I. Recommended Action:
APPROVE and AUTHORIZE the Chief Engineer to execute a Consulting Services Agreement on
behalf of the Bay Area Stormwater Management Agencies Association (BASMAA) between the Contra
Costa County Flood Control and Water Conservation District and Tom Richman & Associates for
technical support services mandated by Joint Municipal NPDES Permits issued by the San Francisco

Bay and Central Valley Regional Water Quality Control Boards to Bay Area Stormwater Management
Programs including the Contra Costa Clean Water Program, which consists of Contra Costa County,
seventeen of its incorporated cities and the Contra Costa County Flood Control and Water
Conservation District.
II. Financiallmpact:
The cost estimated to be $60,000 shall be fully funded by BASMAA member agencies. Contra Costa
County Flood Control & Water Conservation Districts funds will be used only to the extent of its
membership fee participation in BASMAA.
III. Reasons for Recommendations and Background:
The United States Environmental Protection Agency issued National Pollutant Discharge Elimination
System (NPDES) Regulations for stormwater discharges on November 16, 1990 requiring Contra
Costa County, seventeen of its incorporated cities and the Contra Costa County Flood Control and
Water Conservation District (hereinafter referred to as the Contra Costa Clean Water Program) to
implement their Joint Municipal NPDES permit for stormwater discharges issued by the San Francisco
Bay and Central Valley Regional Water Quality Control Boards. The Permits seek to significantly
reduce or eliminate all pollutants from entering the waters of the San Francisco Bay - Delta Region.
The Contra Costa Clean Water Program, as a member of BASMAA, has agreed to participate in this
organization to share resources and information, and to cooperate in other ways involving their
common interests. The funds for this project originate from annual dues paid by BASMAA members,
which include the Counties of Alameda, Santa Clara, San Mateo, Marin, and Contra Costa, the
Fairfield-Suisun Urban Runoff Management Program and the Vallejo Sanitation and Flood Control
District.
The BASMAA Board of Directors has directed BASMAA's New Development Committee to prepare
technical manuals for residential/commercial development. The BASMAA New Development
Committee performed a competitive selection process by issuing a Request for Proposal to 37
municipal planning, design and engineering firms. Six proposals were received and four firms were
selected for interviews. From this process, Tom Richman &Associates was unanimously selected.
IV. Consequences of Negative Action:
If the consulting services agreement with Tom Richman & Associates is not approved, then all
BASMAA member agencies will be in non-compliance with their Joint Municipal NPDES permits
issued by the San Francisco Bay and Central Valley Regional Water Quality Control Boards.
Potentially, fines totaling $10,000 per day for all affected entities could be imposed.
