SUBJECT: CREATION OF 'FINANCIAL "RESPONSIBILITY TRUST FUND

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Authorize the Auditor-Controller to establish a Financial Responsibility Trust Fund for
the deposit of monies collected by the Municipal Courts for administering Sections 16028,
16030. and 16031 of the Vehicle Code.
FINANCIAL IMPACT:
The law requires that these funds be deposited in a special account. This action will
preserve the funds for future use.
REASONS FOR RECOMMENDATION/BACKGROUND:
On July 1, 1985, Section 16028a of the California Vehicle Code took effect providing that
motorists failing to demonstrate proof of automobile insurance to a police officer or
judge would be fined and given 60 days to arrange for auto insurance. In orderto fund
this new mandate, Section 1463.22 of the Penal Code was simultaneously enacted. It
provides that certain court revenues "shall be deposited by the county treasurer in a
special account and allocated to defray costs of municipal and justice courts incurred in
administering Sections 16028, 16030, and 16031 of the Vehicle Code". On December 5, 1985,
enforcement of the Financial Responsibility Law was temporarily suspended by the State
Supreme Court until a ruling on the constitutionality of the statute is issued.
The Municipal Courts incurred expenses before, during, and after the Financial
Responsibility Law was in effect. The amount of these costs is being deposited into the
appropriate accounts of the four Municipal Courts and Law and Justice Systems Development.
All administrative fee revenues in excess of these expenditures will be deposited in the
newly-created Financial Responsibility Trust Fund. This special fund will remain in
effect until the California Supreme Court rules on the constitutionality of the Financial
Responsibility Law, i.e. , Section 16028a of the California Vehicle Code.
