III. Reasons for Recommendations and Background:
Shortly after the Board adopted the above-referenced Resolution of Necessity, the San Ramon
Creek Improvement project was delayed and the property rights were not required at that time.
IV. Consequences of Negative Action: If the Board fails to rescind its previous action, a cloud
might be created on the title of the subject owners and the District would be exposed to possible
inverse condemnation actions.
