On June 22, 1998, at approximately 6:15 in the morning, Claimant was cited under Penal Code section 148, resisting arrest, in that the arresting officer(s) claimed he was delaying a police officer. Deputies with the Contra Costa County Sheriff's Department entered Claimant's residence at about 5:30 a.m., looking for Claimant's son who was not at home. The Deputies then left and returned about one-half hour later, circa 6:00 a.m., inquiring about a missing girl, an acquaintance of Claimant's son. The Deputies then cited Claimant for obstructing police officers and, subsequently, arrested him for resisting arrest. Claimant had done nothing unlawful. The Deputies made the arrest without a warrant and without justification. The arrest was not lawful. The Deputies had no reasonable cause to believe that Claimant had committed a public offense and had no other legitimate reason or cause to arrest Claimant. b. The District Attorney's Office did not file criminal charges against Claimant. 4, How Claimant has been damaged: The Claimant was subjected to a false arrest and false imprisonment. The injuries sustained by Claimant, as far as the date of the presentation of this Claim, among others, consist of interference with Claimant's freedom and peace of mind. The false arrest caused humiliation, embarrassment, and anguish. Claimant was also compelled to expend funds to pay for an attorney. These acts constitute intentional and negligent infliction of emotional and mental distress and anguish which have and are likely to lead to actual and potential loss of past and future earnings in currentand future employment due to false allegations, harassment, and retaliation. The specifics of this claim are substantiated by eyewitness accounts, still photographs, aerial photographs and videotape which clearly demonstrate the volume, rate of discharge and path of water flawing to the impacted properties via County owned and maintained conveyances. Dear Clerk: This letter is being written to clarify our claim that was submitted on June 2, 1998, for the salvage and diving costs associated with the raising of a vessel at the residence of Chuck Norris at 1260 Discovery Bay Blvd. in Byron. Can June 3, 1997, our business was contacted by the Sheriffs Marine Bureau to respond and a raise a vessel at the above referenced address. This was done under the supervision of Capt. Reno, Sgt. Pitts, and James Gallagher with Contra Costa County Environmental Health Department. At the time the vessel was discharging fuel into the waters of Marina Bay. We sent 3 people, including a certified diver, a boat, and all the necessary equipment to raise the vessel. In the past,we have had great success in collecting for our services from the property owners where the incident occurs. In this case however, numerous letters, and a demand sent certified, return receipt went ignored. We then filed action in smallclaims court against the property owner. Just prior to the court date legal advise indicated that we were a `third party", and that the County was the only entity that could collect costs incurred from hazardous clean up. When it was apparent that we had no standing,we dropped the court claim. At that point we were informed by the Sheriff's Department that the county had funds available for just this kind of situation. an June 1st we were given the claim form to full out. Upon receipt of the form it was noticed that all claims that did not relate to death, personal injury, or property damage had to be presented no later than one year after the cause of action. The services were rendered June 3rd, so we scrambled and hand delivered the claim on June 2nd, within the one year requirement. t In checking with your office, it was noted that there was confusion regarding the claim and the delay in getting an invoice to you. We spent a considerable amount of time pursuing payment from who we believed should have paid for the services we rendered. it is only the property's owner refusal that has led us to turn to the County for payment. It is our hope that the appropriate county agency will continue to pursue this property owner. Mr. Norris knew the boat had a leak, and when he got up to go to work that morning he knew that the boat had sank and was polluting. He went off to work anyway and choose to ignore this fact. The Oil pollution Act of 1990 allows the county to recover these costs and we sincerely hope that you do so.
