SUBJECT: Agreement to Provide Services to the Housing Authority of Centra Costa County

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
lRecommended Action: APPROVE agreement to provide real estate services to the Housing
Authority of Contra Costa County for the transfer of assets from the San Pablo Housing Authority
and AUTHORIZE the Board Chair to sign the agreement on behalf of the County.
11. Financial impact: The Housing Authority will pay the actual costs for Real Property staff real
estate services.

III. Background and Reasons for Recommendations: The Housing Authority
requires a variety of real estate services in the transfer of real estate from the San
Pablo Housing Authority but has no right of way staff and desires to contract with
the County for these services.
IV. Consequences of Negative Action: Less efficient government because the
Housing Authority would have to hire additional private contractors at greater
expense.

AGREEMENT
1. Effective Dae and earties. Effective on August 3, 1998, the COUNTY OF
CONTRA COSTA, a political subdivision of the State of California (hereinafter
referred to as "County"), and the HOUSING AUTHORITY OF CONTRA COSTA
COUNTY, (hereinafter referred to as "Authority"), hereby mutually promise and
agree as follows:
2. Purpose. The Authority is in the process of acquiring all of the assets of the San
Pablo Housing Authority. This project includes transferring title to all of the real
estate owned by the San Pablo Housing Authority. The Authority has no right of
way staff and desires to contract with the County for real property acquisition
services.
3. Services by County. The services to be rendered by County to Authority may
include title review, document preparation, escrow instructionsand general real
estate consultation.
4. Payment for Services.. Authority agrees to reimburse County for all labor costs and
appropriate overhead for County Real Property Agents labor including overtime
rates for evening or weekend work if authorized (See Appendix"A"for pay rates).
Such payments shall be made within 39 days of billing by County.
5. Indemnification. Authority agrees to defend, indemnify and save harmless County,
its officers, and employees against any and all loss, damage, liability, expense,
claims or demands of whatever character, direct or consequential, directly or
indirectly contributed to or caused by County assuming and acting as the right of
way agency for and on behalf of Authority.
6. indep2ndent ;Status. Nothing herein shall be construed to imply that any County
employee'providing services hereunder is an Authority employee.
7. Term. The term of this agreement shall commence on the effective date hereof and
shall endupon termination by either party upon 30 days written notice. The rights
and obligations of Paragraph 5"Indemnification"shall survive any such termination.

I. Recommended Action:
APPROVE and AUTHORIZE the Public Works Director,or his designee,to sign a Statement of Acceptance
of said Grant Agreement accepting Grant funds from the State of California, Department of Transportation
(CALTRANS) for construction work at the Buchanan Field Airport,

The total cost of the project is $1,425,000. Ninety percent (90%) of this cost will be funded by the Federal
Aviation Administration,four and one-half percent(4112%)from a Caltrans Grant, and five and one-half percent
(5Llx%)of the project is the responsibility of Contra Costa County. The County's share will be paid out of the
Airport Enterprise Fund.

III. Reasons for Recommendations and Background:
On November 19, 1996, the Board of Supervisors authorized a Preapplication in the amount of$1,425,000,
for construction projects at Buchanan Field Airport, which includes resurfacing and lighting Taxiway E,
resurfacing the Fixed Based Operators' Apron,and constructing a Fixed Based Operator Taxiway. On April
1, 1997,the Board of Supervisors authorized the Public Worms Director to apply for a Grant of four and one-
half percent (4112%0) of the total project cost ($64,125) from the State of California, Department of
Transportation(CALTRANS). This action accepts said Grant funds.
IV. Consequences of Negative Action:
The Airport would not receive the Grant from CALTRANS and the four and one-half percent(41/2%0)of the
AIP costs would be paid out of the Airport Enterprise Fund.

On April 25, 1995, the Beard of Supervisors authorized a Preapplication in the amount of$250,000 for
construction projects at the Byron Airport, to install an Automated Weather Observation System. On April
22, 1997,the Board of Supervisors authorized the Public Works Director to apply for a Grant of four and one-
half percent (4V2%) of the total project cost ($11,250) from the State of California, Department of
Transportation(CALTRANS). This action accepts said Grant funds.
IV. Consequences of Negative Action:
The Airport would not receive the Grant from CALTRANS and the four and one-half percent(41/2%)of the
AIP costs would be paid out of the Airport Enterprise Fund.
