RECOMMENDATIONS:
1. ACCEPT this status report on the plans to transition the Child Care Task
Force to a Local Child Care and Development Planning Council (Local
Planning Council), as is required by AB 1542 (Chapter 270, Statutes of 1997)
- the welfare reform legislation.
2. AUTHORIZE the Family and Human Services Committee to meet with the
Superintendent of Schools to agree on the size of the Local Planning Council
and to develop recommendations for appointments to the Local Planning
Council (in the case of the Board of Supervisors' appointments) and to effect
the appointments (in the case of the Superintendent of Schools'
appointments).
3. In preparation for the meeting of the Family and Human Services Committee
with the Superintendent of Schools, DIRECT the Social Service Director or
Community Services Director to ensure compliance with Education Code
Section 8499.3 (b) (1), which requires the publicizing of the meeting, the intent
to make appointments and which solicits nominations which the Committee
and Superintendent of Schools can review at that meeting.
4. DIRECT the Family and Human Services Committee to report back to the
Board with recommendations for the size and term of office of the Local
Planning Council and for a process and timetable for making nominations for
the Board's appointments to the Local Planning Council by not later than
December 16, 1997.

BACKGROUND:
On July 22, 1997, the Board of Supervisors approved a report from our Committee
which included the following recommendation:
2. AGREE in principle to reconstitute the Child Care Planning Council(Child Care
Task Force)to comply with whatever changes may be required by changes in
State law this year. In connection with this recommendation, DIRECT the
Social Service Director and Community Service Director to advise the Family
and Human Services Committee what changes are required in order to comply
with the law so appropriate recommendations can be made to the Board of
Supervisors.
On October 27, 1997, our Committee met with the Social Service Director, the
Community Services Director and members of the Child Care Task Force. Mr.
Tandy reviewed the attached report with our Committee. We note that the
composition of the new Local Planning Council requires that the membership consist
of the following:
20% consumers
20% child care providers
20% public agency representatives
20% community representatives who are not child care providers or
agencies that contract with the State to provide child care and
development services.
20% at the discretion of the appointing agencies
One-half of the members must be appointed by the Superintendent of Schools and
one-half by the Board of Supervisors. The Superintendent of Schools and Board of
Supervisors must agree on the size of the Local Planning Council and on the term
of office for members of the Local Planning Council. Staff is suggesting that the
Local Planning Council should probably consist of either 20 or 25 members, with
either four or five in each of the five categories. In case of an odd number of
members, both the Board of Supervisors and the Superintendent of Schools must
agree on the appointment to the odd seat.
Every effort must be made to ensure that the ethnic, racial, and geographic
composition of the local planning council is reflective of the ethnic, racial, and
geographic distribution of the population of the County.
Before making appointments, the Superintendent of Schools and the Board of
Supervisors must publicize their intention to select the members and must invite
local organizations to submit nominations.
In order to ensure the ethnic, racial, and geographic balance, it is our Committee's
feeling that the County and the Superintendent of Schools need to meet with each
other and work out their appointments together so that any imbalances in ethnicity,
racial or geographic distribution can be resolved before the appointments are made.
We are recommending that this be done through the Family and Human Services
Committee and that we return to the Board in December with recommendations for
the size, term of office and process for making appointments to the Local Planning
Council.

SUBJECT: Report on AB 1542 Requirements for a Local Planning
Council
California's welfare reform legislation, AB 1542 , requires among
other matters that the "Local Planning Council" for child care
perform specific duties. As you know many of these duties have
been performed by the current Child Care Task Force. However, the
legislation now requires that the composition and functions of
Local Planning Councils be enhanced and application of local
priorities is no longer limited to the former Federal Child Care
Development Block Grant dollars.
In addition, the County Board of Supervisors and the County
Superintendent of Schools are required to appoint members as soon
as January 1, 1998. Generally, a Local Planning Council is charged
with recommending local priorities (subject to approval by the
County Board of Supervisors and County Superintendent of Schools)
for the allocation of child care funds administered by the
California Department of Education.
Regional Composition
Under AB 1542, the members of the Task Force must be appointed half
by the County Board of Supervisors and half by the County Super-
intendent of Schools. Members appointed to the Task Force must
reflect five distinct groups (20% from each group) : 1) Consumers of
child care; 2) Child Care Providers; 3) Public Agency represen-
tatives; 4) Community Representatives who do not receive money from
the California Department of Education (CDE) ; 5) representatives
appointed at the discretion of each appointing authority. Every
effort must be made to ensure that the representation is reflective
of the ethnic, racial and geographic distribution of the population
of the county.
Actions to Date
Since appointments to the Local Planning Council are the
responsibility of the Superintendent of Schools and the Board of
Supervisors jointly, we have held two meetings with Dr. Joe Ovick
and his staff to review the requirements of AB 1542 . In addition,
we attended the Child Care Task Force meeting of September 24,
1997, at which time we invited the Ad Hoc Committee of the Task
Force to join the Superintendent of Schools and our two departments
in discussing the requirements of AB 1542 . This meeting is now
scheduled for 10: 00 a.m. on October 27, after the initial scheduled
meeting on October 17 was cancelled in deference to Ad Hoc members'
commitments (see attachment. )
Attached is a list of specific duties that the Local Planning
Council will be required to perform as excerpted from AB 1542 .
We believe that this collaborative approach will provide the Board
of Supervisors and Superintendent of Schools the best opportunity
to comply with the new law and effectively reconstitute the Local
Planning Council to provide broader representation.

SEC. 13. Chapter 2.3 (commencing with Section 8499) is added
to Part 6 of the Education Code, to read:
CHAPTER 2.3. LOCAL PLANNING COUNCILS
Article 1. Definitions
8499. For purposes of this chapter, the following definitions shall

(a) "Block grant" means the block grant contained in Title VI of
the Child Care and Development Fund, as established by the
Personal Responsibility and Work Opportunity Reconciliation Act of
1996 (Public Law 104-193).
(b) "Child care" means all licensed child care and. development
services and license-exempt child care, including,but not limited to,
private for-profit programs,nonprofit programs,and publicly funded
programs, for all children up to and including 13 years of age,
including children with special needs and children from all linguistic
and cultural backgrounds.
(c) "Child care provider"means a person who provides child care
services or represents persons who provide child care services.

8499.5. (a) The department shall allocate funds for purposes of .
this chapter, on a county-by-county basis, within all counties, based
on the amount of state and federal funding that is available. The
department shall annually notify the local child care and
development planning council in each county of the amount to be
allocated within its county, and the timeline for-these allocations.
(b) Upon approval by the county board of supervisors and the
county superintendent of schools, each local planning council shall
submit to the department the local priorities it has identified. The
priorities shall be identified in a manner that ensures.that all child
care needs in the county are met to the greatest extent possible. To
accomplish this, each local planning council shall do all of the
following: .
(1) Elect a chair and select a staff.
(2) Conduct an assessment of child care needs in the county no
less than once every five years. The needs assessment shall take. into
consideration all of the following:
(A) The needs of.families eligible for subsidized child care.
(B) The needs of families not eligible for.subsidized child care.
(C) The waiting lists for programs funded by the department and
the State Department of Social Services.
(D) The need for child care for children who have been abused
or neglected or are at risk of abuse or neglect.
(E) The number of children receiving public assistance.
(F) Family income .among families with preschool or schoolage
children.
(G) The number of children of migrant workers.
(H) The number of children with special needs.
(I) The number of children from all identifiable linguistic and
cultural backgrounds.
(J) Special needs based on geographic considerations, including
rural areas:
(K) The age of children,needing services.
(L) Any other factors deemed appropriate by the local planning
council.
(3) Document information gathered during the needs assessment
which shall include, but need not be limited to, data on supply,
demand, cost, and market rates for each category of child care in the
county.
(4) Encourage public input in the development of the priorities. 5
Opportunities for public input shall include at least one public
hearing during which members of the. public can comment on the
proposed priorities.

8499.7. It is the intent of the Legislature that any additional
conditions imposed upon local planning. councils shall be funded
from available federal funds to the greatest extent legally possible. -
SEC. 14. Chapter 2.5 (commencing with Section 8499) of Part 6
of the Education Code is repealed.
SEC. 15. Chapter 2:(commencing with Section 10200) is added to
Part. 7 of the.Education Code, to read:

TRAINING PLAN
10200. (a As used in this chapter,"CaIWORKs recipient"means
a parent or retaker relative receiving aid under Chapter 2
(commencing th Section 11200) of Part 3 of Division 9 of the
Welfare and Insti tions Code, or any successor program.
(b) The county perintendent of schools, the local community
College districts, th local school districts that provide adult
education, and the dir ctors of other job training programs in the
county shall develop a Ian by. March 31, 1998, that provides for
instructional and job. tr ing services to CaIWORKs recipients
within that county. The plan hall be approved by the county welfare
director. The,plan shall inclu e all of the following:
(1) 'An estimate of the num er of CaIWORKs recipients in that
county that are expected to r uire education and job training
services and a description of the t es of services necessary to meet
their needs, pursuant to the county. Ian required by Section 10530
of the Welfare and Institutions Code.
(2) An estimate of the number of.s ces available in short-term
classes. that. are offered as part of the. gular course schedule. at
educational institutions that maybe used CaIWORKs recipients
in that county.
(3) An estimate of the number, of full-tiro equivalent students
and average daily attendance rates that wil be generatedby
CaIWORKs recipients at each institution in excess f the number of

As current Chair of the Contra Costa County Child Care Task Force,I urge to table the
plan to reconvene the local planning group presented to you today.
It is vital for the local planning agency torepresent the county's diversity and the plata to
collect applications by December 16 does not allow enough time to adequately complete
the task.
The law does not speak to a January time line. As Janet Poole Brom the California
Department of Uucation's Child Development Division has clearly noted,the January
date is a suggestion,not a mandate.
In our October 27 meeting current Task Force members offered suggestions on how to
reach a cross section of possible applicants. We urge you and the County Office of
Education not to attempt to'keinvent the wheel"and grandfather in many of the current
Task Force members who bring experience as well as a deep concern for children to their
volunteer duties.
