SUBJECT: Acquisition of Rodrigues Property, Oakley
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
A. ACCEPT Grant Deed from Harold Wilfred Rodrigues and Barbara Jean Rodrigues as
Trustees of The Rodrigues Revocable Intervivos Trust dated January 21, 1991;
B. AUTHORIZE the Deputy Director - Redevelopment to accept said Grant Deed on
behalf of the Redevelopment Agency and County;
C. APPROVE payment of $1,847,000 for said property rights and AUTHORIZE the
Auditor-Control.ler to issue a check in said amount payable to First American Title
Guaranty Company, 1850 Mt. Diablo Blvd., Ste. 300, Walnut Creek CA 94596, Escrow
No. 769011 to be forwarded to the Redevelopment Agency for delivery;
D. DIRECT the Deputy Director - Redevelopment to have the above referenced Grant
Deed recorded in the office of the County Recorder; and

E. AUTHORIZE the Deputy Director- Redevelopment, on behalf of the County and the Redevelopment
Agency, to enter into a contract with Treadwell & Rollo for a soils and groundwater assessment for
hazardous materials in an amount not to exceed $30,000.
FISCAL IMPACT
Total funds subject to payment are $1,877,000. This amount includes $1,847,000 to acquire the subject
property, and $30,000 for a hazardous materials assessment. Costs are to be shared equally by the County
General Liability Trust Fund (Trust Fund #4998) and Oakley Redevelopment funds (Fund 289500-7886).
BACKGROUND/REASONS FOR RECOMMENDATIONS
On September 23, 1997 the Board of Supervisors and the Redevelopment Agency authorized settlement
of Rodrigues v. County of Contra Costa, et al. Settlement calls for the County Redevelopment Agency to
purchase the Rodrigues property (AP #035-090-062 and 066) in exchange for dismissal of the lawsuit. The
recommended actions implement the settlement.
