MICHAEL WALFORD, CHIEF ENGINEER DATE: October 14, 1997 SUBJECT: Approve Reimbursement for Extra Drainage Improvements by Danville Land and Development Corporation, Subdivision 6531, Drainage Area 48B, Bay Point area SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: A APPROVE exception to the terms in the May 25, 1993 reimbursement agreement between Danville Land and Development Corporation and the Contra Costa County Flood Control and Water Conservation District to permit immediate reimbursement of $28,485.90 which represents the cost of drainage improvements constructed beyond the developer's obligation by the conditions of approval for Subdivision 6531. B DETERMINE that the above reimbursement does not start the 40 quarters reimbursement period. II. Financial Impact: Repayment of the outstanding revolving fund loan to Drainage Area 48B will be delayed. Reasons for Recommendations and Background: The developer agreed to install additional improvements beyond the improvements required by the conditions of approval for his development. Said work completed this portion of the drainage plan. IV. Consequences of Negative Action: The developer will not be reimbursed for the volunteer extra work he performed, until the outstanding revolving fund loan to Drainage Area 48B is repaid.
