COhTR . 651 Pine Street, Room 106 Martinez, CA 94553 Dear Supervisor DeSaulnier: At the Concord City Council meeting held January 7, 1997, Concord Councilmembers adopted Ordinance 96-9, consolidating the City's municipal election with the statewide general election, and Resolution 97-8, requesting that the Contra Costa County Board of Supervisors approve the consolidation. The Board of Supervisors is hereby requested to agendize this request for approval of the consolidation. Ordinance 96-9 and Resolution 97-8 are enclosed for your reference. The process of consolidating a city election with the statewide general election is referred to in the California Government Code and the Elections Code. After a city has enacted an ordinance consolidating the election, the ordinance becomes operative upon the approval of the board of supervisors. The board of supervisors may deny any request, only if it finds that the ballot style, voting equipment, or computer capacity is such that additional elections or materials cannot be handled by the County Elections Office [E.C. 1002 and G.C. 36503.5(a)(1)]. The City of Concord requests that the Contra Costa County Board of Supervisors approve the consolidation. As stated in the ordinance and resolution, the Concord City Council approved the consolidation to reduce election costs for taxpayers and to increase voter turn-out in local elections. It is hoped the Board of Supervisors will enable the City of Concord to achieve these goals. Sincerely, Lynnet K ' 1, CMC City Clerk Enclosures cc: County Clerk City Councilmembers City Manager City Attorney uopy I ORDINANCE NO. 96-9 2 AN ORDINANCE CONSOLIDATING THE CITY OF CONCORD'S MUNICIPAL ELECTION WITH THE STATEWIDE GENERAL 3 ELECTION AND AMENDING CONCORD MUNICIPAL CODE ARTICLE H, CHAPTER 1, SECTION 2103 (ESTABLISHING 4 MUNICIPAL ELECTION DATES) 5 6 THE CITY COUNCIL OF THE CITY OF CONCORD DOES ORDAIN AS 7 FOLLOWS: 8 WHEREAS, the City's Municipal Election occurs and is consolidated.with the date of 7 election for the Mt. Diablo Unified School.District; and 10 WHEREAS, the Trustees of the Mt. Diablo Unified School District have elected to 11 consolidate their date of election with the statewide general election; and 12 WHEREAS, the City of Concord desires to reduce the cost to taxpayers of the costs of 13 election and, at the same time, increase voter participation in municipal elections. 14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CONCORD DOES 15 ORDAIN AS FOLLOWS: 16 Section 1. Concord Municipal Code Article II, Chapter 1, Section 2103 "Municipal Election 17 Dates" is amended to read as follows: 18 Section 2103. Municipal Election Dates. The date on which the City's municipal 19 election occurs shall be the same as, and consolidated with, the date of election for the 20 statewide general election. The first consolidated election shall occur no sooner than the first 21 Tuesday after the first Monday of November, 1998, and each succeeding election shall occur 22 on the first Tuesday after the first Monday of November of each succeeding even numbered 23 year. 24 Section 2. This Ordinance No. 96-9 shall become effective thirty days following its passage 25 and adoption, and operative upon the approval of the Contra Costa County Board of Supervisors. In 26 the event a summary of this Ordinance is published in lieu of the entire Ordinance, a certified copy of 27 the full text of this Ordinance shall be posted in the Office of the City Clerk at least five(5) days prior 28 to its adoption and within fifteen (15) days after its adoption, including the vote of the Ord.No. 96-9 I Councilmembers. Additionally, a summary prepared by the City Attorney's Office shall be published 2 once at least five (5) days prior to the date of adoption of this Ordinance and once within fifteen(15) 3 days after its passage and adoption, including the vote of the Councilmembers, in the Contra Costa 4 Times, a newspaper of general circulation in the City of Concord. 5 6 r 7 XTayor 8 ATTEST: 9 10 Lynnet i , CMC 11 City Clerk 12 (Seal) 13 14 Ordinance No. 96-7 was duly and regularly introduced at a regular joint meeting of the City 15 Council and Redevelopment Agency held on December 10, 1996, and was thereafter duly and 16 regularly passed and adopted at a regular joint meeting of the City Council and Redevelopment 17 Agency held on January 7, 1997, by the following vote: 18 AYES: Councilmembers -H.Allen, M.Pastrick, M.Peterson, L.Rosas, B.McManigal 19 NOES: Councilmembers -None 20 ABSTAIN: Councilmembers -None 21 ABSENT: Councilmembers -None 22 I HEREBY CERTIFY that the foregoing is a true and correct copy of an ordinance duly and 23 regularly introduced, passed, and adopted by the City Council of the City of Concord, California. 24 25 26 Lynnet Kei MC 27 City Clerk 28 Ord.No. 96-9 COPY 1 BEFORE THE CITY COUNCIL OF THE CITY OF CONCORD COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA 2 3 A Resolution Confirming the Consolidation of the Municipal Elections with the Statewide General Election 4 and Requesting the Contra Costa County Board of Supervisors to Approve the Consolidation 5 RESOLUTION NO. 97-8 6 7 WHEREAS, the Concord City Council has adopted Ordinance 96-9 which consolidates the 8 municipal election date with the statewide general election; and 9 WHEREAS, as a result of the consolidation of the municipal election with the statewide 10 general election the municipal election date will be moved from November of odd years to November 11 of even years; and 12 WHEREAS, the consolidation of the elections will result in the City saving money for the 13 cost of the municipal election and, at the same time, result in a significant increase in voter 14 participation; and. 15 WHEREAS, consolidation of the municipal election with the statewide general election will 16 result in the terms of office for City Councilmembers, City Clerk and City Treasurer to be increased 17 no more than twelve(12) months. 18 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CONCORD DOES 19 RESOLVE AS FOLLOWS: 20 Section 1. The adoption of Ordinance 96-9 will result in the municipal election being 21 consolidated with the statewide general election and will cause the next municipal election to be 22 moved from November 1997 to November 1998. 23 Section 2. The consolidation of the municipal election with the statewide general election 24 will extend the terms of City Councilmembers, City Clerk and City Treasurer by twelve(12) months. 25 The terms of office for Councilmembers Helen Allen, Michael Pastrick and Lou Rosas, City Clerk 26 Lynnet Keihl and City Treasurer Thomas Wentling will be extended until November 1998. The 27 terms of office for Councilmembers Bill McManigal and Mark Peterson will be extended until 28 November 2000. .Res.No. 97-8 ' I Section 3 The Contra Costa County Board of Supervisors is hereby requested to approve 2 the consolidation of the Concord Municipal Election with the statewide general election. 3 Section 4. The City Clerk is hereby directed to notify all registered voters of the changes in 4 election dates within thirty(30) days after the Board of Supervisors approve the consolidation. 5 Section 5.
