BACKGROUND: In July, the Mobile Home Advisory Committee revised its operating rules (bylaws). One of the changes was to revise the charge given the Advisory Committee by the Board of Supervisors. The other was to request that the term of office for members of the Advisory Committee be reduced from four years to two years. The remaining changes were primarily technical in nature. All changes recommended by our Committee are outlined in the attached version of the bylaws, with additions in redlining and deletions in strikeout. Our Committee met with four members of the Mobile Home Advisory Committee on October 21, 1997. Our Committee believes that the broadening of the charge to the Advisory Committee is appropriate and have recommended that change, along with all of the technical changes which were requested by the Advisory Committee. We are not recommending that the term of office be reduced. Therefore, whether the term is two years or four years the incumbent is generally going to be reappointed if he or she wants to be reappointed. Reducing the term of office does not accomplish anything and simply requires more paperwork to process the reappointment. The Advisory Committee members with whom we met suggested that some members do not attend regularly and are not participating in the work of the Advisory Committee. We suggested that when this occurs, the member either be asked to resign or, if they are not attending meetings, that the Board of Supervisors be asked to declare the seat vacant for lack of attendance. We believe the Advisory Committee is accepting of this explanation and understands the alternatives that are available to them. -2- PROPOSED REVISIONS OCTOBER 1997 REVISED APRIL, 1991 OPERATING RULES OF CONTRA COSTA COUNTY MOBILEHOME ADVISORY COMMITTEE SECTION 1. GENERAL PROVISIONS Name: Mobilehome Advisory Committee Number of Members: 11 Day, Time and Place of Regular Meetings: 2:00 P.M., 3rd Thursday of month (as announced). Annual meeting is regular meeting for month of: January SECTION 2. NAME The name of this organization is that set forth above, and it is hereinafter referred to as "Committee". SECTION 3. CHARGES TO THE COMMITTEE 3.1 The Committee is a duly appointed advisory committee to the Contra Costa County Board of Supervisors, and its membership shall support and uphold all laws, ordinances, and regulations applicable thereto and setting forth its duties. 3.2 The Committee is charged with responsibility for the following objectives: a. SECTION 4. MEETINGS 6.1 This Committee shall meet on the days and at the time and place set forth above. 6.2 The Clerk of the Board of Supervisors shall be given notice of the established day, place and time of the meetings. 6.3 All meetings shall be open to the public. 6.4 The membership shall conform to the requirements of the Ralph M. Brown Act (Government Code Section 54950 ff). 6.5 A quorum shall conform of six (6) of the appointed members, one of whom shall be a duly elected officer. 6.6 Each member shall have one vote. 6.7 Summary minutes of each meeting shall be kept. SECTION 7. SECTION 8. DUTIES OF OFFICERS 8.1 The Chairperson shall: a. Preside over all regular and special meetings. b. Maintain communication with the Board of Supervisors as necessary. C. Have the authority to appoint special subcommittees as necessary. d. Perform other duties specified for the office of Chairperson in these rules. 8.2 The Vice-Chairperson shall: a. Preside and act for the Chairperson in his/her absence. 8.3 The Secretary shall: a. Keep a record of the minutes of all meetings. b. Keep a complete up-to-date roster of members. C. Conduct all correspondence unless otherwise ordered. d. Cause notices to be sent or delivered as required. e. Keep a record of attendance at all meetings. SECTION 9. AMENDMENTS These rules may be amended as follows: 9.1 An amendment may be proposed by any member of the Committee at any regular meeting of the Committee. 9.2 Upon majority vote of members of the meeting, the amendment shall be placed upon the agenda of the next scheduled meeting of the Committee. 9.3 The amendment to these bylaws, except as noted in 9.4 below, shall become -Page 4- effective immediately upon affirmative vote of at least eight (8) of the members in attendance and voting. 9.4 No amendment to these bylaws affecting the method of selection, term of office or duties of members or officers shall take affect during the term of office of these who may be affected by the amendment. -Page 5- Footnote ' 1997 MOBILEHOME RESIDENCY LAW DEFINITION SECTION 798.2. DEFINITION OF MANAGEMENT "Management" means the owner of a mobilehome park or an agent or representative authorized to act on his behalf in connection with matters relating to a tenancy in the park. (Enacted by Ch. 1031 (1978), eff. 1/1/79) 798.9. DEFINITION OF HOMEOWNER "Homeowner" is a person who has a tenancy in a mobilehome park under a rental agreement. (Amended by Ch. 1397 (1982), eff. 1/1/83) 798.11. DEFINITION OF RESIDENT "Resident" is a homeowner or other person who lawfully occupies a mobilehome.
