The Board of Supervisors RECOGNIZED outgoing members of the Head Start Policy
Council and welcomed new members, and REFERRED the proposed Head Start Dispute
Resolution Policy to County Counsel for review.

Resolution of Disputes Between the Board of Directors and the Policy Council
1. Background
The Performance Standards require that local Head Start grantees establish a policy
and necessary implementation procedures for the resolution of internal disputes
between the Board of Directors and the Policy Council.
2. Deference
Head Start Performance Standards, (d) 1304.50 (h)
3. Policy
It is the policy of Contra Costa County Head Start to resolve any disagreements
between the Board of supervisors and the Policy Council fairly and expeditiously.
Whenever possible, disagreements will be resolved through processes of mediation
and conciliation, including discussion, compromise, and consensus-seeking between
parties, and, if necessary, professional mediation.
If the parties are unable to resolve a disagreement through informal processes or
mediation, the disagreement shall be resolved though binding arbitration.
4. Administrative Procedure
A) Informal Resolution
The Chairpersons of the Board of Supervisors and the Policy Council will monitor
actions and decisions of each body as they relate to their respective responsibilities.
In the event that a conflict or potential conflict exists, they will initiate informal
discussions between representatives of the two bodies and seek a mutually
acceptable resolution.
b) Mediation
If informal resolution is not effective, the chairpersons will request that the
Community Services Director identify qualified individuals who provide professional
mediation services. The chairpersons will confer and mutually designate a
professional mediator who will be retained to mediate the disagreement. The
mediator will use conciliation, compromise and consensus seeking between the
bodies. The mediation process shall be non-binding.
c) Binding Arbitration
If mediation is not effective, the chairpersons will notify the Community Services
Director who will appoint an arbitrator. The arbitrator will be selected from the
professional arbitrators available and offering their services in the area.
The arbitrator will conduct hearings and investigations as necessary to ascertain the
facts, laws, policies and the impact of the disagreements on program participants.
He or she begins work as quickly as possible but no later than one week after
his/her appointment. The arbitrator will notify all concerned parties, by certified
mail, of the dates and times of arbitration hearings and the process to be observed
in the hearings.
The finding of the arbitrator shall be binding on both parties.
