SUBJECT: Report on Transportation Legislation Program for 1999 and contract for Legislative
Representation on Transportation and Related Matters (Project#6875-6P4149)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)B BACKGROUND AND JUSTIFICATION
1. Recomme dad Action:
1. APPROVE the Transportation Legislation Program for 1999 (see Appendix "C" of Exhibit A).
2. REAF91RM the Board's referral to the Transportation Committee of all transportation related
legislative matters for review and recommendation.
S. AUTHORIZE the Director of Public Works to execute a consulting services agreement for
transportation related legislation representation with Smith & Kempton for the 1998 calendar
year (see Exhibit A).
11. Financial JM12act:
No impact to general fund, 100% funded by road funds.
III. Reasons for Recommondations and Badaround:
A two-year state legislative cycle will begin in 1889 with a new rtovernor and significant turnover
among state legislators. It is expected that new legislation wii be introduced in the upcoming
legislative session that will reflect the policy vision of a new Governor. In order for the Board of
Supervisors to respond to proposed legislation in a timely manner, it is'recommended that Board
continue its policy ofreferring all transportation related legislative matters to the Transportation
Committee.
For a number of years, Contra Costa County has contracted with Smith &. Kempton to provide the
County with legislative representation in.Sacramento on transportation and related matters. Smith
& Kempton also provide similar services to the Contra Costa Transportation Authority (OCTA).

Reasons for Re-commendations and Background (continued)
The Board's Transportation Committee met on 12/7/98 with Smith & Kempton to review the
proposed Transportation Legislation Program for 1999 and the contract for Legislative
Representation. In response to a question posed by Supervisor Gerber (sent via a facsimile due
to illness) concerning potential duplication of work with the CCTA, Smith & Kempton explained
that their representation on behalf of the County over the past several years has dealt with a
broader range of legislation that covers transportation, public works, and planning/development
issues rather than the more specific issues of funding and projectdevelopment for
transportation that have concerned the CCTA. Additionally, Smith & Kempton described how
their advocacy on behalf of the County complements CCTA's issues, and vice versa.
The Public Works Director, Community Development Director, and the Board's Transportation
Committee have negotiated a new scope of work for calendar year 1999 and it is
recommended by the Transportation Committee that the Board authorize the Public Works
Director to execute a consulting services agreement with Smith & Kempton (see Exhibit A).
