Mrack and the County for construction of certain improvements in Subdivision 7780, Alamo area, through December 7, 1997; Approximate percentage of work complete: 0% Anticipated date of completion: unknown Reason for extension: Developer has not elected to construct improvements to date because of the depressed building industry. This subdivision split one parcel into five lots. The improvements secured by this agreement are to serve these new lots. To date, the developer still owns all five lots. The Public Works Director has notified this Board that the improvements in Subdivision 7082 have been completed as provided in the Subdivision Agreement with Tow-Chyuan Chen, Jin Li Chen and Tzan-Chien Chen heretofore approved by this Board in conjunction with the filing of the Sub- division Map, NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of February 11, 1997 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT SURETY July 10, 1990 $30,050 labor and materials deposit (Deposit Permit No. 167155, dated January 5, 1990) BE IT FURTHER RESOLVED that the $30,050 cash security for labor and materials (Auditor's Deposit Permit No. 167155, dated January 5, 1990)deposited by Tow-Chyuan Chen, Jin Li Chen and Tzan-Chien Chen be RETAINED for the six-month lien guarantee period until August 11, 1997, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file.
