THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on January 28, 1997 by the following vote:
AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla, DeSaulnier

RESOLUTION NO.: 97/47
SUBJECT: Completion of Improvements, and Declaring Certain Roads as County Roads,
Subdivision 7640, Oakley area.
The Public Works Director has notified this Board that the improvements in Subdivision 7640
have been completed as provided in the Subdivision Agreement with HPH Homebuilders 1995 L.P.
heretofore approved by this Board in conjunction with the filing of the Subdivision Map. Let it be
known that any required improvements for Minor Subdivision 7-95 were completed as well.
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of January 28, 1997,thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials) surety for $405,400, Bond
No. 1221199 issued by Insurance Company of the West be RETAINED for the six month lien
guarantee period until July 28, 1997, at which time the Clerk of the Board is AUTHORIZED to
release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Nutmeg Drive, Mercedes Lane, Clove Court, Clove
Way, Oregano Court, and Oregano Way the hereinafter described roads, as shown and dedicated for
public use on the Final Map of Subdivision 7640 filed August 17, 1995, in Book 381 of Maps at
pages 49-53, Official Records of Contra Costa County, State of California, are ACCEPTED and
DECLARED to be County Roads.

BE IT FURTHER RESOLVED that the widening of O'Hara Avenue is ACCEPTED and
DECLARED to be a County Road;
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established, and the$8,100 cash deposit(Auditor's Deposit Permit No. 264296, dated July 20, 1995)
made by BPH Homebuilders 1995 L.P., and the performance/maintenance surety for $802,700, Bond
No. 1221199 issued by Insurance Company of the West be RETAINED pursuant to the requirements
of Section 94-4.406 of the Ordinance Code until release by this Board.
