Confirm Oakley/Knightsen Firefighters' Association as the majority representative for
the Oakley Reserve Firefighters Unit

REASONS FOR RECOMMENDATIONIBACKGROUND
On April 14, 1998, the Board acknowledged receipt of a petition filed by the
Oakley/Knightsen Firefighters' Association for formal recognition of reserve firefighters
in the Contra Costa County Fire Protection District who are members of the
Oakley/Knightsen Firefighters' Association. Pursuant. to Section 34-12.008, Unit
Determination, of the County's Employer-Employee Relations Resolution 81/1165 the
parties met and conferred and obtained agreement on the appropriate composition of
the bargaining unit to include the classifications of Oakley Reserve Firefighter, Oakley
Reserve Senior Firefighter, Oakley Reserve Captain, Oakley Reserve Firefighter-EMT,
Oakley Reserve Senior Firefighter-EMT, and Oakley Reserve Captain-EMT reporting to
the Oakley Reserve Division. In accordance with Section 34-12.014, Optional
Verification Procedure, the Labor Relations Manager ascertained that the
Oakley/Knightsen Firefighters' Association was selected as the majority representative
of employees in the Oakley Reserve Firefighters Unit by verification of payroll dues
deduction cards which substantiated proof of employee approval of at least fifty-one
percent of the employees in the unit.

In its capacity as the governing body of the Contra Costa County In-Home
Supportive Services Authority, the Board of Supervisors resolves:
The Contra Costa County Employee Relations Officer having met and consulted
with representatives of interested employee organizations as provided in Government
Code section 3507, the following modifications to the Contra Costa County Employer-
Employee Relations Resolution (Board of Supervisors's Resolution No. 8111165) are
adopted, effective only as to the Contra Costa County In-Home Supportive Services
Authority:
1. Section 34-4.038 is amended to read as follows:
34-4.038 Proof of employee approval.
"Proof of employee approval" means evidence of employee approval to represent
employees, to establish a representation unit, or to become a majority representative;
which may be by:
(1) Filing a predetermined petition form with signatures executed and dated
within six months before filing,
(2) Filing employee organization authorization cards, with signatures executed
and dated within six months before filing; or
(3) Payroll dues deduction evidence, certified by the State of California, using the
monthly payroll immediately prier to the date the request or petition is filed.
2. Section 34-12.012, subsection (d), is amended to read as follows:
(d) A majority representative will be selected by a majority of the valid ballots
cast, provided that at least twenty-five percent plus one of the eligible employees vote in
favor of such majority representative.
