DISPOSITION OF ANY PROPOSED LIBRARY SALES TAX THAT IS COLLECTED

SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
DECLARE the intent of the Board of Supervisors to transfer any funds raised in
Richmond in the event of a successful library sales tax to the City of Richmond, with
the understanding that the Board is neither explicitly nor implicitly prejudging whether
a sales tax or parcel tax is appropriate.
BACKGROUND:
The Board of Supervisors has gone to extraordinary lengths to encourage
communication and cooperation with Contra Costa cities regarding the library
reorganization and library tax.
This process has not occurred with the City of Richmond because, until recently, the
parcel tax was the only option and there was no sentiment to include Richmond.
Following the legislative authorization of a county library sales tax (which must be
countywide and therefore must include Richmond), it now becomes vital to engage
Richmond in the same process of communication that has been accorded the other
cities. -

Following discussion of the above matter, Supervisor Rogers moved approval of the above
recommendation with the addition of a sentence "This declaration of intent is based on
the fact that Richmond has its own separate library system." Supervisor Gerber seconded
the motion. IT IS BY THE BOARD ORDERED that the above recommendation is APPROVED as
amended.

In meeting with the City of Richmond's City Council on October 14, 1997, Council
members requested that I bring an item to the Board of Supervisors to clarify that the
Board intends to give Richmond money raised under a sales tax, in recognition of
Richmond's separate library system. Councilmembers stated that this was a
prerequisite to the Council taking the time and energy to research, get public_input
on, and further discuss the issue.
Let me emphasize that this clarification is in Do way an explicit or implicit
recommendation to place a sales tax rather than a parcel tax on the ballot. Instead,
it is part of the process of the Board getting input from all quarters before making
that decision.
Everybody that I have talked to (County or City of Richmond) has supported the
common sense notion that since Richmond has its own library system it should get
any money raised by a sales tax in the City of Richmond. To do otherwise would
raise difficult legal, economic, and political difficulties.
Some may ask why we need an early decision on this issue when we haven't
decided whether to place a sales tax measure on the ballot. The reason is that we
need to communicate with Richmond prior to deciding on sales tax versus parcel tax.
To the extent that Board members may wonder whether it makes sense to be in
concord with Richmond on this request, I hope we would remember the extent to
which we have sought to be in concord with the requests of other large cities on the
library issue.
Accordingly, I ask that the Board of Supervisors approve the recommendation set
forth above.
