RECOMMENDATIONS:
AUTHORIZE the Cable TV Administrator to sign an agreement with the Contra
Costa Historical Society/Contra Costa History Center for the provision of
photographs and archival documents for use in a series of video segments on Contra
Costa County's history.
AUTHORIZE the Cable TV Administrator to accept sponsorships for video
productions or Infonet development not to exceed $5,000 pursuant to Administrative
Bulletin Number 117.5.
FINANCIAL IMPACT:
None.
REASONS FOR RECOMMENDATION/BACKGROUND:
CCTV is developing a program entitled "At Your Service" to highlight County
departments. In this program there will be several segments including a history of
Contra Costa segment. The Contra Costa Historical Society has agreed to allow
CCTV to use photographs and other archival documents in return for
acknowledgment in the credits "Historical research and materials provided by Contra
Costa History Center" and the agreement that neither p rty will copyright or sell the

without an additional agreement .
Contra Costa Historical Society understands that copies may be made of the
production for the public by CCTV at cost. Their concern is mass production for
profit. Since this is not the business CCTV is in, staff recommends providing these
assurances in return for the use of this archived material. County Counsel has
reviewed and approved the language of the agreement.
In addition, CCTV has found that businesses and organizations in Contra Costa
County are interested in promotion on CCTV. Under the "Agreement for the
Delivery of Access Programming" with the Cable Operators, CCTV can not advertise
on its channel. However, sponsorships are permissible. Therefore, in order to
increase production dollars, staff requests the authorization from the Board to offer
and accept sponsorships for programs. Interested parties can sponsor one or more
programs or Infonet pages and in return receive recognition by an acknowledgment
such as," This program/ page has been sponsored in part by (Company Name,
address and logo)."

LETTER OF AGREEMENT BETWEEN THE CONTRA COSTA HISTORICAL
SOCIETY/CONTRA COSTA HISTORY CENTER (CCHC) AND CONTRA COSTA
TELEVISION (CCTV) REGARDING THE PRODUCTION OF A SERIES OF VIDEOTAPE
HISTORY SEGMENTS.
1. Contra Costa Historical Society/Contra Costa History Center (CCHC) and Contra Costa
Television (CCTV) will collaborate on a series of video segments featuring various chapters
of Contra Costa County's history. Each segment will be approximately one to three minutes
in length.
2. Topics for the historical segments will be initially proposed by CCHC. From these initial
topics, CCTV will select specific topic ideas. CCHC staff will assist a CCTV producer with
historical research and obtaining photographic material related to the selected topic. Based on
these materials, the CCTV producer will write a script for the segment. The script will be
submitted to CCHC for the purpose of verifying historical accuracy.
3. For each segment, photographs and other archival documents from CCHC's collection will
be selected for inclusion in the segment. These materials will be transported to the studio of
CCTV in Martinez by a courier designated by CCHC. These materials will then be
videotaped by CCTV staff. At no time will the CCHC courier be required to leave the
materials unattended.
4. The participation of CCHC will be prominently displayed in the credits of each segment, as
follows: "Historical research and materials provided by the Contra Costa History Center." In
addition, organizational information (e.g. phone number, address, membership contact) for
CCHC will be included in the credits.
5. CCTV retains the irrevocable right to televise the segments at any and all times that meet
CCTV's broadcasting/cablecasting needs and to retain copies of the programs for such
broadcasting/cablecasting. CCTV also retains the right to provide copies of the programs to
the general public for duplication costs only.
6. CCTV will provide three VHS copies of each finished segment to CCHC, which will retain
the right to present these VHS videotapes for educational purposes at any and all times that it
deems appropriate.
7. No money will be exchanged between CCHC and CCTV, for the creation, production
and/or distribution of the history segments.
8. It is not the intention of CCTV or CCHC to either copyright or sell the finished segments
or any material produced during the production of the segments. However, if in the future, if
either party elects to either copyright or sell the segments or any of the production materials
(e.g. raw footage, scripts), both parties will complete a written signed agreement regarding all
terms of the transaction, including issues of copyright ownership and distribution of royalties
or fees.
