BACKGROUND: In December of 1995, the Board of Supervisors approved a contract with Heim, Noack, Kelly & Spahnn which included a small cost-of-living increase each year. The monthly payment for calendar year 1998 is $7,245.50. The contractor is not requesting an increase in the level of payment for the next three years. It is, therefore, recommended that the Board of Supervisors approve this contract. Term. The effective date of this Contract is terminates December 31, 2001 unless sooner terminated as provided herein. 4. Termination. This Contract may be terminated by the County, at its sole discretion, upon five--day advance written notice thereof to the Contractor, or cancelled immediately by written mutual consent. 5. Payment Limit. County's total payments to Contractor under this Contract shall not exceed $ 270.$3,8 • 6. County's Obligations. In consideration of Contractor's provision of services as described below, and subject to the payment limit expressed herein, County shall pay Contractor, upon Contractor's submission of a properly documented demand for payment (County Demand Form D-15) which shall be submitted not later than 45 days from the end of the month in which the contract services were rendered, and upon approval of such demand by the head of the County Department for which this Contract is made or his designee, as follows: [Check one alternative only] ( ) hour; or [ ] a. Contractor shall provide the following described services: See attached workplan for the 1999 calendar year. Another workplan may be substituted for the 2000 and 2001 calendar years by mutual consent. 8. Compliance wits. Contractor shall be subject to and comply with all Federal, State and local laws and regulations applicable with respect to its performance under this Contract, including but not limited to, licensing, employment and purchasing practices; and wages, hours and conditions of employment, including nondiscrimination. 9. NondiscrininatorX Services. Contractor agrees that all goods and services under this Contract shat.. be available to all qualified persons regardless of age, sex, race, reli- gion, color, national origin, or ethnic background, or handicap, and that none shall be used, in whole or in part, for religious worship or 'instruction. Number 10. Independent Contractor Status. This Contract is by and between two independent contractors and ra not intended to and shall not be construed to create the relationship between the parties of agent, servant, employee, partnership, joint venture, or association. 11. Disputes. Disagreements between the County and Contractor concerning the meaning, requirements, or performance of this Contract shall be subject to final determination in writing by the head of the County Department for which this Contract is made or his designee or in accordance with the applicable procedures (if any) required by the State or Federal Government. 12. Access to Books and Records of Contractor Subcontractor. Pursuant to Section 1861(v)(1) of the Social Security Act, and any regulations promulgated thereunder, Contractor shall, upon written request and until the expiration of four years after the furnishing of services pursuant to this Contract, make available to the Secretary of Health and Human Services, the Comptroller General, the County, or any of their duly authorized representatives, this' Contract and books, documents, and records of Contractor that are necessary to certify the nature and extent of all costs and charges hereunder. Further, if Contractor carries out any of the duties of this Contract through a sub- contract with a value or cost of $10,000 or more over a twelve-month period, such sub- contract shall contain a clause to the effect that upon written request and until the expiration of four years after the furnishing of services pursuant to such subcontract, the subcontractor shall make available, to the Secretary, the Comptroller General, the County, or any of their duly authorized representatives, the subcontract and books, docu- ments, and records of the subcontractor that are necessary to verify the-nature and extent of all costs and charges hereunder. This special condition is in addition to any and all other terms regarding the maintenance or retention of records under this Contract and is binding on the heirs, successors, assigns and representatives of Contractor. 13. Reporting Requirements. Pursuant to Government Code 57550, Contractor shall include in all documents or written reports completed and submitted to County in accordance with this Contract, a separate section listing the numbers and dollar amounts of all contracts and subcontracts relating to the preparation of each such document or written report. This section shall apply only if the payment limit under this Contract exceeds $5,000. 14. Indemnification. The Contractor shall defend, indemnify, save, and hold harmless the County and its officers and employees from any and all claims, costs and liability for any damages , sickness , death, or injury to person(s) or property, including without limitation all consequential damages, from any cause whatsoever arising directly or indirectly from or connected with the operations or services of the Contractor or its agents, serveuts, employees or subcontractors hereunder, save and except claims or litigation arising through the sole negligence or sole willful misconduct of the County or its officers or employees. Contractor will reimburse the County for any expenditures, including reason- able attorneys fees, the County may make by reason of the matters that are the subject of this indemnification, and if requested by -the County will defend any claims or litigation to which this indemnification provision applies at the sole cost and expense of the Contractor. 15. Contra October 28, 1998 w Costa DATE: County SUBJECT: Approval of Contract Amendment/Extension Agreement #C-46305 between the District Attorney,Family Support Division and Eastridge InfoTech SPECIFIC REQUEST(S)OR RECOMMENDATIONS&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1. Approve and authorize the Purchasing Services officer to execute on behalf of the County District Attorney,Family Support Division,Contract Amendment Agreement#C-46305 with Eastridge InfoTech in the amount of$65,236 for a new total contract payment limit of$118,261 and to extend the term of the agreement through June 30, 1999. FINANCIAL IMPACT: NONE. There is no net County cost associated with the approval of this request. The total cost is covered by 66%Federal Funding and 34% SEIF(Support Enforcement Incentive Funding). } REASONS FOR RECOMMENDATIONSIBACKGRC1tIND: In April, 1998,the County Administrator approved and the Purchasing Services Officer executed Contract#C- 46305 with Ea3stridge InfaTech for the period April 27, 1998 through June 30, 1998,to provide a qualified temporary Network Analyst to perform Network Analyst services for the District Attorney,Family Support Division. The contract was amended effective July 1, 1998 and extended through..October 30, 1998. Approval of this requested Amendment to Contract#C-46305 will allow the Contractor to continue to provide services through June 30, 1999. Contra Costa's Department of information Technology supports and recommends this action as the appropriate way to proceed to obtain,qualified,Network Analyst support. Ay ,DEPUTY CONSEQUENCES OF NEGATIVE ACTION: Failure to approve this request would result in the District Attorney,Family Support Division,being unable to effectively deal with the post conversion LAN activities and to install specific applications for the Access Data Base and the Comp Data System . We would be unable accesss the Family Support applications effectively and efficiently which could cause a delay in the collection and distribution of child support and providing service to families and children. CHILDREN'S IMPACT STATEMENT: The Child Support Program supports one of Contra Costa County's community outcomes: "Families that are Economically Self Sufficient",by improving efficiency and accuracy in the collection and distribution of child support payments to families and children. No County general funds are involved. REASONS FOR RECOMMENDATION/BACKGROUND: The Dispute Resolution Program Act of 1988 (Business a6 Professional Code Sections 465, et seq.) provides for the establishment and funding, at County option, of local dispute resolution services as an alternative to formal court proceedings. The Act authorized participating counties to increase Superior, Municipal and justice Courts filing fees from one to three dollars for the purpose of funding the local dispute resolut'i'on programs. RECOMMENDATION 1. APPROVE: the Third Amendment of the Consulting Services Agreement with Stephen E. Harriman, AIA & Associates,and AUTHORIZE the County Administrator or his designee to execute the Amendment. 2. AUTHORIZE: the County Administrator or his designee to issue written authorizations for extra work, provided that the cumulative total extra cost for all such authorizations shall not exceed$10,000.00. 11. FINANCIAL IMPACT This Amendment increases the Architect's reimbursable cost allowance by $3,000.00. Adequate funds for this Amendment have been established in the General Funds Plant Acquisition Account(Budget Unit 44134399). III. BACKGROUND This project expands the Juvenile Hall as a result of a Federal Violent Offender/Truth-in-Sentencing Grant award from the California Board of Corrections. Construction is ready to start. The Architect, Stephen E Harriman, AIA & Associates, has designed this addition and is designing repairs to the Juvenile Hall's nearby Pride House for use as a transition facility for sentenced youth. This Amendment funds reimbursable expenses for both projects such as CAD drawing plots,printing,and delivery.
