In the Matter of Confirming Benefit Levels
for Exempt Court Employees Res. No, 97/90
Designated employees and Judicial Officers of the Court are exempted from the County
Merit System (County Ordinance Code Section 33-5.349) and are governed separately in
theirterms and conditions of employment by authority of California Rules of Court, Rule No.
207. Pursuant to Standards of Judicial Administration Sec. 27 the Court administers an
approved personnel plan for Court appointed employees that provides for wage and job
classification, employee benefit plan, recruitment, selection, training, promotion, discipline,
and removal of employees of the court.
By direction of the Court, the salary and benefit levels of Court employees, if not
established specifically by the State, have generally conformed to those represented,
unrepresented and management classes in the County merit system whose duties and
responsibilities are similar; except that certain Court classes have been differentiated from
their merit system counterparts in type of benefits provided. These differences have
created on-going administrative difficulties and require clarification.
This Board Resolution provides that subsequent class changes, additions and deletions not
specifically contained herein will be identified by a resolution addendum to be adopted at
time of personnel action.
Therefore, in order to confirm the direction of the Court as to the level of benefits for its
various employees and to establish the necessary administrative record by which benefits
are granted, the Contra Costa County Board of Supervisors in its capacity as governing
Board of the County of Contra Costa, and all districts of which it is the ex officio governing
Board, RESOLVES THAT:
A. The Court has established and defined exempt class designations as follows (1)
Department Head, (2) Management, (3) Clerical, (4) Unrepresented, (5) Judicial
Officers, (6) Court Reporters, (7) Superior Court Judges. New court classificatlons_.-_
will fall within one of these designations.
B The class of Executive Officer-Coordinated Trial Courts of Contra Costa County
2AA2 has been designated as management-exempt [CF04(B)/CF05(BH)] and
eligible to those general benefits available to all merit system management
employees such as those set forth in Resolution 96/488 Compensation and Benefits
for County Officers, Managers and Unrepresented Employees. Additionally, this
single position is eligible to receive all benefits provided Department Heads.
Exception: Exempt Court management positions shall be credited with eight (8)
hours of paid holiday time on January 1, 1997 and January 1 thereafter.

G. The following Court Judicial Officer classes whose salaries are related to the salary
of Superior Court Judge and who have been designated as management-exempt
[CFO4(B)/CF05(BJ)) are eligible to sick leave accruals, group medical/dental
insurance and membership in the County Retirement System, management benefits
including life insurance, deferred compensation incentive, long term disability, and
sick leave incentive. These classes are not eligible to the following management
benefits: VDT users eye examination, Catastrophic Leave Bank, management
longevity pay differential, personal floating holiday accruals, management
administrative leave and management vacation accruals. These classes are
eligible to 168 hours vacation to be credited January 1, 1997 and January 1
thereafter. This time is non-accruable and all balances will be zeroed out effective
December 31 st each year.

H. The Court classes of Court Reporter-Superior Court JPS1 and Chief Court Reporter-
Superior Court 2BT1 are designated as unrepresented-exempt [CF04 (F)/CF05(FR)]
and are subject to terms of employment, including benefits, in accordance with
Rules of the Superior Court adopted by the Court on February 1, 1993 and further
amendments. (Rules for Superior Court Reporters). The vacation and sick leave
accruals afforded the Court reporter classes will be zeroed out at time of termination
or retirement. Court reporter classes shall continue to receive those general
benefits such as group medical/dental insurance and membership in the County
Retirement System.
1. The class of Judge, Superior Court-Group III (2RA1) [CF04(A)/CFO5(AJ)] has been
designated as management- exempt and are eligible to receive those benefits
afforded all department heads. As appropriate some benefits such as long term
disability may be prorated based on the county portion of the judicial salary.

Administrative Duties in the Class
of Supervising Program Analyst
WHEREAS, the Director of Information Technology has requested and the Director of Human
Resources has recommended that the salary range for Supervising Program Analyst (LAHC) be
restructured so that positions in the class which are assigned additional supervisory/managerial
responsibilities may be appropriately compensated for those added responsibilities; AND
WHEREAS, the County Administrator has approved this request;
NOW, THEREFORE THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS
RESOLVES THAT:
1. Effective December 1, 1996, the class of Supervising Program Analyst(LAHC) is reallocated
from salary schedule/level C5-2296 ($4510-5482) to salary schedule/level XB-2298 ($4510-
6044) and all incumbents are placed at the same salary step on the new range as they held on
the former range.
2. Incumbents in the class of Supervising Program Analyst are assigned one of four major areas
of the Systems and Program Sections of the Department of Technology. Upon
implementation of this resolution, the employee assigned the additional responsibility of
managing the County's Year 2000 Date Challenge Project may have his/her salary placement
advanced two steps on the salary range. The employee assigned may be reduced two steps on
the salary range upon removal of the additional administrative duties.
3. The anniversary date of employees in the class of Supervising Program Analyst shall not be
affected or changed by movement on the salary range related to the assignment described
herein.

SUBJECT: In the Matter of Implementing a Performance
Pay Plan For the Class of Assistant County
Assessor - Exempt.
THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS in its capacity as governing Board of
the County of Contra Costa and all districts of which it is ex-officio governing Board RESOLVES
THAT:
A. Salary Ranee: Effective February 1, 1997, the class of Assistant County Assessor - Exempt will be
reallocated from Salary Level C1 - 2517 to Salary Level XA - 2542.
B. Step Placement of Incumbents: Incumbents in the class shall be placed on the new salary range at
that step which is equal to their current salary step.
C. Performance Review: The appointing authority may, based upon an annual evaluation of work
performance, award one (2.5%) step for outstanding performance and/or the achievement of specific
performance-based objectives (hereinafter referred to as outstanding performance) to incumbents in the
class of Assistant County Assessor - Exempt.
If an employee does not receive outstanding performance pay on his/her annual evaluation date, an
extra salary review date may be set by the appointing authority for six (6) months after the annual
evaluation date. This date may be set by the appointing authority upon return of the Salary Review
Report to the Director of Human Resources or at another time prior to the extra review date six (6)
months after the employee's annual evaluation date.
If an employee was not awarded the outstanding performance step on his/her annual evaluation date,
the appointing authority may, based upon an evaluation of work performance, award an outstanding
pay step effective six (6) months after the annual evaluation date on the first of the month.
At the discretion of the appointing authority, effective the first of a calendar month, approval for
outstanding performance pay may be rescinded, based upon an evaluation of work performance, at any
time between annual evaluation dates. Outstanding performance pay in effect on the employee's annual
evaluation date is subject to evaluation by the appointing authority and must be affirmatively
recommended by the appointing authority to continue.
No salary step beyond Step 1 may be awarded for satisfactory performance. Step 2 is reserved
exclusively for outstanding performance pay. No provision of this section shall allow salary placement
beyond the uppermost step of the salary schedule/level to which the class is allocated.
D. The annual evaluation date for the outstanding performance step for employees shall be set by the
appointing authority.
E. Other Provisions - Except as may be changed or modified by resolution hereafter, all provisions of
the Salary Regulations are applicable to this class.

SUBJECT: In the Matter of Implementing a Performance
Pay Plan For the Class of Risk Manager.
THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS in its capacity as governing
Board of the County of Contra Costa and all districts of which it is ex-officio governing Board
RESOLVES THAT:
A. Hary Range: Effective February 1, 1997, the class of Risk Manager will be reallocated
from Salary Level C5 - 2507 to Salary Level -T9 2431.
B. StQp Placement of Current Incumbent• The incumbent in the class shall be placed at step 9
of the new salary range.
C. Merit Salary increment Review - On the employee's anniversary date, the appointing
authority may, based upon an evaluation of work performance, award a merit increment of 5%
for satisfactory performance of the employee. The salary advancement shall be granted only
on the affirmative action of the appointing authority. In no case shall a step be awarded
beyond step 9 of the salary range for satisfactory performance. The appointing authority may
unconditionally deny a salary increment advancement or may deny the step subject to review at
a specified date before the next anniversary date.
D. Performance Review; The appointing authority may, based upon an annual evaluation of
work performance, award either a one (1) 2.5% step increment or two (2) 2.5% step
increments for outstanding performance and/or the achievement of specific performance-based
objectives (hereinafter referred to as outstanding performance) to the incumbent in the class of
Risk Manager.
If the employee does not receive outstanding performance pay on his/her annual evaluation
date, an extra salary review date may be set by the appointing authority for six (6) months
after the annual evaluation date. This date may be set by the appointing authority upon return
of the Salary Review Report to the Director of Human Resources or at another time prior to
the extra review date six (6) months after the employee's annual evaluation date.
If the employee received an outstanding pay step of 2.5% on his/her annual evaluation date,
the appointing authority may, based upon an evaluation of work performance, award an
additional 2.5% outstanding performance pay step effective six (6) months after the annual
evaluation date on the first of the month. If an employee was not awarded an outstanding
performance step on his/her annual evaluation date, the appointing authority may, based upon
an evaluation of work performance, award one (1) or two (2) outstanding pay step(s) effective
six (6) months after the annual evaluation date on the first of the month. In no instance,
however, shall an employee be awarded more than two (2) 2.5% outstanding performance pay
steps between annual evaluation dates.
At the discretion of the appointing authority, effective the first of a calendar month, approval

performance, at any time between annual evaluation dates. Any outstanding performance pay
step(s) in effect on the employee's annual evaluation date are subject to evaluation by the

In instances where the employee is receiving outstanding performance pay at the time that a
merit increment is approved, the employee's base salary step for satisfactory performance will
be adjusted to reflect the 5% merit increase. The employee's salary step placement will then
be further adjusted for the current outstanding performance pay that the employee had been
receiving using the employee's new merit step as the base upon which the performance pay
step(s) are added.

are reserved exclusively for outstanding performance pay. No provision of this section shall
