Consultant Contract for the Preparation of the Environmental Impact Report
for the Proposed Dow Chemical Company Hazardous Waste Incinerator
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION

I . RECOMMENDED ACTION
Approve and authorize the Director of Community Development Department to
execute a contract with the firm of CH2M Hill , Inc. for the preparation of the
Environmental Impact Report for the proposed Dow Chemical Company Hazardous
Waste Incinerator and authorize the Director discretionary action to modify
payment within a 10% range of original contract amount if required by necessary
changes to scope of work.
II . FINANCIAL IMPACT
The cost of the EIR is totally borne by the project sponsor, Dow Chemical
Company. The cost of the consultant contract is $109,500.
III. REASONS FOR RECOMMENDATION
The Dow Chemical Company proposes to install a hazardous waste incinerator on its
Pittsburg plant site (located in the unincorporated area) to supersede the
disposal of certain of the Company's wastes in evaporation ponds and transport
out-of-state. The proposal is intended to comply with new State and Federal
disposal requirements. I An Environmental Impact Report is required before the
lead agency, the State! Department of Health Services, can act on the proposal .
The State Department of Health Services and the County have agreed that the
County Community Development Department will manage the preparation of the
Environmental Impact Report.
IV. BACKGROUND
The County has no entitlements for the proposed project but has experience in
administering the California Environmental Quality Act. The State Department of
Health Services has primary responsibility for "permitting" the project but
prefers that the Environmental Impact Report be developed at the local level and
address environmental issues beyond their own specialized concerns.
Consequently, the understanding was reached for the County to manage the
preparation of the project's Environmental Impact Report. This arrangement was
presented to the Board of Supervisors in a memorandum from the Community
Development Director dated March 3, 1986, and acknowl ged by the Board on
March 11, 1986.

V. CONSEQUENCES OF NEGATIVE ACTION
I
Without the County's agreement to execute this contract, the State Department of
Health Services would manage the preparation of the Environmental Impact Report.
The consequences would be a loss of participation and review at the local level
and the imposition of delays and additional expenses for the Dow Chemical
Company.
