(RC 9824) IT IS BY THE BOARD ORDERED that permission is granted to Daniel Hamlin—Actus Chiropractic to partially close Chestnut Street, except for emergency traffic, on Saturday, October 24, 1998, from 7:OOAM to 10:30AM, subject to the following conditions: 1. Traffic will be detoured via adjacent lane. 2. All signing to be in accordance with the State of California Manual of Traffic Controls. 3. RECOMMENDED ACTION: 1. DETERMINE that there is a need to continue the emergency action taken by the Board of Supervisors on September 15, 1998, pursuant to Public Contract Code Sections 22035 and 22050, to repair the Stone Valley Road Shoulder in the Alamo area. 2. DELEGATE to the Public Works Director the authority to proceed in the most expeditious manner to repair the erosion to the shoulder and place a pipe within the creek to prevent future erosion and closure of a portion of Stone Valley Road in the Alamo area. FINANCIAL IMPACT: There is no impact to the general fund. Total cost of the project is estimated at$94,000. The project will be constructed with road funds. 111. REASONS FOR RECOMMENDATIONS AND BACKGROUND: During winter storms, approximately 150 feet of the shoulder along Stone Valley Road was eroded by high flows in the adjacent creek. The project consists of placing this section of the creek in a pipe culvert and mitigating the impacts of the project on the creek. If we were to follow our normal construction contract advertisement and approval process, the slide repair could not begin until mid-October. Pursuant to provisions of Sections 22035 and 22050 of the Public Contract Code, when the appropriate findings of an emergency are made by the Board of Supervisors, the normal bidding procedures are waived and repairs can begin immediately. We are, therefore, recommending that the Board make such findings and direct the Public Works Director to proceed with the project and enter into any necessary contracts. IV. Consequences of Negative Action: Non-concurrence of the above recommendation will significantly delay repair of the shoulder prolonging impacts to traffic flow, and potentially endangering this roadway from further erosion and slippage.
