Phil Batchelor Costa County Administrator `'�Sla x�.�..;:.:k• .r�.� County J DATE: Januuary 7, 1997 SUBJECT: Ratification of the County Administrator's j Proclamation of a Local Emergency SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION Ratify the action taken by the County Administrator on January 3 , 1997 proclaiming a local emergency within the county, including all political subdivisions therein, and requesting the Governor to proclaim a State of Emergency for said jurisdictions. BACKGROUND The recent storms have caused emergency conditions throughout the county. Numerous incidents, including flooding and mudslides, have resulted in damage to public facilities and private properties. Several county government buildings incurred flood damage, notably the Pinole and Lafayette libraries. The Marsh Creek detention facility bridge sustained significant damage. Many of the cities have experienced numerous mud slides and flooded streets with damage to public infrastructure, private homes and businesses. Preliminary damage assessment reports indicate public and private storm related damage in excess of $13 Million. Based on information provided by the County Office of Emergency Services, the County Administrator, in accordance with Sections 42- 2 .802 and 42-2 .804 of the County Ordinance Code proclaimed a local emergency within the county and requested the Governor to proclaim the county to be in a State of Emergency. Such action makes the county and its political subdivisions eligible to apply for available State and Federal financial disaster assistance. ATTESTED January 7 , 1997 Contact: Gary Brown, Director OES 'PHIL BATCHELOR,CLERK OF THE BOARD OF cc: County OES SUPERVISORS AND COUNTY ADMINISTRATOR Coastal Region via IDES All Cities via OES BY DEPUTY PROCLAMATION DECLARING A LOCAL EMERGENCY AND REQUESTING GOVERNOR TO PROCLAIM A STATE OF EMERGENCY IN CONTRA COSTA COUNTY WHEREAS, Section 42-2.802 of the County Ordinance Code empowers the Administrator of Emergency Services (County Administrator) to proclaim the existence of a local emergency when the Board of Supervisors is not in session, but only after conferring with one or more members of the Board, including the Chairman, if available, or declaring in writing that such a conference is impossible; and WHEREAS, Section 42-2.804 of the County Ordinance Code empowers the County Administrator to ask the Governor to proclaim a state of emergency; and WHEREAS, the County Administrator does hereby find: That conditions of extreme peril to the safety of persons and property have arisen within this county, caused by storm and flood conditions commencing on December 29, 1996; and WHEREAS, many cities and the county have expended extraordinary resources to respond to storm/flood caused damage and local resources are now unable to cope with the effects of this emergency; and WHEREAS, continued storm activity may result in additional damage to public facilities and/or private property within the county or the political subdivisions within the county; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a Local Emergency now exists throughout this county including all political subdivisions therein; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said Local Emergency the powers, functions and duties of the Administrator of Emergency Services and the emergency organization of this county shall be those prescribed by state law, and by the ordinances, resolutions, and approved plans of this county; and IT IS FURTHER PROCLAIMED AND ORDERED that a copy of this proclamation be forwarded through the State Director of the Office of Emergency Services to the Governor of California with a request that he proclaim the County of Contra Costa including all political subdivisions therein, to be in a State of Emergency; and that he take action to have Contra Costa County included in a Presidential declaration for the incident period which began December 29, 1996, and IT IS FURTHER ORDERED THAT Gary Brown, County Emergency Services Director, is hereby designated as the authorized representative of the County of Contra Costa for the purpose of receipt, processing and coordination of all inquiries and requirements necessary to obtain available state and/or federal assistance for the public/private sectors.
