In its bid, Tank Protect listed Thunder Electric as a WBE subcontractor, with the dollar value of the subcontract being $8,700.00. On October 15, 1996, the Beard of Supervisors awarded the contract to Tank Protect. The contract work has been completed, and the project was accepted by the Board on July 28, 1998. On September 17, 1998, Tank Protect advised the Public Works Department that Thunder Electric had not been used on the project and that the electrical work in question had been performed by Tank Protect. Public Contract Code Section 4107 provides for the substitution of subcontractors only for certain specified grounds and only with the prior, written consent of the awarding authority or its designated officer. For violations of those provisions, Section 4110 provides for the assessment of a penalty of not more than ten percent of the amount of the subcontract involved. In addition, Section 4110 provides that violators are subject to discipline by the Contractors State License Board. It is recommended that the Board assess a penalty of $870.00, which is ten percent of the involved subcontract. It also is recommended that the County submit a written complaint to the Contractors State License Board'. Tank Protect has been notified of these recommendations and afforded an opportunity to address the Board. FINANCIAL IMPACT: NONE. The Blackhawk Homeowners Association(HOA)maintains the common area and the storm drain line. The landslide occurred within the boundaries of the Blackhawk GHAD. The slide occurred on February 8, 1998 and was reported to the GHAD almost immediately. The GHAD responded to the slide as an emergency and installed steel reinforced concrete caissons to protect the two residences. The temporary repair remained stable through subsequent rains,although the lower portion of the slide required numerous additional responses to stabilize. Engeo,Inc., San Ramon, California was retained by the GRAD to evaluate the landslide and recommend a repair strategy. By letter dated July 6, 1998,Engeo transmitted their findings and recommendations to the GHAD. Engeo recommended the installation of additional steel reinforced concrete caissons as well as removal and replacement of slide material with drained-engineered fill. The damaged storm drain will be replaced. The project was included in the adopted FY 99/99 budget with an estimated repair cost in the range of $150,000.00 to$200,000.00. Because the landslide damaged a portion of the HOA maintained drainage system,the Blackhawk HOA agreed to contribute$36,250.00 toward repair of the storm drain. Consequential damage to landscaping and other site improvements has been estimated(by the two homeowners)to be in excess of$100,000. License Agreements providing the GHAD with sufficient rights to enter upon and repair the landslide have been executed with the Blackhawk HOA as well as the two affected homeowners(Goza and Watson). The License Agreements with the two homeowners provide for the GHAD to partially reimburse the homeowners the cost of repairing and/or replacing landscaping and other improvements damaged by the landslide in accordance with the GHAD's interim policy on Funding for the Repair and/or Replacement of Landscaping and other Improvements Damaged by Landslides. Board Resolutions 86/370 and 98/329 define procedures related to advertising and awarding of GHAD maintenance and repair contracts. On September 21, 1998,the GHAD advertised for bids for the repair of both the Chestnut Place landslide and the damaged storm drain line. Pursuant to the provisions of Resolution 98/329, four pre-qualified contractors were invited to submit bids. Bids were received and opened in the office of the General Manager on Thursday,October 8, 1998. The lower of the two bids received was from Siteworks Construction, Inc.,Lafayette,California, in the amount of$247,915.00. Sufficient funds are available in the approved GHAD budget and its reserve account for the project. Because of the emergency nature of the project and the need to proceed with the repair before the winter rains, the General Manager awarded the contract to Siteworks Construction,Inc., on October 13, 1998. The License Agreement with the Blackhawk HOA gives the GHAD permission to enter and repair that portion of the landslide that impacted property owned and maintained by HOA. The Agreement also gives the GHAD's contractor(Siteworks Construction Inc.,Lafayette,California)permission to use a portion of HOA maintained common area as a staging area for its operations. In addition,the License Agreement with the HOA provides for the transfer of$36,250.00 to the GRAD to cover the HOA's obligations with respect to repair of the damaged storm drain line. The License Agreements with the two homeowners(Goza and Watson)provide the CHAD with the necessary rights of entry and liability protection to proceed with the repair. The Agreements also provide for the GHAD to partially reimburse the homeowners the cost of repairing and/or replacing landscaping and other improvements damaged by the landslide. Said reimbursement is subject to submittal of invoices and was developed in accord with the GHAD's interim policy on Funding for the Repair and/or Replacement of Landscaping and other Improvements Damaged by Landslides. Because of the emergency nature of the project and the need to proceed with the repair before the winter rains, the General Manager executed the agreement with the Blackhawk HOA on September 23, 1998. The agreements with the Gozas and the Watsons were executed on October 12, 1998. The contract with Siteworks Construction was awarded on October 13, 1998. Consequences of Negative Action: Without the rights provided by the three License Agreements,the GRAD would not have been able to award a contract for the repair and the Chestnut Place landslide could not be repaired this season. Any significant delay in the repair could possibly result in significant damage to the two houses located at the top of the landslide.
