Supervisor DeSaulnier recommends the following people be reappointed as District
4 representatives to the Countywide Youth Commission for an interim term ending

It is has been determined that terms based upon the school year, rather than the
calendar year, work better for the students who make up CYC. When the interim
term expires on August 31, 1997, the above representatives will then have the
option to be reappointed for the full two-year term.

On behalf of the Advisory Council on Aging, it is recommended that the Board of Supervisors
take the following action:
Declare vacant the Local Committee seat held by Woodie Williams. Mr. Williams' term expires
September 30, 1998.
JUSTIFICATION:
Mr. Williams has resigned from the Advisory Council. It is necessary to fill this vacancy in an
effort to bring the Advisory Council to its required number of active members.

SUBJECT: LEGISLATION: SB 154 (Thompson)

RECOMMENDATION:
ADOPT a position in SUPPORT of SB 154 by Senator Mike Thompson, which would
authorize a board of supervisors to impose a sales tax increase for library
construction, acquisition, programs, or operations in an amount of either 1/8¢ or %0
for not to exceed 16 years, providing that the voters approve the increase by a2/3
vote.
BACKGROUND:
In the past, the Board of Supervisors has been very supportive of a variety of
measures to provide additional funding to libraries. In the Board's 1997 legislative
program, the Board supports bond measures being placed on the ballot to provide
additional funding for libraries.
Senator Thompson has introduced SB 154 which takes a somewhat different
direction. It would allow a board of supervisors to increase the sales tax by either
1/8¢ or %0 for not to exceed 16 years, providing the measure is first submitted to the
voters and is approved by a 2/3 majority.
The funds could only be used for funding public library construction, acquisition,
programs, and operations within the county. The revenue from the sales tax
increase could only be used to supplement and not supplant existing funding.
In view of the Board's continuing support for the County Library, it is recommended
that you go on record in support of SB 154

An act to add Chapter 2.98 (commencing with Section
7286.59) to Part 1.7 of Division 2 of the Revenue and Taxation
Code, relating to taxation.
LEGISLATIVE COUNSEL'S DIGEST
SB 154, as introduced, M. Thompson. Transactions and use
taxes: counties: public libraries.
Existing law authorizes various local governmental entities,
in accordance with certain requirements and limitations, to
levy transactions and use taxes pursuant to the Transactions
and Use Tax Law.
This bill would additionally authorize the board of
supervisors of a county to impose a transactions and use tax at
a rate of 0.125% or 0.25% by the adoption of an ordinance, as

The people of the State of California do enact as follows:
1 SECTION 1. Chapter 2.98 (commencing with
2 Section 7286.59) is added to Part 1.7 of Division 2 of the
3 Revenue and Taxation Code, to read:

5 CHAPTER 2.98. COUNTY TRANSACTIONS AND USE TAX FOR
6 LIBRARY PROGRAMS

8 7286.59. (a) In addition to the tax levied pursuant to
9 Part 1.5 (commencing with Section 7200) , and any other
10 tax authorized by this part, a board of supervisors of a
11 county may impose a transactions and use tax in lieu of,
12 and not in addition to, a tax imposed under Section 7285.5
13 for the purposes described in paragraph (3), by the
14 adoption of an ordinance in accordance with this part if
15 each of the following conditions are met:
16 (1) The ordinance imposing the tax is submitted to and
17 approved by the voters of the county by a two-thirds vote
18 of those voters voting on the ordinance in accordance
19 with Article 3.7 (commencing with Section 53720) of
20 Chapter 4 of Part 1 of Division 2 of Title 5 of the
21 Government Code.
22 (2) The tax is imposed at a rate of 0.125 or 0.25 percent
23 for a period not to exceed 16 years.
24 (3) The revenues collected from the tax are used only
25 for funding public library construction, acquisition,
26 programs, and operations within the county. These
27 revenues shall be used only to supplement existing
28 expenditures for public libraries and shall not be used to
29 supplant existing funding for the support of public
30 libraries.
31 (4) The transactions and use tax conforms to Part 1.6
32 (commencing with Section 7251) .
33 (b) "Public library" means a library, or two or more
34 libraries that are operated as a single entity by one or
35 more public jurisdictions, that serve the general public
36 and are required to report appropriations to the State
37 Librarian under the provisions of Section 18023 of the
38 Education Code.

ACKNOWLEDGE that the Board of Supervisors is the sponsor of SB 159 which has
been introduced by Senator Richard Rainey. As introduced, SB 159 would
designate Contra Costa County as a demonstration site to test the value of
concurrent planning as a means of speeding up the adoptions process and
increasing the number of children who are adopted where reunification is no longer
a realistic possibility.
BACKGROUND:
On November 19, 1996, the Board of Supervisors adopted its legislative program for
1996. Included in the legislative program was the following item:
"8. SPONSOR legislation or seek an administrative decision
to designate Contra Costa County as a demonstration
county under the Governor's Adoption Initiative.
In the 1996-97 State Budget, the Governor proposed a concurrent
planning model whereby Social Service Department staff would
concurrently plan for the long-term placement needs of a child while
still trying to return the child to his or her family. In this way, if it turns
out that preserving the family unit is not going to be possible,
planning will already be underway or completed for addressing the

believes that this County is ideally situated to be a demonstration
county for this purpose. The Department's experience and level of
readiness could help the State identify the pluses and minuses of
launching the initiative statewide. It is not clear at this time whether
legislation is necessary for this or whether simply an administrative
decision within the State Department of Social Services could
accomplish the designation."
Senator Rainey has agreed to author this legislation for the County and has
introduced SB 159 for this purpose. Additional amendments will be needed to flesh
out what is a very preliminary version of the bill at this point. In view of the fact that
SB 159 has been introduced at the request of the Board of Supervisors, it is
appropriate for the Board of Supervisors to acknowledge its sponsorship of SB 159.

An act to add Section 16003 to the Welfare and Institutions,
relating to public social services.
LEGISLATIVE COUNSEL'S DIGEST
SB 159, as introduced, Rainey. Children: placement.
Existing law provides for the placement of a child in foster
care when the child is removed from his or her family home.
This bill would require the Director of Social Services to
designate Contra Costa County as a pilot county to test the
effectiveness of concurrently planning for family
reunification and for placement in an adoptive home. The bill
would authorize Contra Costa County to apply to the
department for an unspecified amount from an item in the
Budget Act of 1996 for this purpose.

3 (a) The Governor proposed an adoption initiative in
4 the 1996-97 State Budget and has provided $7,000,000 to
5 improve the statewide adoption system by removing
6 barriers that keep children in long-term foster care and
7 impede public agency productivity.

1 (b) Concurrent planning is a method whereby
2 reuniting a child with his or her family and permanency
3 planning in an adoptive home are pursued
4 simultaneously in order to speed up the placement of the
5 child with an adoptive family if returning the child to his
6 or her birth family is determined not to be possible.
7 (c) The success of concurrent planning hinges on the
8 ability of a county welfare department to find, recruit,
9 and prepare a pool of families who can provide a foster
10 home while the goal for the child is reunification with the
11 birth family, and who can also commit to adopting and
12 raising the child if reunification fails.
13 (d) Concurrent planning is consistent with the goals of
14 the Governor's adoption initiative and should be tested to
15 determine its value in increasing the number of
16 adoptions.
17 (e) Contra Costa County is presently testing
18 concurrent planning and is willing to serve as a
19 demonstration site to test the value of concurrent
20 planning in increasing the number of adoptive
21 placements and decreasing the time required to finalize
22 an adoption.
23 SEC. 2. Section 16003 is added to the Welfare and
24 Institutions Code, to read:
25 16003. (a) The director shall designate Contra Costa
26 County as a pilot county to test the effectiveness of
27 concurrent planning as a means to increase the number
28 of adoptions and to decrease the time required to finalize
29 an adoption.
30 (b) Contra Costa County may apply to the
31 department for an amount not to exceed dollars
32 ($ ) from the Governor's adoption initiative,
33 which is incorporated in Item 5180-001-0001 of the Budget
34 Act of 1996 (Ch. 162, Stats. 1996) , for the purpose of
35 testing concurrent planning pursuant to subdivision (a) .
