JUSTICE ASSISTANCE (BJA) - ESTABLISHMENT OF TRUST FUND AND
ADVISORY BOARD
Specific Request(s) or Recommendation(s) & Background & Justification
RECOMMENDATIONS:
1 . OPEN the public hearing regarding the proposed use of the Bureau of
Justice Assistance Local Law Enforcement Block Grants award of $186 ,250
to Contra Costa County; hear public testimony; close the public hearing.
2 . DIRECT the Auditor-Controller to establish Local Law Enforcement BGP
Fund #114400, an interest bearing trust fund for the award as required
by the Federal Bureau of Justice Assistance.
3 . ESTABLISH advisory board as specified by Federal Bureau of Justice
Assistance for project period ( 10/1/96 to 9/30/98) to include Warren
Rupf, Sheriff-Coroner; Gary Yancey, District Attorney; Joe Ovick,
Superintendent of County Office of Education; Jennifer Wiley-Fletcher,
Legal Director, Battered Women' s Alternatives; and Peter L. Spinetta,
Presiding Judge, Superior Court.
4 . AUTHORIZE the advisory board to review the application for funding under
the Local Law Enforcement Block Grants Program and make non-binding
recommendations to the Board of Supervisors for the use of funds
received under the Program.
REASONS FOR RECOMMENDATION/BACKGROUND:
The Board of Supervisors approved the application to the Federal Bureau of
JusticeAssistance on July 9, 1996 pursuant to the Local Law Enforcement
Block Grants Program and authorized the County Administrator or his designee
to sign the application on behalf of the County and execute any related grant
award documents or amendments .

The Omnibus Consolidated Rescissions and Appropriations Act of 1996 (P.L.
104-134 ) appropriated $503 million for Local Law Enforcement Block Grants
pursuant to H.R. 728 as passed by the House on February 14 , 1995 . Under H.R.
728, block grant funds are allocated to local jurisdictions, based on their
respective number of reported Part 1 violent crimes . Contra Costa County was
awarded $186,250 . The County, as recipient, agreed to provide $20, 694 over
the grant period in a cash match to be absorbed within the budgets of the
participating agencies . Special conditions required in the grant award
include establishment of a trust fund in which the Bureau of Justice
Assistance will deposit all payment received under this award and use of the
grant award in the trust fund (including interest) during the period not to
exceed 24 months from the date of the first Federal payment. The trust fund
is an interest bearing account that is specifically designated for this
Program.
The County also agreed that prior to the obligation of funds at least one ( 1)
public hearing would be held regarding the proposed use of the payment under
the Local Law Enforcement Block Grants in relation to its entire budget.
Contra Costa County is proposing to spend the grant and matching funds in the
Block Grants category of Enhancing Adjudication, specifically in the area of
improving the prosecution of domestic violence cases . The Sheriff ' s
Department will receive $75,000 of the Federal grant funds to pay for a FTE
Sheriff ' s Specialist and the purchase of one vehicle to be used by assigned
Domestic Violence staff . The Specialist will be assigned to the
Investigations Division and work with a Deputy Sheriff/Investigator and half-
time Crime Analyst/Statistician responsible for investigation of major
domestic violence cases, as well as establishing liaison with other divisions
and outside agencies .
These additional resources will allow for more emphasis on domestic violence
incidents, development of increased expertise resulting in better service to
victims and improved prosecution, increased reporting and increased number of
prosecutions . The District Attorney' s Office will receive $111,250 of the
Federal grant funds for . 75 Deputy District Attorney A-level and one B-Clerk.
These staff positions will become part of the District Attorney' s
comprehensive domestic violence prosecution unit (of 4 attorneys, 1 Sr.
Inspector, 2 Clerks and 1 Domestic Violence Counselor at Battered Women' s
Alternatives (BWA) . This entire unit in FY 1996/97 is grant supported. This
unit will be able to handle, on a vertical prosecution basis, all felony
level domestic violence, as well as the most serious misdemeanor cases . In
addition, staff will be able to coordinate and provide training in
conjunction with BWA, to the 25 law enforcement agencies in the County. A
full-time victim advocate for BWA funded through the District Attorney' s
grants, will provide victim support services through the criminal justice
process .

ON A PROPOSED EXPENDITURE OF A FEDERAL GRANT AWARD
CONTRA COSTA COUNTY
NOTICE is .hereby given that on Tuesday, January 28, 1997, at
11 a.m. in room 107 of the County Administration Building, corner
of Pine and Escobar Streets, Martinez, California, the Contra Costa
County Board of Supervisors will hold a public hearing to consider
the following:
The Omnibus Consolidated Rescissions and Appropriations Act of
1996 (P.L. 104-134) appropriated $503 million for Local Law
Enforcement Block Grants pursuant to H.R. 728 as passed by the
House on February 14, 1995 . Under H.R. 728, block grant funds are
allocated to local jurisdictions, based on their respective number
of reported Part 1 violent crimes . Contra Costa County has been
awarded $186,250. The County, as recipient, agrees to provide
$20,694 over the grant period ( 10-1-96 to 9-30-98) in a cash match.
the County will also establish a trust fund in which the Bureau of
Justice 'Assistance will deposit all payment received under this
award and will use the grant award in the trust fund (including
interest) during the period not to exceed 24 months from the date
of the first Federal payment. The trust fund is an interest
bearing account that is specifically designated for this Program.
The County agrees that prior to the obligation of funds at
least one ( 1) public hearing will be held regarding the proposed
use of the payment under the Local Law Enforcement Block Grant in
relation to its entire budget.
Contra Costa County is proposing to spend the grant and
matching funds in the Block Grant category of Enhancing
Adjudication, specifically in the area of improving the prosecution
of domestic violence cases . The Sheriff 's Department will receive
$75,000 of the Federal grant funds to pay for a FTE Sheriff ' s
Specialist and the purchase of one vehicle to be used by assigned
Domestic Violence staff. The Specialist will be assigned to
Investigations Division and work with a Deputy Sheriff/Investigator
responsible for investigation of major domestic violence cases, as
well as establishing liaison with other divisions and outside
agencies . The District Attorney's Office will receive $111,250 of
the Federal grant funds for . 75 Deputy District Attorney A-level
and one B-Clerk. These staff positions will become part of the
District Attorney's comprehensive domestic violence prosecution
unit (of 4 attorneys, 1 Sr. Inspector, 2 Clerks and 1 Domestic
Violence Counselor at Battered Women' s Alternatives (BWA) . This
entire unit in FY 1996/97 is grant supported. This unit will be
able to handle, on a vertical prosecution basis, all felony level
domestic violence, as well as the most serious misdemeanor cases .
In addition, staff will be able to coordinate and provide training
in conjunction with BWA, to the 25 law enforcement agencies in the
County. A full-time victim advocate for BWA funded through the
District Attorney's grants, will provide victim support services
through the criminal justice process .

I apologize for the delay in providing you with a detailed program and fiscal description of
how we intend to use the funds available to us through a joint District Attorney's Office/
Office of the Sheriff Local Law Enforcement Block Grant. I have provided a tentative
outline of the program below. Please advise me if you need additional information.
Use of Funds
This Office's share of the funds available under this grant shall be used as follows:
1. Pay for the salary of a Sheriffs Specialist position.
2. Purchase of one vehicle to be used by assigned Domestic Violence staff.
3. Join the District Attorney's Office in supporting a Battered Women's Alternative
Advocacy position.
Outline of Program
The Specialist position will be assigned to Investigations Division. The Specialist will work
with a Deputy Sheriff/Investigator who will be responsible for investigation of major
domestic violence cases, as well as establishing liaison with other divisions and outside
agencies. Both of these positions will also work closely with the Crime Analysts to develop
accurate statistics on the number and type of incidents.
Cooperation with Other Agencies
One of the major purposes of the program we are developing is to provide for close
collaboration with other public agencies and private groups. This will include close ties with

the District Attorney's Domestic Violence Unit, Battered Women's Alternatives, Rape Crisis
Center, other area law enforcement agencies, the courts, and any other agency or group
with a vested interest in this problem.
Impact of this Funding on the Problem
The ultimate impact on problems associated with domestic violence provided by this
program, in combination with other actions we are taking, cannot be accurately projected
at this time. It is reasonable to assume that, at the very least, the following improvements
will be noted:
1. More emphasis will be placed on domestic violence incidents.
2. The creation of specialized assignments will result in increased expertise which, in
turn, should result in better service provided to the victims and greater chances of
successful prosecution.
3. A much greater and more consistent flow of information shall be achieved between
the various public and private agencies with a vested interest in this problem.
4. Increased information and regular, inter-agency meetings should provide greater
understanding of the problems and more likelihood of additional corrections being
identified.
5. It is likely that, statistically, the initial response will be an increase in the number of
reported incidents of domestic violence, plus an increase in the number of
prosecutions. This is inevitable when such focusing of resources is directed at a
specific area. In the long-term, increased prosecution, increased awareness and
education, and increased service to the victims should have a major, positive impact
on this problem.
Overall, our belief is this program, combined with a Federal Domestic Violence Grant we
have received and are employing, are positive steps toward addressing a major problem
area in law enforcement and the community. The increased cooperation and sharing of
information between allied agencies, by itself, should positively impact working
relationships among these groups. We urge the County's continuing support for this effort.

Domestic violence is an area of growing public awareness and concern. For numerous
sociological reasons, the cases are difficult and time-consuming to investigate and
prosecute.
All modern, larger district attorney's offices have specialized units to handle domestic
violence cases. The better staffed offices include misdemeanor level crimes as well as
felonies in their caseloads.
Historically, the Contra Costa County District Attorney's staff has never been
augmented to support a specialized domestic violence prosecution team. Repeated
budget requests over the past several years for enhanced staffing to form such a team
have been routinely denied.
Fortunately, two years ago a small domestic violence prosecution grant became
available though the State Attorney General's Office. This money was used to fund
an experienced prosecutor full-time on domestic violence cases. She developed a
close working relationship with Battered Women's Alternatives and police agencies,
but was quickly overwhelmed with work. It became necessary to assigned another
experienced attorney to help the grant position which was drowning in work.
Unfortunately, this temporary augmentation put an even greater strain on the mainline
prosecution resources than normally expected due to the necessity of having to form
a Three Strikes team, also out of existing resources. In any event, it quickly became
evident that two lawyers an one-half investigator were totally inadequate to properly
handle even the felony level domestic violence cases.
At the 1996/97 County budget hearing, the Chief Deputy announced that the District
Attorney would be establishing a comprehensive domestic violence prosecution effort
funded with outside revenue. Fiscal year 1996/97 has brought the feasibility of
pooling several new grants and funding sources with the existing Department of
Justice grant to fund a properly staffed domestic violence prosecution unit. This goal
is only workable, given the unreliability and short term nature of grant money, because
of the nature of the District Attorney's fixed-term attorney program. The fixed-term
program allows a greater degree of flexibility for expansion and contraction of staff
than available in the general Merit System structure. If the grants are prematurely
terminated from insufficient outside funding and the county does not pick up the
programs, we would be forced to terminate our enhanced domestic violence
prosecution program and reduce attorneys and support staff.
The anticipated grant revenues for the comprehensive program include $ 111 ,250 in
federal block grant funds, $ 337,000 in State COPS money (which must be spent on
enhanced prosecution efforts), $ 62,000 form the City of concord as part of its
federally funded domestic violence grant, and $ 25,000 in Keller Canyon fees, in
addition to the existent State Department of Justice grant. These revenues will
finance personnel costs for four experienced deputy district attorneys, a full-time
investigator, a senior clerk, and an experienced level clerk, as well as a full-time victim
advocate from Battered Women's Alternatives. (See attached). Keller Canyon funds
will be used to match federal funds and will support 25% (FTE) attorney, which will
be dedicated to prosecuting East County domestic violence cases.
This unit should be able to handle, on a vertical prosecution basis, all felony level
domestic violence, as well as the most serious misdemeanor cases. In addition, staff
will be able to coordinate and provide training in conjunction with Battered Women's
Alternatives, to the 25 law enforcement agencies in the County. A full-time victim
advocate for Battered Women's Alternatives funded through the District Attorney's
grants, will provide victim support services through the criminal justice process.
Through the District Attorney's obtaining and dedicating outside funding to domestic
violence cases, NO COUNTY GENERAL FUNDS are needed to support this
comprehensive domestic violence prosecution program for the entire 1996/97 fiscal
year.
