Management Agency Costs for Fiscal Year 1997/98 (Exhibit A) with a
recommendation for action.
FISCAL IMPACT
None to the General Fund. Congestion Management Agency costs are paid through state
gas tax subventions to the County.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Each year all local jurisdictions in Contra Costa receive a notice from the Contra Costa
Transportation Authority, acting as the County's Congestion Management Agency (CMA),
describing their estimated share of costs for administration of the CMA. These notices are
provided pursuant to the Joint Powers Agreement executed by the cities and the County
that established the CMA for the County. The County Administrator requested background
information on the funding arrangement for the CMA. The report to the County
Administrator is attached (see Exhibit A). If there are concerns by Board members this
report could be referred to the Transportation Committee for a recommended action.

Val Alexeeff requested that I provide a response to your June 26
questions concerning the subject item.
No. 1: How and why are we obligated to pay these costs?
We are obligated to pay these costs pursuant to a Joint Powers
Agreement (JPA) executed by all 19 jurisdictions which established
the Contra Costa Transportation Authority (CCTA) as the Congestion
Management Agency (CMA) for the county. That JPA includes a
formula for allocating the local contributions to defray the cost
of the CMA function. The allocation of $77, 625 is for FY 96/97 CMA
costs, not FY 97/98 CMA costs. The JPA provides for local
contributions on a reimbursement basis to the CMA. :
State law required each urban county in the state to establish a
CMA as a condition for local jurisdictions to receive their share
of the gas tax revenues generated by Proposition 111. That state
mandate was modified in 1996, making the CMA function discretionary
within a county. The CCTA agreed to continue the CMA function for
one year to see how other county's responded to the relief of the
mandate and how it affected a county's ability to influence
priorities for allocating state and federal transportation funds.
Consequently, the CCTA has adopted a CMA budget for FY ,97/98. The
local jurisdictions' share of the cost of the CMA is budgeted at
$135,841. The budget allocated 49.85% of this cost to Contra Costa
County ($67,717) .
No. 2: Do we acxree with the allocation formula?
No, but past attempts to change it have not been successful. The
formula was developed by the Public Managers Association in 1992 .
The County had proposed an alternative formula which determined a
local jurisdiction's share based on a combination of the revenues
received from Proposition 111 and Measure C-1988. The CCTA Board
did not support that alternative. At Supervisor Torlakson's
recommendation, the County requested that the CCTA reconsider the
formula in 1996, since few other CMAs in the state allocate the
local contribution in this manner. The CCTA Board declined to
change the formula.

Allen Payton In 1991, the Contra Costa Transportation Authority was designated by the
cities in Contra Costa County and the County as the Congestion Management
Julie Pierce Agency (the "CMA"). In 1993, local Contra Costa jurisdictions signed a joint

Attached please find your estimated share of cost for the administration of
the Congestion Management Agency for FY 1996-97. Do not pay the amount
listed in the attachment; this is not a bill. However, you should accrue this
amount for FY 1996-97. A final bill for FY 1996-97 will be sent to you in
November or December upon completion of the Authority's audit. Please call me at
256-4725, or Eleanor Schermerhorn at 256-4723, if you have any questions.
For FY 1997-98, the total estimated share of cost for local jurisdictions is
$135,841. You can budget your jurisdiction's share of cost based on the same
percentage shown on this table.
