Board for the above referenced project. The County is currently preparing its case to defend its position on this claim. The Public Works Department has entered into discussion with the Covello Group, Inc. to provide legal advisory services. IV. Consequences of Negative Action. The lack of approval would prevent the County from retaining the services of the Covello Group, Inc.
