FISCAL IMPACT: 4, 000.00, if the County does the abatement. The County presently holds a $3, 100.00 bond and will use the bond to defray abatement costs. SACKGRt9MMZR ASONS MR RECOMMEMMIM: On March 27,1998, a complaint was received regarding a moved home that had not been completed per the building code. Two building permits were issued and both permits have expired for lack of activity. The first permit expired on March 21, 1997 and the second expired on March 27, 1998. The structure is presently incomplete and vacant. Per Contra Costa County Ord. 714-4.602 (house moving) , if the structure is not completed within (90) ninety days, the performance bond posted shall be used to abate the structure. The following violations of the County Ordinance exist: Title 7, Chapter 712-2 .004 (substandard building) Chapter 74-3.101 (permits required for construction) Chapter 714-6. 004 (nuisance abatement) The owner of the property has been notified through written correspondence and certified mail. As of this date compliance has not been gained. On September 22, 1998, the Building Inspection declared the property a public nuisance and posted a Notice and Order to Abate under Title 1, Chapter 14-6. This appeal is being made under the provisions of this title. The reasons for the appeal are numerous,including; I) The house in question has been lestatly moved and is on a legal lot with its own address(147 MacMurtty Dr.). 2) The foundation is in place,and was constructed according to a legal building,permit with proper inspections. 3) The mover will be dropping the house onto the foundation within 3 weeks of the date of this letter. 4) The house is unoccupied and not used for any purpose. It is on a flag lot and not visible from the street How can it be a public nuisance?Nuisance to who? 5) The building permit has expired,and I have been lax in finishing.But if Mr.Hogan had a problem with that,why haven't I heard from him in 2 years? I received a letter from Mr.Hogan maybe 3 years ago.I immediately called him and left a message on his answering machine,but he didn't call me back.Then a few months later,I happened to come home from work in the middle of the day,and Mr.Hogan was there,looking around.He was rude,threatening,and imtinudating..His attitude was completely uncalled for,considering that I did call him after receiving the letter,and had asked him for a meeting if he wished,but he ignored my call(I wander if he ignored it on purpose since it wasn't in writing?).Last summer,there were 2 people here from the city,but I don't remember what we talked about or who they were. I certainly didn't receive a letter from these 2 people, before or after I met them. So this is the extent of my contacts with Mr.Hogan or his people, I letter and 2 accidental meetings.For this you're going to tear my house down?Isn't this a little extreme? I estimate the value of the house and foundation at$50,000. If the county is crazy or stupid enough to destroy my legal property,not only will I not pay for the cost of abatement;I will expect a check from the county for$50,000 to cover the value of my property.My attorney has been contacted,and is waiting to see YAW develops.
