RECOMMENDATION DELEGATE Board functions under Public Contract Code Sections 4107 and 4110 to the Director of General Services or his designee,pursuant to Public Contract Code Section 4114. II. FINANCIAL IMPACT This recommended delegation of functions will reduce Board and staff time and costs associated with public hearings for substitution of subcontractors. III. REASONS FOR RECOMMENDATIONS/BACKGROUND The Public Contract Code Sections 4107, 4107.5 and 4110 set forth procedures to be used by an awarding authority when a prime contractor seeks consent to substitute a subcontractor for a subcontractor listed in the original bid, claims an inadvertent clerical error in the listing of a subcontractor, or violates the provisions of the Subcontractor Listing Law. For contested matters, the procedures include a public hearing by the awarding authority (i.e., Board of Supervisors). Public Contract Code Section 4114 allows the Board to delegate its functions under Sections 4107 and 4110 to any officer designated by the Board. The authorized officer makes a written recommendation to the Board. The Board may adopt the recommendation without further notice or hearing, or may set the matter for a de novo hearing before the Board. This recommended delegation will provide a more efficient means of resolvingsubcontractorlisting disputes, without unnecessarily taking up the Board's time. The shortage occurred from April 1, 1903-through September 30, 1995 (42 months). This shortage is attributed primarily to the Jail Management System's computer errors.
