Specific Request(s) or Recommendation(s) $ Background & Justification
1. RECOMMENDED ACTION:
APPROVE Project, and
FIND, on the basis of the initial study and all comments received, that there is no substantial
evidence that the project will have a significant effect on the environment,
ADOPT the Mitigated Negative Declaration and Mitigation Monitoring Program in compliance
with the California Environmental Quality Act, (the custodian of which is the Community
Development Director who is located at 651 Pine Street, and
DIRECT the Public Warks Director to begin right of way acquisition and to prepare contract
plans and specifications for construction.
DIRECT the Director of Community Development to file a Notice of Determination and a
Certificate of Fee Exemption: De Minimis Impact Finding with the County Cleric.
DIRECT the Community Development Director to arrange for payment of the $25.00 handling
fee to the County Clerk.
11. FINANCIAL IMPACT:
No general funds are involved. The estimated project cost is approximately $ 3 million. The
project is to be funded by the RedevelopmentAgency.

III. REASONS FOR RECOMMENDATIONIBACKC3R UND:
The proposed construction would extend Carol Lane its existing terminus west of State Route
4 westward to Live Oak Avenue. The project also includes creating an east west cul-de-sac
extending east from Live Oak Avenue approximately one block south of Carol Lane. The
proposed project includes approximately 820 m (2,690 ft.) of full width pavement construction,
curb and gutter, underground drainage, sewer and water facilities, street lights, striping and
traffic signs. These improvements are necessary to encourage economic development to the
Oakley Light-Industrial area. The Oakley Municipal Advisory Council, a proponent of the
project, recommendedfunding for the project.
On November 2, 1998, the East County Planning Commission determined the proposed
project to be in compliance with the General Pian. A Mitigated Negative Declaration of
environmental significance pertaining to this project was published. The Board has
considered the Mitigated Negative Declaration together with all comments and responses to
comments (see attached) received during the public review period.
Four comment letters were received from neighbors living in the Heather Parc Subdivision,''
south of the proposed project. The primary concern of the neighbors was the increase in
noise resulting from the Carol Lane extension. The acoustical analysis prepared for the
project recommended mitigation measures which would reduce the noise impacts to an
insignificant level. These mitigation measures have been incorporated'into the proposed
project are included in the attached Mitigation Monitoring Program.
This item was originally scheduled for the December 1, 1998, Board of Supervisors meeting.
It was pulled from the agenda to allow time for staff to meet with the owner of property on the
south side of the existing Carol Lane subject to acquisition. Staff met with the property owner
and subsequently agreed to a minor revision of the alignment that would not impact the
property (see attached site plan dated 1213/98). It was determined that the project description
prepared for the CEQA document was adequate for the revised road alignment. In addition,
none of the cicumstances identified in the CEQA Guidelines Section 15073.5, requiring
recirculation of the Notice of Intent to adopt a Negative Declaration, exist, Therefore, the
CEQA document prepared for the proposed project is adequate.
This project has been found to be de minimis in its effect on the environment and is exempt
from the $1,250.00 Fish and Game filing fee.
IV. CONSEQUENCES OF NEGATIVEACTION.,
If the project is not approved, the improvements cannot be constructed.
