1. Recommended Action:
APPROVE Contract Change Order No. 4, Revision 1, Supplement 1, in the approximate amount
of$106,000.00 and AUTHORIZE the Public Works Director to execute it in order to compensate
the contractor, Bay Cities Paving & Grading, Inc. for unforeseen increases in contract items.
11. Financial lmpact:
The project contingency funds are sufficient to cover the change order casts. The source of funds
is Measure C (42010), AB434 (38010), Transportation Development Act (9°1o), 300 (5 0) and Road
Funds (6010).

The increase in Contract Change Order No. 4, Revision 1, Supplement 1 is greater than 10'% of
the original contract, thereby requiring Board APPROVAL..
IV. Consequences of Negative Action:
The lack of approval would preclude payment for work that was performed in good faith.

I. Recommended Action:
APPROVE the project contingency fund increase of$3,000.00 to compensate the contractor, W.T. Cook
Construction, Inc. for unforeseen contract item increases.
II, Financial Impact:
The increase in the contingency fund will be funded by Transportation Development Act(3611/o),Community
Development Block Grant(30%) and Road Funds (34%).

The additional money is needed to pay the contractor for authorized additional quantities added to the
original contract.

The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on March 11, 1998, contracted with Tri-County, Inc. for the construction of
traffic signals, lighting, curb ramp and striping, with Reliance Surety Company',as surety, for work to be
performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of September 14, 1998.
Therefore, said work is ACCEPTED as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

The County of Contra Costa on May 13, 1998, contracted with Valley Slurry Seal Company for placing
asphalt rejuvenating agent at various locations, with National Fire Insurance Company of Hartford as
surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of September 2, 1998.
Therefore, said work is ACCEPTED} as completed on said date, and the Clerk shall file with the County
Recorder a copy of this Resolution and Notice as a Notice of Completion for said contract.

Payment of$2,400.00 is funded by South Walnut Creek Area of Benefit.
Ill. Reasons for Recommendations and Background:
James Gillespie and Douglas Webber, a Partnership, were the tenants of the Shell
gas station site at 1600 Tice Valley Boulevard in Walnut Creek. The property was
acquired for the Olympic Boulevard Widening Project. Moving expenses are part
of their relocation entitlement required by Government Code section 7260, et seq.
IV. Consequences of Negative Action:
The County would not be in compliance with State and Federal law.
