HomeMy WebLinkAboutMINUTES - 11041997 - C2 01Z THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 4, 1997, by the following vote: AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla, DeSaulnier NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 97/620 (S & H § 1700) Subject: Resolution Declaring Highway Property in the City of Concord to be a County Highway State Route 242 Widening Project (Sts. & Hy. Code §1699 et seq) W.0. 3085 As part of the Contra Costa Transportation Authority State Route 242 widening project, a joint project undertaken by the Contra Costa Transportation Authority, the California Department of Transportation and the County, that portion of State Highway Route 242 depicted on Exhibit "A," attached hereto and incorporated herein by reference is to be widened. The County is currently in the process of acquiring the right-of-way for the State Route 242 Widening Project. In connection therewith, the County proposes to declare the highway property described on Exhibit "B," attached hereto and incorporated herein by reference, as a county highway for the purpose of acquiring rights-of-way and providing for construction, maintenance, improvement and repair activities; Once the right-of-way has been acquired by the County and the highway widening project in the area depicted on Exhibit "A" has been completed, the County shall relinquish any unexpired rights-of-way acquired in connection with the project to the State of California; NOW, THEREFORE, THE BOARD RESOLVES AS FOLLOWS: 1. This Board deems it for the best interest of the County of Contra Costa that the property described in Exhibit "B", attached hereto and incorporated herein by reference, be declared to be a county highway. 2. This Board hereby declares the property described in Exhibit "B" to be a county highway for the purposes of acquisition of right-of-way, construction, maintenance, improvement and repair, pursuant to Streets and Highways Section 1700. 3. The Clerk of the Board is hereby directed to cause a certified copy of this Resolution to be forwarded to the governing body of the City of Concord for its consent, pursuant to Streets and Highways Section 1701; 4. Upon the taking effect of an ordinance or resolution, adopted by the governing body of the City of Concord, containing the City's consent to the establishment of said County highway, the property described on Exhibit "B", attached hereto, shall become a county highway for purposes of acquisition of right-of-way, construction, maintenance, improvement and repair.
