SUBJECT: A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF
CONTRA COSTA CERTIFYING REVIEW AND CONSIDERATION OF THE
ENVIRONMENTAL IMPACT REPORT, MAKING FINDINGS REQUIRED BY
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, MAKING FINDINGS
OF CONSISTENCY WITH THE COUNTY GENERAL PLAN, INCLUDING
GROWTH MANAGEMENT ELEMENT, AND STATING OVERRIDING
CONSIDERATIONS IN THE APPROVAL AND ADOPTION OF THE
AMENDMENT TO THE PLEASANT HILL BART STATION AREA SPECIFIC
PLAN AND RELATED GENERAL PLAN AMENDMENT
WHEREAS, the Board of Supervisors of the County of Contra Costa (the "Board") is
considering adoption of a Pleasant all BART General Plan Amendment(County File#GP970014)
and Pleasant Hill BART Station Area Specific Plan Amendment (County File #SP970041)
(collectively, the"Plan Amendments"); and
WHEREAS, an Environmental Impact Report (the "EIR") on the Plan Amendments was
prepared by the County of Contra Costa pursuant to the California Environmental Quality Act(Public
Resources Code Sections 21400 Z=, hereafter"CEQX'), the Guidelines for Implementation of
the CEQA (14 California Code of Regulations, Section 150 g. , hereafter the "State EIR
Guidelines")and the County's Local Guidelines for Implementing CEQA(the"Local Guidelines");
and
WHEREAS, on August 20, 1997, the County forwarded the Draft EIR to the State
Clearinghouse for distribution to those agencies which have jurisdiction by law with respect to the
Plan Amendments, and to other interested persons and agencies, and sought the comments of such
persons and agencies, and
WHEREAS, notice to all interested persons and agencies of the completion of the Draft EIR
was published in the Contra Costa County Times on August 20, 1997; and
WHEREAS, on April 6, 1998,the Contra Costa County Zoning Administrator recommended
to the Board the certification of the Final EIR; and
WHEREAS, the Final EIR consists of the Draft EIR(dated August, 1997), the Final ETR
incorporating comments and written responses thereto(dated March, 1998); and
WHEREAS,by this resolution, the Board, as the lead agency under CEQA for preparing the
EIR and the entity responsible for adopting the Plan Amendments, desires to comply with the
requirements of CEQA the State EIR Guidelines, and the Local Guidelines for consideration,
certification, and use of the EIR by lead agency in connection with the approval and subsequent
implementation of the Plan Amendments.
NOW,THEREFORE,BE IT RESOLVED that the Board hereby finds and certifies that the
EIR has been completed in compliance with CEQA and the State EIR Guidelines; that the EIR
Resolution 98/585
adequately addresses the environmental issues of the Project and the Plan Amendments; and that the
Beard has reviewed and considered the information contained in the Final EIR prior to approving the
Plan Amendments.
BE IT FURTHER.RESOLVED that the Board deletes item#4 on Exhibit B attached to the
October 6, 1998 Board Order and directs staff to explore making the green space program a
demonstration:program under the guidelines of Iron Horse Trail program.
BE IT FURTHER RESOLVED that the Board identifies the significant effects, adopts the
mitigation measures,adapts the monitoring program to be implemented for each mitigation measure,
makes the findings, and declares the statement of overriding considerations set for in detail in the
attached Exhibit which is incorporated in the Resolution by this reference. The statements, findings
and determinations set for in ExUit A are based on the above certified final EIR and other
information available to the Board, and are made in compliance with Sections 15091, 15092, and
15093 of the State EIR Guidelines and Section 21081.6 of CEQA.
BE IT FURTHER RESOLVED that the Board makes the following growth management
findings for adoption of the Plan Amendments:
1. Traffic: The EIR has been prepared for the Plan Amendments. The mitigation measures
contained in the Final EM combined with the Specific Plan, ensures compliance with the
Level of Service Standards for Basic Routes and does not adversely affect the ability to meet
the Traffic Service Objectives for Routes of Regional Significance or to implement the related
actions in the Countywide Comprehensive Transportation Plan.
2. 3y=: The project area lies within the service area of the Contra Costa Water District. The
Contra Costa Water District had indicated in writing the water can be provided for all
proposed development within the area.
3. Sam Sewer: The project area lies within the service area of the Central Contra Costa
Sanitary District and the District has indicated that it will be able to serve all development
within the area.
4. Fire Protection: Four fire stations varying in distance from 1.25 miles to 3.5 miles serve the
Specific Plan area. All development projects greater than one and one-half mile from the fire
station will be required to have automatic fire sprinkler systems.
5. Public Protection: The Contra Costa County Sheriff's Department, BART police and East
Bay Regional Park District share responsibility for police protection in the Specific Plan area.
Defensible space guidelines aimed at increasing the public protection in the area have been
incorporated into the proposed Specific Plan Amendment.
6. Parks and Recreation: The proposed Specific Plan Amendment does not increase residential
population. All residential development is required to pay a$2,000/unit park dedication fee
to mitigate impact on parks and recreation in the area. The Specific Plan also requires a
minimum of 20%useable open space is required for commercial and office projects.
7. Floud_Control and Drainage: All development projects in the area will be required to collect
and convey the drainage to an adequate storm drainage system.
