SUBJECT: Legal action by Contra Costa County to halt the U.S. Department of
Energy's planned shipment of spent nuclear fuel rods through the San
Francisco Bay Area
Dear Supervisor DeSaulnier and Board Members:
On March 27, 1997, I wrote to State Attorney General Dan Lungren, along with ten other
members of the State Assembly, to request that he take legal action to stop the U.S. Department
of Energy's plan to import foreign spent nuclear fuel rods at the Concord Naval Weapons Station
and ship this dangerous material through Contra Costa Costa County and Northern California's
most heavily populated communities.
In July of 1997, the California Legislature officially came out against the Department of
Energy's planned California shipments. Assembly Joint Resolution 21,that I authored along
with Assemblymembers Carole Migden and Lynne Leach, was adopted in the State Senate and
Assembly with near unanimous bipartisan support.
AJR 21 calls upon the President and Congress to halt the five planned shipments of spent
nuclear fuel rods through the San Francisco Bay to the Concord Naval Weapons Station for land
transport to Idaho. It further calls upon the DOE to prevent these shipments until specified
actions are taken with regard to notice, safety and environmental impacts and compensation.
At this point it appears the State of California does not plan to initiate legal action.
It is vital that action be taken immediately at the local level to stop this ill-conceived plan from
taking affect early next year.

SUBJECT: Intervention to stop the U.S. Department of Energy's planned
shipments of spent nuclear fuel rods through the San Francisco
Bay Area and Northern California
Dear Vice President Gore:
I am writing you on behalf of the California Legislature to request your immediate
assistance to stop the U.S. Department of Energy's planned shipments of spent nuclear fuel rods
from foreign nuclear research reactors in Asia through the San Francisco Bay Area. It is
proposed that they be sent by ship through the San Francisco Bay to the Concord, California
Naval Weapons Station, and then transported by rail to the State of Idaho. This dangerous
material would be sent through Northern California's most heavily populated communities
beginning in early 1998.
The Department of Energy and the Department of State have proposed that the Port of
Concord, located at the Concord Naval Weapons Station, be used as the one West Coast port of
entry for spent nuclear fuel rods arriving from seven foreign countries. The DOE plans to utilize
this port, located in the San Francisco Bay Area's east bay suburb of Contra Costa County, to
receive at least five shipments of one metric ton of spent nuclear fuel, in 38 casks, over the next
thirteen years. The countries of origin include South Korea, Bangladesh, Thailand, Taiwan,
Philippines, Malaysia and Indonesia.
These shipments will consist of sealed casks containing shielded but highly radioactive
bundles of rods made up of enriched uranium and other byproducts, including plutonium.
The spent nuclear fuel casks -- each of which contain more radioactive material than a
nuclear bomb -- will pass directly under the Golden Gate Bridge, then move through a narrow
channel called the Carquinez Straits, which is lined with oil refineries and pipelines, under five
additional bridges, among vessels carrying millions of tons of petroleum and chemicals.

Casks containing spent fuel rods will be off-loaded at the dock of the Concord Naval
Weapons Station -- a liquefaction zone near an active earthquake fault -- where they will be
transferred to trains and shipped to the Idaho National Engineering and Environmental
Laboratory (INEEL), where they will be stored pending approval of a final resting place for the
radioactive material.
The planned rail route passes high above the Feather River Canyon, where trains have
derailed 28 times in 16 years.

The DOE's plan to return spent nuclear fuel through the Bay Area has met widespread
opposition from local governments, citizens groups and state agencies since it was announced in
the spring of 1995. At least 16 Bay Area communities have passed resolutions opposing the
proposal. A year ago, the Association of Bay Area Governments also registered its opposition to
the shipment plan on behalf of all city and county governments represented in the nine-county
San Francisco Bay Area region.
In addition, the San Francisco Bay Conservation and Development Commission, which
administers the federally approved State Coastal Management Program for the San Francisco
Bay, voted in March of 1997 to oppose the shipment of spent nuclear fuel rods through the San
Francisco Bay to the Concord Naval Weapons Station.
Despite this widespread opposition, the Department of Energy remains committed to
using Concord, California as an entry point for the spent nuclear fuel.
Mr. Vice President, I want to share with you that two senior officials with the Department
of Energy openly admitted that the proposed shipments through California are not a prudent use
of taxpayers dollars.

In a discussion I had in April of this year, David Huizenga, Associate Deputy Assistant
Secretary of Environmental Management for Nuclear Materials and Facility Stabilization, and
Robert M. Alcock, Deputy Assistant Secretary for Intergovernmental and External Affairs,
shared with me that the proposed route through California will cost significantly more to execute
than using the Charleston Naval Weapons Station in Charleston, South Carolina. The
Department of Energy currently has an agreement with the state of South Carolina to receive
nineteen tons of the spent nuclear fuel in 300 shipments from 34 countries through their East
Coast port.
As you can see, there are potentially significant state, regional and local impacts of the
proposed federal plan to ship spent fuel rods through the Bay Area and Northern California.
There are viable, less dangerous and cost efficient alternatives for shipping the rods as well as
alternative routes which do not go through one of the largest metropolitan areas of the country.
I am working together with Senator Tim Leslie, Assemblywomen Carole Migden and
Lynne Leach, as well as other legislators on both sides of the aisle, in both houses, to mobilize
the California Congressional delegation's opposition to halt these shipments through our state.
The local communities of the San Francisco Bay region have spoken. The California
Legislature has spoken. We urge you to reject the proposal by the Department of Energy to ship
these nuclear fuel rods through the San Francisco Bay Area and Northern California.
We respectfully request that you carefully review and evaluate the comments and
concerns that have been forwarded to the Department of Energy by California state and local
government. Mr. Vice President, your assistance and personal intervention is now needed to stop
this adverse plan from becoming a reality for the people of California.
