SUBJECT: Hearing to consider extension of interim ordinance for
Park Dedication requirements for County Service Area R-7A
This being the time set for hearing to consider extension
of interim ordinance for Park Dedication requirements for County
Service Area R-7A; and
The Chairman opened the public hearing and no one appeared
in opposition. The Chairman closed the hearing.
The Board considered the matter.
IT IS BY THE BOARD ORDERED that reading is waived and
Ordinance No. 86-50 is ADOPTED extending the Urgency Interim
Increase in Park Dedication Requirements for County Service Area
R-7A and Surrounding Territory.

ORDINANCE NO. 86_50
(Extension of Urgency Interim Increase in Park
Dedication Requirements for County Service Area R-7A
and Surrounding territory)
The Contra Costa County Board of Supervisors ordains as follows:
SECTION I . Ordinance Area. This ordinance applies to the
territory in the unincorporated area of this County within Federal
Census Tracts Nos . 3420 , 3440 , 3452 . 01, 3461. 01, 3461. 02, 3462. 01
and 3462. 02 , based on the 1980 federal census , hereinafter
referred to as the "ordinance area. " A map showing the
approximate location of the ordinance area, entitled "Map of
Ordinance Area, Ordinance No. 86-38" is filed in the Office of the
Clerk of the Board of Supervisors .
SECTION II . Urgency Declaration. This ordinance is an urgency
measure as an interim authorization for an increased fee or charge
to protect the public health, welfare and safety, authorized by
Government Code §65962 . There is an urgent need for an increase
in the amount of fees which may be paid in lieu of land dedication
requirements for park and recreational facilities in the ordinance
area. The fees currently required do not reflect current land
values in the ordinance area. Development of a significant amount
of land in the ordinance area is imminent. Therefore, unless the
fees are increased immediately, the cost of establishing park and
recreational facilities called for by the general plan' s
recreational element in the ordinance area will far exceed the
fees collected. Failure to collect sufficient fees will hinder
and forestall , and may prevent, the establishment of those park
and recreational facilities . Having adequate park and
recreational facilities is in the best interest of the public ' s
health, safety and welfare, as such facilities provide a place
where all people may enjoy wholesome outdoor activities , and
children may play free from traffic and other hazards. Therefore,
inability to establish park and recreational facilities , as the
need for them arises, is detrimental to the public health, safety
and welfare.
On May 20, 1986, the Board of Supervisors adopted Ordinance
No. 86-38, increasing park dedication requirements within the
ordinance area. Ordinance No. 86-38, due to expire on June 19,
1986, unless extended, is hereby extended.
SECTION III . Dedication. Notwithstanding Ordinance Code §920-
6.002 , within the ordinance area, the total area required to be
dedicated shall be computed by multiplying the number of dwelling
units to be included in the development by four hundred square
feet. The "dwelling unit, " as used herein, has the same meaning
given in Ordinance Code §920-6. 002.
SECTION IV. Amount of Fee. Notwithstanding the provisions of
Ordinance Code §920-6.004 , when fees are to be paid in lieu of
land dedication in the ordinance area, such fees shall be
$1,100. 00 per dwelling unit.
SECTION V. Effective and Expiration Dates. This ordinance
becomes effective immediately upon passage and shall be operative
for thirty ( 30) days (through July 17 , 1986 ) , pursuant to

Government Code §65962. Within 15 days of passage, this ordinance
shall be published once with the names of supervisors voting for
and against it in the Valley Pioneer, a newspaper published in
this County.
