SUBJECT: Ratify previous permission by the Public Works Director to 'completely close a
portion of Lone Tree Way, for the purpose of installing sewer and water lines,
Brentwood area.
The Public Works Director having reported that prior approval has been granted to the City
of Brentwood to completely close Lone Tree Way, except for emergency traffic, for 24 hours a day
from Wednesday, September 30, 1998 to Thursday, December 31, 1998, subject to the following
conditions:
1. Traffic will be detoured via neighboring streets.
2. All signing to be in accordance with the State of California Manual of Traffic Controls.
3. The City of Brentwood shall comply with the requirements of the Ordinance Code of Contra
Costa County.
4. Provide the County with a Certificate of Insurance in the amount of $1,000,000 for
Comprehensive General Public Liability, which names the County as an additional insured
prior to permit issuance.
5. Obtain approval for the closure from the Sheriff's Department,the California Highway Patrol
and the Fire District.

I. ftgomMended Action: APPROVE Agreement to provide right of way services to the City of
Dixon for their Downtown Multi-Medal Project and AUTHORIZE the Board Chair to sign the
agreement on behalf of the County.
If. Financial Impact: The City of Dixon will pay the actual costs for Real Property staff right of way
services.
Ill. Reasons for Recommendations i1nd ftckaround: The City of Dixon requires a variety of right
of way services but has no right of way staff and desires to contract with the County for these
services. Their funding sources require the use of a State Certified Agency such as Contra Costa
County.
IV. Consequences of Negative Action: Less efficient government would result because the``City
of Dixon would have to hire addition I private contractors at greater expense.

AGREEMENT
1. Effective Date and Parties. Effective on August 25, 1998, the COUNTY OF
CONTRA COSTA, a political subdivision of the State of California (hereinafter
referred to as "County") and the CITY OF DIXON, a municipal corporation
(hereinafter referred to as "City") hereby mutually promise and agree as follows:
2. Pur ase, The City is planning the Downtown Multi-Modal project which involves
at funds and requires oversight by a state certified agency. Contra Costa
County is a certified agency. The City has no right of way staff and desires to
contract with the County for property acquisition and oversight services.
3. Services by County. The services to be rendered by County to City may include
appraisal review, negotiation, land rights document preparation, right of way
acquisition, relocation, angor selection and supervision of independent contractors
providing such services as outlined in Appendix "B" attached.
4. Payment for Services. City agrees to reimburse County for all labor costs and
appropriate overhead for County Real Property Agents labor including overtime
rates for evening or weekend work (See Appendix "A" far pay rates). Said costs
shall not exceed $12,000 unless agreed to in writing by the City. City shall pay all
acquisition settlement and any other costs of acquisition such as title fees,
recording fees, etc. Such payments shall be made within 30 days of billing by
County.
5. Indemnification. City agrees to defend, indemnify and save harmless County, its
officers, and employees against any and all loss, damage, liability,;expense, claims
or demands of whatever character, direct or consequential, directly or indirectly
contributed to or caused by County assuming and acting as the right of way agency
for and on behalf of City.
6. In open Status. Nothing herein shall be construed to imply;that any County
employee providing services hereunder is a City employee.
7. Tim. The term of this agreement shall commence on the effective date hereof and
shall end upon termination by either party upon 30 days written notice. The rights
and obligations of Paragraph 5"Indemnification"shall survive any such termination.

SUBJECT: Accept Completion of Warranty Period and Authorize Release of Cash Deposit for
Faithful Performance, Subdivision 7916, Walnut Creek area.
On September 23, 1997, this Board resolved that the improvements in Subdivision 7916
were completed as provided in the subdivision agreement with Trident Associates and now on the
recommendation of the Public Works Director,
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance, and IT IS BY THE
BOARD ORDERED that the Public Works Director is AUTHORIZED to refund the $1,000 cash
deposit (Auditor's Deposit Permit No. 272856, dated January 29, 1996) plus linterest to Trident
Associates in accordance with Government Code Section 53079,if appropriate, and Ordinance Code
Section 94-4.406 and the subdivision agreement.
NOW THEREFORE BE IS RESOLVED that the warranty period has been completed and
the subdivision agreement and surety bond are exonerated..
