Reasons for Recommendations and Background: The purpose of the County's Computer Mapping/Geographic Information System is to provide land related data in a geographic format for local government. Membership in the system is means for other non-County local agencies to share the data and to bear a proportionate share of the costs. Funding for the period from July 1, 1999 through December 31, 1999 will be will be included in the Department's proposed FY 1999-00 Budget. 111. CHILDREN'S IMPACT STATEMENT: The Community Services Department Head Start Program supports two of Contra Costa County's community outcomes: "Children Ready for and Succeeding in School" and "Families that are Safe, Stable and Nurturing." These outcomes are achieved by offering comprehensive services, including high quality early childhood education, nutrition, health, and social services, along with a strong parent involvement focus, to low-income children throughout Contra Costa County. The overall goal of the program is to bring about a greater degree of social compet7e7hchhooll children from low-income families. REASONS FOR RECOMMENDATIONS/BACKGROUND: On September 15, 1998 the Board approved and authorized submission the 1999 Head Start Grant Application to the U.S. Department of Health and Human Services, Administration for Children and Families (ACF) to continue Head Start program services to approximately 1,587 children and their families for the period from January 1, 1999 through December 31, 1999. On January 6, 1998 the Board approved contracts with the above-listed agencies to continue Head Start services in West and East Contra Costa County for the period from January 1, 1998 through December 31, 1998. This action is submitted in order to contract with the Delegate Agencies to continue, without interruption, Head Start program services to children and families during the 1999 calendar year. DATE: December 1, 1998 " SUBJECT: Contract with Skamser&Associates Owl% u n ty for Consultation'and Technical Assistance on the Americans with Disabilities Act (ADA) SPECIFIC REQUEST{S}OR RECOMMENDATION(S)&BAC€KGROUUNND AND JUSTIFICATION �••••`r•••��••�•••�•_••••••�••• RECOMMENDATION: APPROVE and AUTHORIZE the Risk Manager to execute a contract with Skamser and Associates to provide consultation and technical assistance with regard to the Americans with Disabilities Act(ADA) in an amount not to exceed $60,000. FINANCIAL IMPACT: Costs for consultation and technical assistance are funded through the Workers' Compensation Self-insurance Trust Fund. BACKGROUND/REASONS FOR RECOMMENDATION: The Americans with Disabilities Act provides protection against discrimination to disabled individuals. The Act prohibits discrimination on the basis of disability in employment, public services and public accommodations. Tonda—335-1450 cc: CAO Risk Management Auditor-Controller Skamser&Associates BY DEPUTY To ensure continuing compliance with the employment provision of ADA and to promote better coordination of the ADA Program with the Workers' Compensation Vocational Rehabilitation Program, responsibility for the ADA Program in regard's to employment issues has been transferred from the Affirmative Action Office to Risk Management. In order to protect employees' rights and avoid costly litigation, Risk Management seeps to provide expertise for the County's ADA Program and coordinate departmental efforts through contracting with an outside consultant. The County advertised, recruited and interviewed agencies and individuals with expertise in ADA. After an extensive interviewing process that examined 10 candidates, it is recommended the County enter into a contract with Skamser and Associates to administer the County's ADA Program and oversee essential job function documentation throughout County departments. This firm has extensive experience in providing consultative services in the area of ADA and was determined to be the most qualified. The contract requires that over a six-month period the following will be achieved: • Meet with department heads to stress the timeframes and goals of the ADA Program. • Review current policies, procedures, documentation systems, forms, and existing systems on ADA related matters, and recommend modifications as appropriate. • Meet with department managers and department ADA coordinators on existing procedures and to identify current needs. • Train personnel designated by department heads on: ✓ bleed for essential job functions for job classes and positions; ✓ How to develop, coordinate, and implement procedures on how to analyze and establish the essential functions in job classifications and positions; ✓ How to identify the essential functions in job analysis; ✓ How to complete essential job functions description forms. Priority will be given to job classes with larger number of incumbents and high potential for permanent disabling injury. • Train responsible department personnel on ADA related topics, including identification and assessment of ADA and related legal issues, means of resolution and documentation requirements. • Staff, coordinate and provide appropriate services to responsible department personnel on new and existing ADA related personnel issues. • Provide updates on Federal and State law and other issues that deal with the rights of qualified, disabled employees. • Work with responsible department personnel to meet special training needs, and assist in developing procedures and resource materials to allow them to deal effectively with ADA and other related legal issues. This contract commences January 1, 1999 for a six-month period, at an hourly rate of $60. During that time, the consultative services will be monitored and evaluated. -2-
